RELEASE FOR BUBBLE/FOAM PARTY PARTICIPANTS                                                

Participation Acknowledgement

I hereby acknowledge that I have read and understood the risks and hazards associated with participating in the Foam and/or Bubble Party event, including t not limited to:

• Injuries from slipping, tripping, or falling on foam or other surfaces
• Contact with others or objects while in the foam environment
• Exposure to loud music and strobe lights
• Potential allergic reactions to foam or other substances used in the event

Release of Liability

In consideration of being allowed to participate in the Foam and/or Bubble Party event, I hereby release and hold harmless Top Kids Gym & Sports, its officers, directors, employees, and agents (collectively “Releasees”) from any and all claims, demands, actions, or causes of action, whether known or unknown, arising out of or in connection with my participation in the event, including but not limited to:

• Any injuries or damages I may suffer as a result of my participation
• Any claims arising from the negligence or misconduct of Releasees

Indemnification

I agree to indemnify and defend Releasees against any and all claims, demands, actions, or causes of action arising out of or in connection with my participation in the event, including but not limited to:

• Any injuries or damages I may cause to others or property
• Any claims arising from my breach of this Waiver and Release of Liability

Acknowledgement of Risks

By signing below (electronically), I acknowledge that I have read and understood the risks and hazards associated with participating in the Foam and/or Bubble Party event and that I am voluntarily assuming those risks.

 

GENERAL RELEASE                                                                                      

DISCLAIMER:  Top Kids Gym & Sports ("Top Kids") is not responsible for any injury (or loss of property) to any person while practicing, training, taking class, competing, participating in open gym, special events, demonstrations or shows, or in any other way involved in gymnastics, tumbling & trampoline, ninja, or teams (the “activity”) at Top Kids for any reason whatsoever, including ordinary negligence on the part of Top Kids, its members, managers, agents, or employees.

CONSENT: I consent to  my/minor’s participation in the activity and acknowledge that I fully understand my/minor’s participation may involve risk of serious injury, illness, or death, including losses which may result not only from my/minor’s own actions, inactions or negligence, but also from the actions, inactions, or  negligence of others, the condition of the facilities, equipment, or areas where the activity is being conducted, and/or the rules of play of this type of activity. I understand that if I have any risk concerns, I shall discuss them completely with the staff before I sign this agreement and before my/minor’s participation in the activity begins.

Knowing and understanding the risks involved with participation in the activity, I hereby voluntarily and willingly assume full and complete responsibility for all losses and damages, including injury, illness, and death, resulting from my/minor’s participation in the activity, including transportation to and from the activity. I agree I am financially responsible for any losses and damages resulting from my/minor’s participation in the activity.

In the event of emergency I would like my above mentioned child(ren) to be taken to a hospital for medical treatment and I hold Top Kids Gym & Sports and its representatives harmless in their execution of this action. Additionally, I hereby agree to individually provide for all possible future medical expenses which may be incurred by my child as a result of any injury sustained while participating at or for Top Kids Gym & Sports.

If your child requires an inhaler, I understand I am required to stay with him/her or get a doctor’s release.

WAIVER: In consideration for my/minor’s participation in the activity, I hereby waive all claims or causes of action, including ordinary negligence, against Top Kids, its managers and members, and any of their employees, teachers, coaches, or agents, arising out of my/minor’s participation in the activity wherever, whenever or however the same may occur. I understand that this waiver is intended to be as broad and as inclusive as permitted by the laws of the State of Texas and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect. I further agree that the venue for any legal proceedings shall be within the State of Texas.

I have read this form and fully understand that by signing this form, I am giving up legal rights and or remedies which may be available to me/minor for the ordinary negligence of Top Kids or any person listed above.

PHOTO & VIDEO RELEASE: I grant consent for my/minor’s picture to be taken or to be filmed while participating in activities at Top Kids. I authorize Top Kids to use and publish images, photographs, pictures, portraits, and audio, video and/or film footage of me/minor in all forms of media and in all manner for publication including, but not limited to, advertising and marketing campaigns, press releases, periodicals, and website use. I hereby waive any right I may have to review, inspect, edit or approve such publication and I release Top Kids from any claims I may have against it for use of such images, photographs, pictures, portraits, and audio, video and/or film footage of me.  

By your attendance at Top Kids Gym & Sports, you are granting your permission for you and your child to be filmed, videotaped or photographed by any means and are granting full use of your likeliness, voice and words without compensation.

 

I affirm that I am of legal age and am freely signing this agreement.

By signing this agreement, I affirm that the information provided within is accurate and complete and that I am the legal guardian/parent of the child(ren) listed within.
