    Dear Entertainer,

    Nothing says late summer like Pittsburg’s own Seafood & Music Festival, the two-day, outdoor extravaganza that draws thousands of visitors to Pittsburg every year. We cordially invite you to apply 2023 Entertainment lineup at the 35th Annual Pittsburg Seafood & Music Festival. 

    This year's festival will be held Saturday, September 9, 2023 from 10:00 a.m. to 7:00 p.m. and Sunday, September 10th from 10:00 a.m. to 7:00 p.m. on Railroad between 8th st and 3rd st 

    We are pleased to accept your entertainment application for the 35th Annual Pittsburg Seafood & Music Festival! Last year we had a great lineup of entertainment. We will continue to maintain the quality and professionalism of past festivals, providing festival patrons with top-notch entertainment.

    Please read through this entire application carefully as there may be some changes. The application is a vital part of the screening process of the over 200 requests received each year to perform at the Pittsburg Seafood & Music Festival. Variety, quality and price have always been our criteria for selecting performers. We stress the importance of submitting a complete package, including a completed application with as many of the items requested as possible. Please include a sample of your act; we need to be able to evaluate the quality to consider any group for hire. If you are a new group for the Festival, it is very important to include a list of current engagements as the Entertainment Committee may come and audition new groups. All applications are considered on a year to year basis. There are no guarantees of repeat performances.

    The Pittsburg Chamber and it's Annual Seafood & Music Festival is a non-profit organization. Its mission is to support the community projects, charitable groups and service organizations of Pittsburg. In 2018 over 2,180 volunteers from 40 local non-profit groups worked 20,000 volunteer hours to host the 35th Annual Pittsburg Seafood & Music Festival. From 1984 through 2018 the success of the annual festival has enabled the Chamber to award over $790,000 these groups. Please keep this in mind when quoting your fee, as we must consider prices when selecting entertainment.

    The completed application package must be submitted no later than 5:00 pm PST, June 15, 2023. This will allow ample time for selection and scheduling. Again, make sure the application is complete so as not to delay the process. You will be notified via e-mail or phone call of our decision and your tentative scheduled date and time by July 18, 2023.

    The Pittsburg Seafood & Music Festival gives equal opportunity to all performers who wish to enter the Festival. As part of the Pittsburg Chamber of Commerce’s hope to expand and diversify the festival each year, we cannot promise that returning performers will receive a spot. The festival’s entertainment committee will consider each group fairly. 

    Entertainment for the Pittsburg Seafood & Music Festival is for bands only. We ask that you sign a waiver of all liability while at the Festival. If you choose to forgo the waiver, we will require a certificate of insurance. Please submit your completed application, release & waiver and or certificate of insurance naming the Chamber of Commerce & City of Pittsburg as additionally insured along with a letter of endorsement and a completed W-9 Form by the due date of June 15th. Insurance from the Chamber’s broker will be available for $130.00. (If you choose not to sign the waiver of liability and you don’t already carry your own insurance). 

    In the event of an emergency that keeps you from attending the festival, you must let us know by August 1, 2023 in order to be considered next year’s Seafood & Music Festival.

    The deadline for application is June 15, 2023.  If you have not heard from us, we ask that you contact the Pittsburg Chamber of Commerce for further information (925)-432-7301. Performance slots are limited, entertainment slots will be assigned on a first come, first serve basis. No seniority privileges will be applicable.

    If you wish to sell CD’s to festival patrons, you must be approved by the Pittsburg Seafood Festival Committee. In order to qualify, you must be approved by the Seafood & Music Festival Committee and you must agree to follow all rules and guidelines. No other items like, but not limited to t-shirts, food or beverages, including water, are allowed to be given or sold. If you are found to be selling any of these items, you will be asked to leave the festival and will not be asked to participate again next year. All entertainers must supply their own instruments, as no entertainment backline is provided. 

    We anticipate another enjoyable, exciting and successful event, and encourage you to apply as part of our entertainment line-up at the Annual Seafood & Music Festival.   • 2023 Entertainment - Policies & Procedures

    The Pittsburg Seafood & Music Festival Entertainment Committee desires to maintain the quality and professionalism of past festivals by providing our guests with top-notch entertainment. While music/lyrics with swearing and a message which encourages or condones violence, sexual harassment, sexual innuendos, use of drugs, degradation of persons due to race, gender etc may have its place in the media industry – it does not comply with the vision of this event. Please take this into consideration as to whether this venue is one that will meet your needs as well as those of this event.

