Session Reservation Fee
Upon execution of this Agreement, your non-refundable session reservation fee of $150 for studio sessions or $250 for outdoor sessions is due to reserve photography services for your requested session date and time. Upon receipt of and as consideration for your session reservation fee, Mark Stevens Photography shall remove your requested date and time from calendar availability for other clients or potential clients.
Due to your session reservation’s exclusivity, please note that your session reservation fee is non-refundable. You may move your appointment with seven days notice with no penalty. Appointments canceled with fewer than seven days notice and no-shows will forfeit the session fee. If you are more than 20 minutes late you will be considered a no-show.
In the event you are using a gift certificate to schedule your session, you agree to pay a $150 missed session fee to reschedule a no-show or last minute cancellation. Your gift certificate can not be applied toward this fee.
Photography Session
Your Portrait Session will last approximately one hour and your reservation fee covers Mark Stevens Photography’s time and talent only. No products, including digital images, are included with the reservation fee.
Your session will include an in-person ordering appointment and, upon request and availability, an in-person pre-session consultation.
It is understood and agreed that Mark Stevens is the exclusive official photographer retained to perform the photographic services referenced in this Agreement.
NO OTHER CAMERAS, CAMERA PHONES OR OTHER RECORDING DEVICES ARE ALLOWED AT THE SESSION. It is distracting for both the photographer and the subjects.
Ordering Appointments and Minimum Order Requirements
Orders placed pursuant to this Agreement are based on Mark Stevens Photography’s Standard Price List. Such price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
Orders must be placed at your in-person ordering consultation at the studio. Images are not presented online or in take-home form. All decision makers must be present at this appointment. In the event a decision maker is not present during the ordering appointment, the decisions of the person present will be binding and may not be canceled. During this appointment, Mark Stevens will present the lightly edited images from your session for your review and order selection.
If you do not love your images you may elect to purchase nothing.
Mark Stevens Photography reserves the right to assess a $150 cancellation fee for cancellations made within 2 days of an in-person ordering appointment. Failure to attend an in-person ordering appointment shall be deemed a cancellation.
Payment Responsibilities and Image Archiving
Payment must be made during your in-person ordering appointment and orders are not fulfilled until the balance is paid in full. ALL SALES ARE FINAL AND NON-REFUNDABLE.
With a minimum initial order of $850, purchased images will be archived for no additional charge. Images that are not purchased will be permanently deleted after the expiration of fifteen (15) days from the in-person ordering appointment.
Copyright, Model Release and Artistic Control
NOTICE OF COPYRIGHT: IT IS ILLEGAL TO COPY OR REPRODUCE THESE PHOTOGRAPHS OR VIDEOS ELSEWHERE WITHOUT MARK STEVENS PHOTOGRAPHY’S WRITTEN PERMISSION, AND VIOLATORS OF APPLICABLE FEDERAL COPYRIGHT LAW WILL BE SUBJECT TO ITS CIVIL AND CRIMINAL PENALTIES.
Mark Stevens Photography reserves the right to use images created under this Agreement for advertising, display, publication or other purposes. The undersigned warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Mark Stevens Photography in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of Mark Stevens Photography.
Mark Stevens Photography regularly works with its clients to deliver photographs which will meet their individualized needs, however, Mark Stevens Photography reserves the right to exercise full artistic control over the nature, number, types, sizes, and editing processes of all images it shoots and produces as finished products.
Pets
Mark Stevens Photography welcomes pets at your session. The undersigned is responsible for disclosing all behavior issues of any animals at your session. The undersigned accepts total liability for any injury caused to any person or any damage to any equipment/property by any animal brought to the session. The undersigned is responsible to notify Mark Stevens immediately at any point they believe their animal is not comfortable. An animal exhibiting aggression will be cause for Mark Stevens Photography to immediately terminate the session. All animals must be prepared in accordance with Mark Stevens Photography’s animal preparation guidelines. Failure to prepare your animal adequately may result in the cancellation of your session and forfeiture of your reservation fees.
Other Provisions
The undersigned agrees to be responsible for all loss, damage or destruction to Mark Stevens Photography’s equipment or property, whether or not covered by insurance, that is directly caused by or results from the negligence acts of any subject, family member, guest or other invitee of the above referenced session.
Mark Stevens Photography’s liability for its provision of products and services hereunder shall be limited to the amounts paid to Mark Stevens Photography pursuant to this Agreement.
This Agreement incorporates the entire understanding of the parties and is governed by Colorado law. Any modification to this Agreement must be in writing and signed by both parties.
