Terms and conditions of the contract:
We reserve the right to refuse puppy sales to anyone at any time for any reason!
Note: Nosam Kennels, has the option of first pick(s) of the litter at any time of male or female.
Those earning AKC, NAVHDA or are hunting will recieve prioity on our waiting lists.
Those getting pets understand that pet puppies are pups priced with slight imperfections and we do not guarantee against comsmetics or slight defects that may not affect the well-being of the dog such as a overshot/undershot bites, hernias or etc.
Vaccinations, Medical Records & etc:
It is understood that your puppy has had at minimum, 1st parvo vaccination, dewormer, dewclaws removed, and tails docked.
You will be provided a Medical Information Sheet to bring with you to your vet. It is understood that you will purchase SAFEGUARD dewormer in advance so that you may continue the deworming process once you bring your puppy home to ensure a healthy transition. It is understood that you must deworm your puppy within one week of their arrival home with SAFEGUARD for 3-consecutive days!
The breeder may terminate the contract at any point they feel a family is not fit for a puppy. Buyers are expected to have a considerable amount of knowledge about the breed before purchase.
You agree to provide a safe and loving home for your puppy, provide fresh water and quality food appropriate veterinary care including, but not limited to, vaccines and heartworm preventative, a home with a yard, shelter and adequate room for daily exercise, companionship, and an active lifestyle.
If at any time you feel your pup no longer fits in with your family and lifestyle, please return the puppy back to the breeder where we will provide proper placement. Under no circumstances should a puppy be sold, transferred, or surrendered to an animal control facility, shelter, rescue or a cash refund given for the return. Failure to return the puppy to the seller will result in prosecution a $5,000 fine + any fee's or money spent to get the dog back or placed in an appropriate home.
Puppies will not be sold to dog brokers, pet shops, or any affiliated animal group or business looking to buy a puppy for resale!
We cannot guarantee color, size, positions on the list or genetic health expect under the terms & conditions outlined in this contract.
The Dog described in this contract is not guaranteed to be fit for breeding.
It is understood that no cash refunds will be given for returned puppies
Puppies will only be held past the date of eight (8) weeks of age by prior arrangement. Seller may sell any puppy held past the date of nine (9) weeks of age (unless prior arrangement has been made) with Buyer forfeiting deposit and all claims to the puppy. If the puppy has been paid in full, the seller will return the purchase price, minus the deposit. Any expenses incurred by Seller shall be deducted from any returned monies owed to Buyer.
Visits: Due to scheduling, safety of our home, health of our dogs and puppies;It is understood that visits without an appointment are not allowed and are not scheduled until the puppies have received their first round of vaccines or are ready to go home by families who have made a deposit on a specific pup or litter. Usually around 8-weeks of age!
Deposits, Positions & fees
It is understood that your down payment and this completed contract ensure the privilege to purchase a puppy and your remaining balance will be paid in full (during the availability week of the list you join and must include any additional kenneling or training fees if applicable).
It is understood that your down payment pays for the hold of a puppy and time spent occupying a spot on a specific list as well as any professional service(s)shared directly with you and Nosam Kennels. Deposits ONLY reserve a puppy from our kennel, they do not guarantee a specific litter, sex, time frame or position on the list.
Positions on the lists are subject to change at ANY time for any reason.
Your initial purchase price only applies to the list that you joined and the price format at that time. If you switch to a different list with a higher pricing format your deposit will transfer but you will be required to fill out a new contract for the new list at the pricing format during that given time.
It is understood that our pups join their families at 8-weeks of age at the scheduled availability date for each litter.
A $15 fee is required for each additional day after 8 weeks. (note: balances and kenneling fees must be paid prior to picking up if you don’t pick the puppy up on the availability date).
If you participate in extended training all training fee’s & final balances must be paid in full prior to the training by the time the puppy is 8-weeks of age!
Due to the inconvenience created for the breeder and other client or potential client families, you will lose your deposit if any of the following apply: If the contract must be terminated for any reason!
A. If you fail to pay the balance of your pup by the scheduled availability dates for that given litter.
B. If you fail to confirm your intent of purchase after pups are born or you are non-responsive throughout the developing stages thereafter.
C. Changing your mind about the purchase after an amount of time spent occupying a spot on a list. Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy to some other Buyer and retention of the Deposit is meant to compensate Seller for his possible loss. This includes newly developed allergies, health issues or deciding you no longer want a puppy from this kennel or pricing format.
D. Refuse to pay the agreed upon price listed in this contract
The Seller reserves the right to void this transaction (deposit remains non-refundable) if we learn of any reason why Buyer might not be suitable for the puppy – (I e. Conflict between buyer & seller, buyer is found to be an animal abuser, violent person, representative of a Pet Store, representative of a pharmaceutical research laboratory or etc.).
If the transaction is voided through some tragic accident if the Puppy were to die or otherwise be seriously injured before it goes to its new home then, of course, the deposit will be returned to the Buyer; unless the Buyer wishes to apply the Deposit to another Puppy, if one is available, or to a puppy from the next available litter.
