CONTRACT AGREEMENT

The Terms and Conditions (“Agreement”), by and between Zekes Mobile Multi-Services LLC, d/b/a Zekes Justice League Services, in its capacity as a court process server “(process server”) and customers not otherwise contracted with “Customer”, provides as follows:

Process Service of your legal documents, includes up to 3 attempts within 7 Days and 1st attempt within 24 hours and Video Recording of the Respondent being issued the legal documents for your records.

Services; Zekes Justice League Services will provide court process serving, document retrieval and/or skip tracing for process serving on behalf of the Customer, its agents or its employees that have actual or apparent authority to bind the Customer. At all material times, Zekes Justice League Services will exercise in its own professional judgment the method and manner of performing such services. The scope of such services will be reflected in an Invoice that will accompany service performed by Zekes Justice League Services.

Rates & Charges Firm; Customer agrees to pay the amount identified on the Quote/Invoice on same day of receipt of the Quote/Invoice. All quotes/invoices paid by credit cards, wii be charged a 5% credit card processing fee. Prior to performing of services under this agreement, Zekes Justice League Services will issue an Quote/Invoice to Customer, which is due upon receipt. Customer will not and shall not have the right to withhold or offset the payment of charges for any reason or they shall forever be barred from my services.

Guarantor; The Customer and guarantor (if applicable) shall be liable, jointly and severally, for all unpaid charges payable on account of services.

Term and Termination; The term of this agreement shall commence when executed by Zekes Justice League Services and shall continue until assignment is completed or terminated by either party upon.

Notices; Any and all notices required by this Agreement shall be in writing and delivered to the party entitled to receive same by email, hand delivery or by U.S. Certified Mail to the address identified in this Agreement.

Modification; All of the essential terms or representations made prior to, or contemporaneously made herewith, are included within this Agreement. This Agreement can only be modified by a written instrument duly authorized and executed by both parties.

Severability; If any term or provisions of this Agreement or any application thereof shall be held to be invalid or unenforceable, the remainder of this Agreement shall not be affected thereby and shall remain in full force and effect.

Attorney Fees and Expenses; If either party brings an Action to enforce their rights under this agreement, the prevailing party may recover its expenses (including reasonable attorneys' fees) incurred in connection with the Action and any appeal from the losing party.

It is my mission to serve your important documents in the most time and cost effective manner.

Zekes Justice League Services uses body cameras while process serving to discourage anyone from reporting that they were not served. This saves the client money on not having to pay for unnecessary court appearances.

In California, “Registered Process Servers” are granted “…a limited exemption against trespassing in gated communities.” This allows servers to enter a private property for a reasonable period of time to attempt service of process. In California, gated communities which are “…staffed by a security guard, or where access is controlled, must allow a Registered Process Server to enter for service of process upon presenting valid identification, and indicating to which address the process server is going.” § 415.21 Access to gated communities.

All attempts will be made to locate and serve the respondent. I will give you a report of all attempts made to locate and serve the other party: including dates, times and addresses I went to in an attempt to find the respondent.

Make sure to get his/her correct current living address and work address. Including address of individuals he/she may have close ties with.

Also the Make/Model/Color/Picture if possible of vehicle.

Also a current picture of person being served.

At anytime I feel my safety is in jeopardy due to individual or individuals has threaten my life/safety. I will stop service and will refuse to continue with service. I will advise you of incident and provide you a police report if one is done.
I will return 1/2 your money back.

Because I’m not affiliated with the Kern County Sheriffs Department or any Law Enforcement Agency and because I am a small business. I do have the right to refuse to take your assignment or any future assignments that you may have.

Does the US law prohibit a person from tracking someone without the consent?

Penal Code §637.7

(a) No person or entity in this state shall use an electronic tracking device to determine the location or movement of a person.

(b) This section shall not apply when the registered owner, lessor, or lessee of a vehicle has consented to the use of the electronic tracking device with respect to that vehicle (You must provide copy of you vehicle registration - proof of ownership of vehicle).

(c) This section shall not apply to the lawful use of an electronic tracking device by a law enforcement agency.

(d) As used in this section, “electronic tracking device” means any device attached to a vehicle or other movable thing that reveals its location or movement by the transmission of electronic signals.

(e) A violation of this section is a misdemeanor.