    To achieve this goal, we ask Entertainers to:

    1. Be on time or early and provide quality entertainment which commensurates with the sample provided to the 2019 Pittsburg Seafood & Music Festival Entertainment Committee with this application. Parking and transportation from lot to the stage can be challenging and need extra time to navigate crowds and transportation from entertainers arriving and leaving - so allow extra time. 
    2. Notify the Pittsburg Seafood & Music Festival Entertainment Committee if the size of the group changes or names of group members change. Gate Passes will be issued based on the number of performers listed on the application questionnaire. Gate Passes will NOT be issued to managers, agents, family members, roadies, etc. Gate Passes are for the entertainers. The Pittsburg Seafood & Music Festival is not responsible for lost, stolen, or forgotten gate passes. If passes are lost, stolen, or forgotten, new gate passes must be purchased at the entertainer’s expense.
    3. Agree to comply with all applicable provisions of the policies and regulations of the Pittsburg Seafood & Music Festival and its Board of Directors.
    4. Agree that the Pittsburg Seafood & Music Festival Committee shall have overall control of content and sound levels of the performance.
    5. Upon approval, groups may sell their DVDs and/or CDs during their performance time only and understand that sales are limited to DVDs and/or CDs. Sales of T-Shirts and/or other merchandise are only permitted if you have been pre-approved. Entertainers without pre-approval will not be permitted to sell merchandise on the day of the event.
    6. Please have all your equipment labeled in an obvious way. Entertainers are responsible for their equipment and ensuring that it is transported with them and taken out of the transport vehicle(s). Any lost items, if found, will be held in the blue headquarters building.  

    Compensation

    1. Entertainers paid $500 or more must receive Form 1099 from the Pittsburg Seafood & Music Festival (NOTE: The annual Pittsburg Seafood & Music Festival is part of a non-profit organization and typically will not be able to compensate more than $600 per set). Payment will not be made unless a signed W-9 is on file. A W-9 will accompany the contract if we do not have one on file. Additionally, failure to provide correct information will result in not performing at future Pittsburg Seafood & Music Festival events.
    2. The performer shall be an independent contractor and not an employee of the Pittsburg Seafood & Music Festival under this agreement.
    3. Pittsburg Seafood & Music Festival will release a check for the amount of compensation shown in the contract within (10) days after the last day of the Pittsburg Seafood & Music Festival if performance criteria are met and a signed W-9 is provided. All checks will be mailed from the Pittsburg Chamber of Commerce office unless other arrangements are made in writing to pick up your check at headquarters.

    NOTE: The 2023 Pittsburg Seafood & Music Festival Entertainment Committee will assign your entertainment slot based on how it fits in the festival entertainment schedule. NO SENIORITY PRIVILEGES WILL BE APPLICABLE. The Pittsburg Chamber of Commerce reserves the right to contract with an outside entertainment company, which may be scheduling and communicating with entertainers.

    The Pittsburg Seafood & Music Festival's host (Pittsburg Chamber of Commerce) is a non-profit organization and thus, the entertainment committee has a tight budget to meet. Keeping in mind this is a non-profit event, Please quote your fee range for up to a 90 minute show as we want to be respectful of your's and the committee's time and effort. (Please note that entertainers compensation may be negotiated by the Chamber). 

    NOTE: We book our groups for either ONE or TWO sets depending on schedule over the course of the weekend.

    In keeping with our commitment to environmental responsibility, the Pittsburg Seafood & Music Festival is striving to minimize waste. Please submit samples of your entertainment electronically via web links and or digital uploads in the area provided. 

    LINKS TO SAMPLES OF ENTERTAINMENT OR SAMPLE UPLOADS ARE REQUIRED FOR CONSIDERATION. If relying exclusively on upload materials, the total file size limit for uploads is 100 MB. 

    PLEASE PROVIDE AMPLE LINKS, FILES, IMAGES, AND DOCUMENTS FOR THE COMMITTEE TO EVALUATE. ANY COMBINATION OF LINKS, TEXT INPUT, AND FILE UPLOAD are ACCEPTABLE. Submissions providing insufficient sample material will not be considered.

