KREWE OF ST. PATRICK
FLORIDA WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION, AND MEMBERSHIP ACKNOWLEDGMENT AGREEMENT
In consideration of being permitted to apply for membership in and/or participate in any event, activity, parade, meeting, social gathering, ball, fundraiser, or function sponsored, organized, hosted, or affiliated with the Krewe of St. Patrick (collectively, “Krewe Events”), including but not limited to Mardi Gras parades, Mardi Gras balls, social gatherings, meetings, fundraisers, and related activities, whether participating on a float, walking, volunteering, serving as a safety walker, attending in any capacity, or applying for membership, I, the undersigned, knowingly, voluntarily, and intending to be legally bound, hereby agree to the following:
1. ASSUMPTION OF RISK
I acknowledge that participation in Krewe Events involves inherent and foreseeable risks, including but not limited to physical injury, illness, death, property damage, accidents involving vehicles or floats, falls, uneven walking surfaces, crowd-related incidents, weather-related hazards, alcohol-related risks, and other known or unknown dangers.
I knowingly and voluntarily assume all such risks associated with my application for membership and/or participation in Krewe Events.
2. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Florida law, I hereby knowingly and voluntarily waive, release, and forever discharge the Krewe of St. Patrick, its officers, directors, board members, committee members, volunteers, agents, representatives, sponsors, venues, and affiliated entities (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, or liabilities of any kind arising from or related to any injury, loss, or damage sustained by me, including those caused in whole or in part by the NEGLIGENCE of the Released Parties, arising out of or related to my application for membership in and/or participation in Krewe Events, including travel to and from such events.
This release does not apply to acts of gross negligence or intentional misconduct.
3. INDEMNIFICATION AND HOLD HARMLESS
I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorney’s fees, arising from my actions, conduct, application for membership, or participation in Krewe Events.
4. PHYSICAL FITNESS AND ABILITY TO PARTICIPATE
I certify that I am physically fit, in good health, and capable of safely participating in Krewe Events, including walking the full parade route if required. I acknowledge that the Krewe cannot provide special accommodations for injuries, medical conditions, disabilities, or physical limitations.
5. COMPLIANCE WITH LAWS AND EVENT RULES
I agree to comply with all applicable federal, state, and local laws, as well as all rules, safety requirements, codes of conduct, and instructions issued by the Krewe during Krewe Events. I acknowledge that traffic control and law enforcement support may be discontinued at designated points during or after the parade routes.
6. ALCOHOL CONSUMPTION AND TRANSPORTATION SAFETY
I acknowledge that alcoholic beverages may be present or available at certain Krewe Events, including social gatherings, Mardi Gras balls, and parade-related activities. I understand that alcohol consumption can impair judgment, coordination, and reaction time and increase the risk of injury to myself and others.
Any consumption of alcohol is voluntary, and I acknowledge that I am solely responsible for my actions and behavior while consuming or under the influence of alcohol. The Krewe of St. Patrick does not encourage excessive alcohol consumption and shall not be responsible for any injury, damage, loss, or incident arising from my alcohol use.
I further acknowledge the importance of safe transportation and agree not to operate a motor vehicle while under the influence of alcohol or drugs. I understand that alternative transportation options, including rideshare services such as Uber or Lyft, designated drivers, or other safe transportation methods, are strongly encouraged when needed.
7. RESPONSIBILITY FOR MINORS
If I am the parent or legal guardian of a minor participating in Krewe Events, I acknowledge and accept responsibility for the supervision, conduct, and safety of the minor. I acknowledge the inherent risks associated with participation and agree that the minor participates voluntarily, under my direction.
To the fullest extent permitted by Florida law, I agree to indemnify and hold harmless the Released Parties from claims arising out of the minor’s participation.
8. PERSONAL PROPERTY
I acknowledge that the Krewe of St. Patrick is not responsible for lost, stolen, or damaged personal property.
9. MEDIA RELEASE
I grant permission to the Krewe of St. Patrick to use my name, image, likeness, photographs, and video recordings taken during Krewe Events for promotional, informational, or broadcast purposes without compensation.
10. MEMBERSHIP APPLICATION ACKNOWLEDGMENT
By applying for membership in the Krewe of St. Patrick, I affirm and acknowledge that:
- I am submitting this application for membership voluntarily.
- I understand that submission of an application does not guarantee acceptance and that membership is subject to approval by the Board of Directors in accordance with the Bylaws.
- If accepted, I agree to comply with and be bound by the Bylaws, rules, regulations, codes of conduct, and policies of the Krewe of St. Patrick, as adopted or amended by the Board of Directors.
- I acknowledge that I have received, read, and understand this Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement, and that it applies to all Krewe Events, including social gatherings, Mardi Gras balls, and parade participation, whether riding on a float, walking, volunteering, or attending in any capacity.
11. GOVERNING LAW AND VENUE
This agreement shall be governed by and interpreted in accordance with the laws of the State of Florida. Any legal action arising from this agreement shall be brought in a court of competent jurisdiction within the State of Florida.
IMPORTANT NOTICE
I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR DAMAGES CAUSED BY NEGLIGENCE.