Any deposits on litters that are not fulfilled are transferred to the next litter or another upcoming litter by mutual decision. If we are unable to produce a puppy that fits what you are looking for (based on sex and color) within 24-months we will return your deposit.
If you choose to transfer your deposit due to unforeseen circumstances that no longer allows you to purchase your puppy then you must use this deposit within 2-years or it will be lost.
Price: Puppy prices are NON-NEGOTIABLE! The price you agree to pay is listed in the contract at the time of signing and this is the price you are expected to pay for your puppy in full by 8-weeks of age. If other puppies in the litter are discounted after you have signed the contract you are still locked in for agreed upon price format. Refusal to pay the agreed upon price will result in a void of contract and you will forfeit your position on the list.
Shipping & Pick Up: Please note we do ship puppies as Cargo. If your puppy must be transported with a USDA ground shipper or Flight Nanny it is up to you as the buyer to arrange and pay costs associated with that. There will be a $50.00 fee to cover the extra certificate needed for puppies to be shipped via ground or fly in cabin. We can also meet you at Nashville International Airport, or Louisville International Airport with your puppy.
Nosam can deliver puppies for a flat rate fee of $500.00
Spay & Neuter
Buyer understands the recommended minimum age at which one of our puppies shall have Spay/Neuter procedure is 18-24 months old due to early spay & neutering becoming a concerning cause for many serious health conditions in young dogs (Including but not limited to Canine Hip Dysplasia, bladder incontinence, cancers, & more). Buyer is prepared to comply with this for the health of your new puppy. Buyer fully understands that spaying/neutering your puppy before 12 months of age will void our health guarante.
Health: At 8 weeks of age the pups are ready to leave our home and join their new family. We know we have done our best in raising your new family member and we back our puppies with these comprehensive guarantees. All pups
leaving our home will have already been micro-chipped. Any pup/dog being returned must match their said microchip number in order for this guarantee to be honored.
 General Health Guarantee - 3 days Your new puppy is warranted to be in good health and to be virus-free for up to 3 days.
 Hip Dysplasia Guarantee - 24 month
Elbow Dysplasia Guarantee- 24 month
Although Epilepsy is common in the breed we cannot guarantee against is as there is currently no screening test to determine normal, carrier and affected status, to allow breeders the potential to eliminate epilepsy from breeding stock.
**Please be advised that a Urinary Tract Infection (UTI) can also be a common issue with these breeds during puppyhood.
 GENERAL HEALTH
If your veterinarian states that your puppy has any problem that makes it a poor health risk (this does not include the presence of external parasites such as fleas, ticks, lice, mites, mange, etc. or internal parasites such as roundworms, whipworms, hookworms, tapeworms, giardia, coccidia, poisoning, reproductive problems, accidents, vaccine or medicine-related reactions, umbilical hernias, undescended testicles, UTI's, lack of veterinary care, veterinary error, lack of training, or behavioral problems.), you may, within 3 days of purchase,
return the puppy (along with the AKC registration papers and all materials) for a full refund. A written, signed, and dated statement from your veterinarian is required detailing the description of symptoms supporting his/her opinion and an explanation as to why this puppy would be a poor health risk. This exam and all associated costs
are the buyer’s responsibility. Please note that this is 3 days from when the pup leaves our premises.
It is understood that no cash refunds will be guaranteed and we will not be responsible for ANY vet expense or diagnostic testing for any reason. We reserve the right to have a second option obtained from another veterinarian of our choosing. If a puppy should die before the extent of this guarantee a necropsy must be performed within 24 hours of the puppy’s’ passing to determine the cause.
If a currently licensed veterinarian finds a life-threatening health disease within 3 days of purchase, the breeder must be notified immediately (within 24 hours) by the customer with the conclusion of the veterinarian findings. A certified letter is to be sent to the breeder by the veterinarian within 24 hours of the diagnosis. The unhealthy puppy must be returned within 3 business days for a replacement. If you refuse to provide proof of or cannot provide proof from a veterinarian, or do not return the unhealthy puppy the guarantee will be void.
Nosam Kennels, is not obligated to exercise this section of the contract if we believe that the puppy is the victim of an accident or has been abused.
Hip dysplasia (CHD) and other joint problems can often be attributed to environmental conditions as well as heredity. Studies have shown that CHD is 50% genetic as well as 50% environmental. Therefore, we cannot guarantee this dogs hips against any form of dysplasia that is attributable to nongenetic causes, nor do we guarantee a dog will obtain any particular Orthopedic Foundation for Animals (OFA or Pennhip) Rating.
Note: if only one hip or elbow is rated with mild dysplasia or worse but the other side is rated with a fair or better than this is not covered by our guarantee. True hereditary dysplasia is bilateral and affects both sides. Unilateral dysplasia is where there was trauma involved that caused one side to not grow or heal properly. Puppies are warranted against crippling hip/elbow dysplasia that is apparent by 24 months of age.
