  • SBP Senior Team & Client Portrait Agreement

    I am so excited to have you as part of this year's Senior Team! Please be sure that you and your parent read all sections below. This contract is valid through June 30th, 2027 or your graduation date, whichever comes first. By signing this contract, you and your parent/legal guardian agree to the following:

  • Senior Team Agreement

    1) I agree to only represent Sean Brown Productions for the 2025-2026 and 2026-2027 school year exclusively and to be an active part of the SBP Senior Team to the best of my ability.

    a. I agree that I will not promote other photographers, including myself, that advertise photography services in any capacity, amateur or professional. Only photographers at school-sanctioned events are acceptable to work with (i.e. prom photographer contracted by the school, team sports photographer hired by school, etc. This does not include other photographers that offer Prom group shoots or the likeness that are not affiliated with the school). This includes modeling for friends that advertise their paid or free photography services, take photography clients, senior photos or are working to build a portfolio and is a violation of your contract.

    b. Failure to comply with Sections 1a is automatic grounds for removal from the SBP Senior Team at the Photographer's discretion.

    2) I understand that all of the benefits and perks of being an SBP Senior Team member for Sean Brown Productions LLC are contingent up on my completion of the required tasks as outlined in the SBP Senior Team magazine. I acknowledge that I have received a digital copy of this and have read through it in its entirety.

    3) As an SBP Senior Team member, I understand how “Group Photo Shoots” operate.

    a. The dates for group photo shoots will be scheduled to make sure the maximum number of Senior Team members can attend. An online poll will be sent out with potential shoot days at least 1 month in advance. The date with the most number of people that say they can attend will be selected as the shoot date.


    b. Since group photo shoots are complimentary for Senior Team members, missing a shoot is not compensated for in any way (i.e. print credit, make-up session, etc.) except at Photographer’s discretion.


    4) I will receive a custom smartphone “app” displaying my group photo shoot images to share with family and friends. I agree that when sharing images to social media, Sean Brown Productions will be tagged. 


    5) I understand that I will receive priority scheduling for my individual senior session prior to future clients. Date availability will depend on the Sean Brown Productions LLC calendar and schedule. I understand that my individual senior session must be scheduled between June 2026 and August 15, 2026 by January 5th, 2026.

    6) Sean Brown Productions LLC reserves the right to release SBP Senior Team members for behavior deemed unbecoming of a studio representative (including but not limited to bullying [online or in-person], use of alcohol or drugs, negative or hostility towards fellow SBP Senior Team members (directly or indirectly, i.e. gossip or any digital communication that is maliciously directed at another Senior Team member or Photographer), and display of inappropriate content on social media).

    7) If I cannot fulfill my obligation as a SBP Senior Team member for any reason, I agree to pay a termination fee of $750 due within two weeks of notice in the form of liquidated damages to Sean Brown Productions LLC. This will relieve any future obligation of the rest of this contract and will be considered void and null. I understand that if Photographer releases Senior Team member from the team for breaking the terms in this contract, this fee also applies.

    a. If Senior Team member is released from the team, neither the Senior Team member nor Sean Brown Productions LLC shall have any obligation beyond services/rewards performed/earned to date.

    8) I understand that as a SBP Senior Team member, I must book my senior session with Sean Brown Productions. There is a Senior Team retainer (non-refundable, non-transferable) which includes all group photo shoots, an individual senior session, and Image Premiere and Ordering Session to view my final gallery from my individual senior session. The Senior Team retainer is due at the time of signing this contract if you choose to participate in the SBP Senior Team and is not refundable. Prints, digital images and products from the individual senior session are not included in the Senior Team retainer. I understand that there is a $750 minimum purchase at the time of my Image Premiere and Ordering session after my individual senior session has been completed. I have read and acknowledge Sean Brown Productions collections pricing as indicated in the SBP Senior Team magazine.

    9) Severability: If any part of this agreement is declared invalid or unenforceable, the remainder will continue to be valid and enforceable.

     

    By signing below, I acknowledge that I have read this complete agreement and understand my responsibilities and obligations by taking part in the exclusive Sean Brown Productions LLC Class of 2026 Senior Team.

  • Standard Client Portrait Agreement

    It is understood that the terms stated in this agreement between Sean Brown Productions LLC, hereafter Photographer, and the undersigned, hereafter Client, will be fulfilled by both parties.

    TERMS AND CONDITIONS
    • Upon signature, Photographer shall reserve the time and date agreed upon. All session fees and retainers are nonrefundable, even if the portrait is rescheduled or canceled for any reason other than inclement weather.

    • If, in the opinion of Photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the photographer, Photographer may elect to use an alternate location or to reschedule the portrait. If above conditions are met, session retainer will be applied to new session date with no additional costs to Client.

    • I acknowledge that a parent/guardian will be present during the session.

    • All sessions take place in the Vancouver, WA or Portland, OR area. Any locations that are more than 20 miles from the 98660 zip code are subject to a travel fee based on the location. Locations outside of the 20 mile radius must be 90 days prior to the session and a travel fee based on location will apply. Photographer reserves the right to decline location suggestions to ensure the final product is representative of their work presented in their portfolio.

