By signing this agreement for the Art in the Park the undersigned Vendor (herein referred to as Vendor ) agrees to be bound by each and every of the terms set forth herein and the terms and representations set forth in the Art in the Park Application, which is incorporated herein by reference as though fully set forth.
Space: HACC agrees to provide each Vendor of the Arts Festival with assigned space(s). HACC reserves the right to place Vendors in booth locations at the discretion of HACC.
Refund Policy: A 50% refund will be given in response to a written request received by HACC by September 1, 2019, if the space can be filled from an approved waiting list. No refunds will be given for any request received by HACC after September 15, 2019.
Trash: Vendors agree to remove all trash after the show or be subject to a $35 cleanup fee.
Electricity is not provided. Tent & display are not provided.
Parking: Vendors will be allotted one (1) parking space per booth, for their vehicles in a designated parking area. Due to limited parking availability, HACC cannot guarantee Vendors more than one parking space. HACC is not responsible for tickets or fines to Vendors due to illegal parking of vendor vehicles.
Illegal Contraband: Vendors shall not display, offer for view or sale any illegal or contraband items. The laws of the State of Vermont and local ordinances of the Town of Norwich shall control. Vendors shall not display, offer for view or sale any items that are unlicensed and/or copies/interpretations of licensed or registered items at any site or operation of the Art Festival.
Security: HACC does not provide overnight security patrols, and HACC and the Town of Norwich or the Dresden School Department accept no responsibility for items left overnight. Vendors are solely responsible for the security of all items in their booth at all times.
Attendance: HACC makes no representation or guarantees towards actual attendance.
Weather: The festival is a rain/shine event. Vendors understand that HACC has no control over weather, acts of God, acts of terrorism, or governmental intervention, or any other cause that may prevent, and or interrupt, the festival, and Vendors shall hold HACC harmless for any losses that could arise because of such event.
Liability: The Vendor agree(s) to defend, indemnify, and hold harmless HACC and the Town of Norwich and Marion Cross School from any claim, demand, suit, loss, cost or expense, or any damage which may be asserted, claimed or recovered against or from HACC and the Town of Norwich and Marion Cross School by reason of any damages to property, personal injury or bodily injury, including death, sustained by any person whomsoever and which damage, injury or death arises out of or is incident to or in any way connected with the 2018 Art Festival and regardless of which claim, demand, damage, loss, cost or expense is caused in whole or in part by the negligence of the Town of Norwich, Marion Cross School or by third parties, or by the agents, servants, employees or factors of any of them.
This agreement has been read, understood and entered into freely, voluntarily and absent of duress by the parties signed below.
Acting in its sole discretion, HACC reserves the right to reject any application for any reason.
Taxes: All sales taxes and reporting are the sole responsibility of the vendor. Vermont does require collection of sales tax including from out of state vendors. To register, visit www.myvtax.vermont.gov and file as a seasonal business.