If a NK puppy is suspected of being mildly to severely dysplastic (hips & elbows) or has eye or thyroid issues within 24 months, due to genetic cause, and is not functionally able to run or walk without extreme pain (Many times, even with diagnosed dysplasia, the puppy can still live a happy, full, and pain-free life), this is the procedure to follow for the terms of the warranty to remain in effect: We will apply the full purchase price of your puppy toward the price of a replacement puppy chosen by Nosam Kennels within 24 months.
Nosam Kennel’s will not be responsible for any travel/shipping expenses, either for receiving a replacement puppy or returning an unhealthy puppy. It is understood that no cash refunds will be given & we will not be responsible for ANY vet expense or diagnostic testing for any reason; including spaying/neutering. The breeder reserves the right to a second opinion to be obtained from a veterinarian of breeder’s choice. If documentation from the veterinarian is received and a life-threatening health disease is verified, and the puppy is returned, then a replacement puppy will be given to replace the above-purchased puppy. The replacement puppy will be the breeder’s choice of current stock or expected litters. If you choose to keep the dog, you have the right to a replacement puppy at 3/4 the selling price from the next litter within 24 months.
A statement must be received from your veterinarian noting that he/she has no knowledge of any injuries to this dog which may have contributed to the dysplasia. The breeder has also recommended the minimum age at which puppy shall have Spay/Neuter procedure is 12-24 months old. Buyer understands that failure to comply with these recommendations shall Null and Void any and all health warranties provided by Breeder.
It is understood that hip/elbow problems can be caused by poor nutrition, early spay/neuter or injury and that the puppy is warranted to the extent of genetic hip or elbow dysplasia, eye & thyroid problems only. In order to maintain the limited guarantee outlined herein, the buyer must
1. have all updated immunizations documented and administered by a licensed veterinarian.
2. Have the dog on a proper moderate exercise routine
3. Provide the dog with a proper diet; dog must not be over or underweight.
4. The dog must not have been bred or sired a litter before 24 months of age.
5. The dog must not have been Spayed or Neutered before 12-24 months of age. (if a puppy is spayed/neutered before this recommendation the warranty is null and void)
6. A copy of the OFA/Pennhip rating must be sent to the Breeder by 24 months of age.
WE ONLY warranty genetic hip, elbow, eye and thyroid issues for 24-months only. We cannot warranty any other health issues not found within the 3-day warranty above!
The dog shall NOT be put to sleep due to genetic health or behavioral issues within this warranty without seller’s written consent.
NON-BREEDING: Buyer understands that we do not sell puppies with breeding rights or funishish puppies to homes for breeding. In order to protect our lines we retain the right to place all puppies on non-breeding contracts.
Buyer agrees and understands that the dog will be registered on an AKC non-breeding Limited Registration that will not be reversed. Buyer understands the dog will NOT be permitted to produce ANY litter during its lifetime. Any other arrangements may only be made with the Seller’s written consent. Violation of this agreement is subject to a fine of $10,000. Puppies are sold on limited registration and must meet the requirements for this to be released at the breeder's discretion. If a dog sold on limited registation is bred we will not consent to registration with ANY registery including AKC (american kennel club) for the the resulting litter(s).
When signing the contract all buyers guarantee that their sole purpose in coming to our property is to buy a puppy & that they are NOT working undercover for HSUS, PETA or any other animal rights extremist group, rescue or any groups affiliated with the sole purpose to end animal ownership & violate the rights of dog breeders. Also that they will NOT give information about our property to any humane society or animal rights organization under penalty of prosecution. The Animal Enterprise Terrorism Act (AETA) is a United States federal law (Pub.L. 109–374; 18 U.S.C. § 43) that prohibits any person from engaging in certain conduct "for the purpose of damaging or interfering with the operations of an animal enterprise."The statute covers any act that either "damages or causes the loss of any real or personal property" or "places a person in reasonable fear" of injury.
This contract contains the entire agreement between Buyer and the seller and no other statements, agreements or attachments, written or verbal, made by either party that is not contained in this written contract shall be valid or binding and is signed by both parties. If any part of this contract is not legal according to local laws, the rest of the contract shall remain unaffected. If any part of this contract is breached by the Buyer the Seller is released from all further obligations.
Buyer agrees not to attack and or criticize the Seller in private or public emails, phone calls, forums, blogs, social networks and any other type of online media at any time during or subsequent to contract period in a way which brings financial harm or bad name to the Seller. In the case of breach of this clause, the buyer agrees to pay five thousand dollars ($5,000) to the Seller as damages.
The contract & warranty only applies to the original buyer outlined in this contract. If the puppy or dog is sold or transferred to another home the guarantee will be null & void.
In the event of any litigation in connection with this health warranty/contract, by signing this contract, the purchaser agrees to be responsible for breeder’s attorney fees. Venue and jurisdiction for litigation arising out of or related to this contract shall be exclusively in breeder’s current county and state.
