• Lunch Meal Time Exemption Request Form

  • A contracting entity (CE) may request reasonable variances in lunch meal service times in the following circumstances on a case-by-case basis:

    1. Accommodation of special circumstances for traditional students during traditional lunch meal times which includes limitations caused by the capacity of the facility and the length of the school day

    For Example:

    • The CE cannot provide a complete lunch meal service to all program participants because its facilities do not have the capacity to accommodate the number of meals served.
    • The CE has extended school hours.

     2. Accommodation of special circumstances for traditional students with non-traditional lunch meal times which includes situations where students are not on campus during the regular school day

    For Example:

    • Credit recovery or graduation programs that operate on a non-traditional school day schedule
    • Work study programs that allow students to work during the regular school day and attend classes in the late afternoon or evening
  • If approved, the lunch meal time exemption is in effect until there is a change in one of the conditions required for this approval.

    CEs may submit a request for multiple sites on the same form as long as all sites have the same circumstances and the same lunch meal times. 

    Questions about a lunch meal time exemptions may be submitted to TDA by email to SNPWaivers@TexasAgriculture.gov. Lunch Meal Time Exemption should be recorded in the subject line of the email.

  • To submit a request to TDA, please take the following actions:

    • Complete the Lunch Meal Time Exemption Request Form located in The Texas Unified Nutrition Programs System (TX-UNPS) Download Forms | NSLP Exemptions and Waivers
    • Retain a copy of the submitted form for the CE’s records.
    • Click Submit when the form is completed.

     

  • Part I. Contracting Entity (CE) Information

    Provide the following information about the CE
  • Provide the site(s), site identification number (ID), and the number of students enrolled at the site for which the exemption will be used. Multiple sites may be listed as long as ALL sites have the same circumstances and the same lunch meal times. 

  • Part II. Lunch Meal Time Conditions

  • Instructions: Check the box for each circumstance that applies and provide the answers for each circumstance checked. 

  • Circumstance 1- Capacity Issues

    Provide the following information for each site for Circumstance 1 - Capacity Issues:

    • Site Name (as listed on TX-UNPS application)
    • Site ID (4 digits from TX-UNPS application)
    • a. How many lunch meal service periods will be used? (number)
    • b. How long is each lunch serving period? (minutes)
    • c. What is the maximum number of students that can be served during a lunch serving period? (number)
    • d. What is the average number of lunches served daily? (number)
    • e. Enter the time that the site will begin serving the first lunch meal service period. (Enter the HOUR only - hh)
      • Enter the time that the site will begin serving the first lunch meal service period. (Enter the MINUTES only --- for example, if you begin service at 11:30, enter 30)
    • f.  Enter the time when the site will stop serving meals for the last meal service period. (Enter the HOUR only.)
    • g. Enter the time when the site will stop serving meals for the last meal service period. (Enter the MINUTES only.)


    Note: Students may finish a meal that has been served before lunch meal service was stopped. 

  • Circumstance 2- Extended Day

    Provide the following information for each site for Circumstance 2 -- Extended Day.

    • Site Name (as listed on TX-UNPS application)
    • Site ID (4 digits from TX-UNPS application)
    • a. How many lunch meal service periods will be used? (number)
    • b. How long is each lunch serving period? (number of minutes)
    • c. What is the maximum number of students that can be served during each lunch serving period? (number)
    • d. What is the average number of lunches served every day? (number)
    • e. Enter the time that the site will begin serving the first lunch meal service period. (Enter the HOUR only -- hh)
      • Enter the time that the site will begin serving the first lunch meal service period. (Enter the MINUTES only -- mm. For example, if you start serving at 11:30, enter 30.)
    • f. Enter the time when the site will stop serving meals for the last meal service period. (Enter the HOUR only)
      • Enter the time when the site will stop serving meals for the last service period. (Enter the MINUTES only.)
    • g. When does the official school day begin? (Enter the HOUR only)
      • When does the official school day begin? (Enter the MINUTES only)
    • h. When does the official school day end? (Enter the HOUR only)
      • When does the official school day end? (Enter the MINUTES only)
    • i. How many instructional days does the school have each year? (number)

     Note: Students may finish a meal that has been served before lunch meal service was stopped. 

  • Circumstance 3- Non-Traditional Program

    Provide the following information for Circumstance 3 -- Non-Traditional Program

    • Site Name (as listed on the TX-UNPS application)
    • Site ID (4 digits from TX-UNPS application)
    • a. How many lunch service periods will be used? (number)
    • b. How long is each lunch serving period?(number of minutes)
    • c. What is the maximum number of students that can be served during a lunch serving period? (number)
    • d. What is average number of lunches served daily to students in the non-traditional program? (number)
    • e. Enter the time that the site will begin serving the first lunch meal service period. (Enter the HOUR only -- hh.)
      • Enter the time that the site will begin serving the first lunch meal service period. (Enter the MINUTES only -- mm. For example, if you start serving at 11:30, enter 30 -- mm.) 
    • f. Enter the time when the site will stop serving meals for the last meal service period. (Enter the HOUR only -hh.)
      • Enter the time when the site will stop serving meals for the last service period. (Enter the MINUTES only - mm.)
    • g. When does the official school day for non-traditional students begin? (Enter the HOUR only -hh.)
      • When does the official school day for non-traditional students begin? (Enter the MINUTES only mm.)
    • h. When does the official school day for non-traditional students end? (Enter the HOUR only -hh.)
      • When does the official school day end? (Enter the MINUTES only mm.)
    • Provide a description of the non-traditonal program in the text box.

    Note: Students may finish a meal that has been served before the lunch meal service has stopped.