  • Hold Harmless Agreement

    Entertainer shall be solely responsible for any and all injuries to persons or damages to property or any other injury, claim, damage or loss of whatever nature, arising from or related to the performance/installation. Entertainer shall indemnify, save and hold harmless the Pittsburg Chamber of Commerce, and its employees, agents and volunteers from and against all liability, loss, damages, claims, costs, and expenses (including reasonable attorney's fees) arising out of injury (including death) or damage to property or any other injury, claim, damage, loss, cost or expense arising from the performance/installation performed by Entertainer including, but not limited to, any negligence, act or omission of the Entertainer, his respective employees, guests, agents, or subcontractors.

    Memorandum of Understanding


    I understand that the Pittsburg Chamber of Commerce, its Board of Directors, staff and the City of Pittsburg will not be responsible for any lost, stolen, or damaged materials, equipment and/or merchandise. I have read and fully understand and agree to comply with the policies and procedures included in this application. My submission of this application constitutes a digital signature. 


    I understand that violation of the rules and procedures will result in my removal from the Festival without compensation.

    If your application is accepted, you will receive additional information regarding performance times, fee payment, location, parking, etc.

  • 2023 Pittsburg Seafood & Music Festival Release Waiver of Liability and Indemnity Agreement

  • This Agreement is made:

  •  - -Pick a Date
  • in the City of Pittsburg, County of Contra Costa, by and between:

  • hereinafter referred to as “Participant” and the Pittsburg Chamber of Commerce, its officers, directors, employees, agents, and representatives, all hereinafter referred to as “the Chamber.” IN CONSIDERATION FOR THE PARTICIPATION in the PITTSBURG SEAFOOD & MUSIC FESTIVAL, the parties hereby agree as follows:

    1.Participant hereby releases, waives, and forever discharges both the Chamber and the City of Pittsburg from any and all claims, demands, causes of action, damages, losses, costs, attorney’s fees and expenses of any kind or nature whatsoever known or unknown which Participant have or may have against either the Chamber and/or the City of Pittsburg resulting in any way from Participant’s involvement in or merely attendance at the Pittsburg Seafood Festival.

    2.Participant hereby agrees to indemnify, hold harmless, and defend both the Chamber and the City of Pittsburg from and against all past, present and future claims, demands, causes of action, obligations, losses, liens, costs, expenses, attorney’s fees, liabilities, injuries and damages of any kind or nature whatsoever brought by any person or entity arising out of or connected in any way with Participant’s involvement in or attendance at the Pittsburg Seafood & Music Festival, whether caused solely or partially by a Participant or any other person or entity.

    3.This Agreement may be pleaded as a fully and complete defense to any action or proceeding, as the basis for abatement of, or injunction against, such action or other proceedings, and as the basis of a cross-complaint for damages. Participant’s specifically waives his or her rights under California Civil Code 1542, which provides as follows:

    “A general release does not extend to the claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

    4.This Agreement shall be interpreted in accordance with and governed in all respects by the laws of the state of California with venue agreed to be in Contra Costa County, California. Moreover this Agreement shall be binding upon and inure to the benefit of the heirs, executors, administrators, trustors, trustees, beneficiaries, predecessors, successors, assigns, partners, principals, agents, and all persons or entities connected in any way with Participant without limitation. If any provision or any part of the Agreement shall, for any reason, be held to be invalid, unenforceable or contrary to the public policy or any law, then the remainder of this Agreement shall not be affected thereby.

    5.Each party has read and understands this RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT and has voluntarily signed the same.

    Hold Harmless Agreement

    Booth Vendor shall be solely responsible for any and all injuries to persons or damages to property or any other injury, claim, damage or loss of whatever nature, arising from or related to the Festival. Booth Vendor shall indemnify, save and hold harmless the Pittsburg Chamber of Commerce and the City of Pittsburg, its employees, agents and volunteers from and against all liability, loss, damages, claims, costs, and expenses (including reasonable attorney's fees) arising out of injury to person (including death) or damage to property or any other injury, claim, damage, loss, cost or expense arising from the Festival performed by vendor including, but not limited to, any negligence, act or omission of vendor.

    Memorandum of Understanding Agreement

    I understand that the Pittsburg Chamber of Commerce, its Board of Directors, staff and the City of Pittsburg will not be responsible for any lost, stolen, or damaged materials and/or merchandise. I have read and fully understand and agree to comply with the policies and procedures included in this application. My submission of this application constitutes a digital signature. I understand that violation of the rules and procedures will result in my removal from the Festival without refund.
