DEPOSIT AND PAYMENT: A non-refundable deposit in the amount of $150 is due at the time of booking. This guarantees that your date is secured. Your session date is not completely secure until deposit fee is received. The remainder is due on the day of the photographing event. Additional Images and products are sold separately unless otherwise specified.
CANCELLATION/POSTPONEMENT: Client understands that by entering into this agreement, Photographer is foregoing other photography jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the deposits paid are non-refundable. Deposits are transferable if a date change is necessary. Forty-eight hours (48) notice of postponements or cancellations is appreciated. If it is not possible for a session to take place on a scheduled day due to weather or Photographer, we will reschedule on a agreed date at the earliest date possible, with no additional charge.
COOPERATION/NO SHOWS: Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions( that includes children and newborns) or for missed images due to details not revealed to Photographer. It is the parents responsibilities to control their children at ALL times, I ask they NOT run around, because for their own safety reasons,if the parent does not make sure that their own children are behaving, I will end the session without any refund whatsoever. Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes, especially to small children, which hinders Photographer’s ability to obtain quality shots. If Client and/or key individuals fail to appear to a scheduled portrait session, the deposit is non-refundable.The photographer cannot guarantee any poses or facial expressions, and is not responsible for the cooperation level of the participants. I will try my best to get your child to smile but there are no guarantees that he/ or she will. They are not in a familiar enviroment and will behave differently.
Capture, Delivery, Post Production & Editing: The Photographer is not liable to deliver every image taken at the session. The photographer will never deliver RAW images. The photographer will deliver the images within3-4 weeks after the session. The final post-production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer based on her style and the available lighting.
Digital Files: Upon receipt of the digital photos, the client accepts all responsibility for archiving and protecting the photographs.
Photographer does not permanently archive image files. Any images printed by the client over the provided size may lose image quality. Digital images provided in private online gallery will be in JPG format. If you would like additional images in higher resolution for large prints, those digital files can be purchased for $40 each.
DIGITAL NEGATIVES, PRINTS & COPYRIGHT: All images and copyrights are the property of Nicole Calore Photography. In exchange for services provided, Photographer retains the exclusive right to copy, edit and distribute any/all images created under this agreement, to the general public, for any reason, including but not limited to: advertising, marketing, sales, print competitions, educational seminars, and monetary gain. The mediums for display could include newspapers, magazines, books, television, and the internet, but are not limited to only those mediums. The Photographer retains these rights even if image files are turned over to the Client.
RETOUCHING, CONVERSIONS AND DIGITAL FILES: Standard retouching will completed to the images in your viewing gallery before they are uploaded this includes light blemish removal . Complex retouching includes such changes as the removal of scars or heavy blemishes. Tonal conversions include converting color images to black-and-white or sepia tone (for an antique look) and black-and-white images to sepia tone. Photographer has the right to refuse any requested edits to the images.
INDEPENDENT CONTRACTOR: This Contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor.
ENTIRE AGREEMENT: This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived.
I, the client have read all of the above and understand that there is a $100 deposit fee that reserves the time and date of the session. This guarantees that your date is secured and will apply toward your session. Your session date is not completely secure until session deposit fee is received. The remainder of the session fee is due at the time of your session/ event.