    • In the event of client illness, Client agrees to notify Photographer immediately to reschedule portrait session. One (1) rescheduling due to client illness will be allowed before additional session fee of $150 is needed to reserve another session date. 

    • Sessions are considered booked when session retainer is paid and Client signs this agreement. Until Client has paid the session retainer and this agreement, the session date is considered available even if a verbal commitment has been made.

    • Session retainers are for the time and talent of the Photographer and professional hair & makeup only. Session retainers do not include prints, digital images or photo products as offered by Photographer. In addition to the session retainer, there is a $750 minimum order requirement for every session.

    • By signing below, Client and Parent/Guardian acknowledges that they have received, read and agree with the pricing as presented in the SBP Senior Magazine provided in a digital copy prior to booking.

    • Client must indicate at the bottom of this agreement what session option they are selecting at the time of signing this agreement. Photographer session retainer is due at time of signing agreement and includes complimentary hair and makeup. The professional hair and makeup is determined by Sean Brown Productions and substitute hair and makeup artists are not allowed.:

     

    + Senior Team Investment Fee: 2.5 Hours of Photographer’s time and talent for your individual senior session, Client’s hair and makeup done professionally at salon chosen by Photographer for individual senior session, and all of the Senior Team benefits as aforementioned. (Session retainer due: $500).

    • Cash, checks and credit cards are accepted. A $125 fee is assessed on NSF checks.

     • Clients are presented a minimum of 40 images at their Image Premiere.

    • Image Premiere and Ordering Session will take place in person within 30 days of the session and photos will not be placed in an online gallery for ordering - only purchased digital files are released digitally.

    • Image Premiere and Ordering Session will take place at the Photographer's studio located in Vancouver, WA.

    • If no order is placed at the Image Premiere and Ordering Session or if 30 days elapses after the session date and no Ordering Session has taken place unless arranged under certain circumstances subject to photographer’s approval, the minimum order amount of $750 is due the day of the initial Image Premiere and Ordering Session or after 30 days has elapsed from the date of the session. If no order is placed at the first Image Premiere and Ordering Session, a $250 Archival Fee to schedule another Image Premiere and Ordering Session is due at the initial Image Premiere and Ordering Session; 50% of the Archival Fee will be applied in the form of product credit. The minimum order amount of $750 will be applied to the final order total in the form of product credit.

    • All sales are final. Washington sales tax is applicable to all fees and payments.

    • Orders will be ready for delivery 4-6 weeks after session premiere. Specialty items may take longer.

    • Finished galleries are archived for a minimum of 1 year. Files may be available longer, but this is up to the discretion of the photographer.

    • If the Photographer cannot perform this Agreement due to casualty, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of all monies paid.

    • The charges in this Agreement are based on the Photographer’s price list. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when this agreement is signed. By signing, I acknowledge that I have read the pricing in the SBP Senior Magazine and agree to them.

    • Client may reproduce all digital files purchased for personal use only. This does not include commercial use or use by other entities other than the Photographer (i.e. modeling agencies). All digital files presented by Photographer may not be altered in any way including cropping (i.e. removal of watermark if present), digital editing (i.e. Instagram filters, black and white conversions, etc.), or other manipulation without the consent of Photographer. 

    • All images are copyrighted. All images are the sole property of Sean Brown Productions LLC and are protected by Federal Copyright laws. Sean Brown Productions LLC retains the right to all images for promotional and competitive use. Copying images without permission is punishable by up to $150,000 fine if pursued as a legal matter. 

    • If Client cancels the session, Client will be deemed to forfeit the full amount of any deposits and pre-payments of Compensation it made.

    • Severability: If any part of this agreement is declared unenforceable or invalid, the remainder will continue to be valid and enforceable.

    Photography Consent Form/Release (for minor)

    I, (parent's name), parent or official guardian of (child’s name), do hereby consent and agree that Sean Brown, Sean Brown Productions, its employees, or agents have the right to take photographs of my child and to use these in any and all media, now or hereafter known, and exclusively for the purpose of online and print portfolios. These materials might include printed or electronic publications, web sites, or other electronic communications. In addition, you acknowledge that these images may be used for social media, photo contests, print and electronic publications including those produced other companies, individuals or entities. I further consent that my child’s name and identity may be revealed therein or by descriptive text or commentary.

    I do hereby release to Sean Brown Productions LLC, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. I waive any rights, claims, or interest I may have to control the use of my child’s identity or likeness in whatever media used.

    I authorize the use of these images without compensation to my child or myself. All prints and digital reproductions shall be the property of Sean Brown Productions LLC and its representatives.

    I also understand that Sean Brown Productions LLC is not responsible for any expense or liability incurred as a result of mine or my child’s participation in this photography, including medical expenses due to any sickness or injury incurred as a result.

    By signing below, I agree that I have read and understand the foregoing statement, and am competent to execute this agreement and take full responsibility in signing for my child and  I acknowledge that I have read and understand the Terms and Conditions stated in this agreement and agree to the Terms and Conditions.
