Terms of Contract.
Retainer:
A retainer fee of $250 is required for all portrait sessions. This is a non-refundable retainer. In the event of cancellation, the retainer paid is non-refundable. It shall be liquidated for damages and loss of work to the Photographer. By entering into this agreement the client understands that the photographer is foregoing other photographic jobs. These fees are transferable if a date change is necessary. Forty eight hours notice for postponements is necessary.
Model Release:
Michelle Ivy Photography has permission to use any photo taken of you during your session in marketing and advertising. You grant Michelle Ivy Photography irrevocable and unrestricted rights to use and publish all photos taken under this contract for any purpose and in any medium, to alter the photos without restriction, and to copyright the photos without restriction, in perpetuity. Michelle Ivy Photography reserves the right to use any and all photos taken during your session in materials to market and promote her business.
Copyright:
All photos are copyrighted. The digital images created by the Michelle Ivy Photography remain the property of the Photographer. It is illegal to copy, scan, reproduce, or post online without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalities.
Creative License:
Images are edited at the Photographer’s discretion, and delivered prints may not include all images shot. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards.
Force Majeure:
If the Photographer cannot perform this Agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
Archival Policy:
Michelle Ivy Photography is not liable for the loss of images beyond the final delivery of all products of the original ordering session.
Pricing Policy:
Services or merchandise not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice.
Ordering Policy:
Your Ordering Appointment will take place one to two weeks after your photo session. THIS IS THE TIME TO PLACE YOUR ORDER. Additional ordering appointments will incur an additional fee of $100.
Sales Policy:
Due to the custom nature of all of our products, ALL sales are final.
