Closed on Sundays. Rentals Done on Saturday's will be charged the weekend rate if not returned Saturday by 5:00 pm.

I accept for use the equipment listed on this form and accept full responsibility for the care of this equipment. I have made no misrepresentations to this ski shop regarding this user’s height, or age.

I understand and am aware that Nordic skiing/Snowshoeing/Ice-Skating can be a HAZARDOUS activity. I understand that the sport of Nordic skiing/Snowshoeing/Ice-Skating and the use of this equipment involve risk of injury to any and all parts of the user’s body. I hereby agree to freely and expressly assume and accept any and all risks of injury to the user of this equipment while skiing/ snowshoeing.

I understand that the Nordic skiing equipment being furnished forms a part of or all of a Nordic ski-boot-binding boot-binding system which is a NON-RELEASE system and that its use cannot guarantee this user’s safety of freedom from injury while skiing. I further agree and understand that this Nordic ski-boot-binding system does NOT REDUCE THE RISK of injuries.

I agree that I will release this ski shop form any and all responsibility or liability for injuries or damages to the user of the equipment listed on this form, or to any other persons. I agree NOT to make a claim against or sue this ski shop for injuries or damages relating to skiing/snowshoeing/ice-skating and/or the use of this equipment.

I hereby agree to accept the terms and conditions of this contract. This document constitutes the final and entire agreement between this ski shop and the undersigned. This ski shop, itself, provides NO WARRINATIES, expressed or implied, and this equipment is accepted “as is”.

I have carefully read this agreement and the release of liability and fully understand its content. I am aware that this is a release of liability and a contract between this ski shop and myself and I sign it of my own free will.

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liability incidents to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE (RELEASEES), to the fullest extent permitted by law.

TERMS & CONDITIONS

A. Payment and security deposit.

1. I agree to pay upon demand all rates, charges, plus applicable taxes, fees and surcharges, which may apply to the rental, including charges for loss and/or damage defined in this agreement. I agree and authorize Wilderness Sports to apply any charges to the method of payment used by me at the time of rental unless another form of payment is arranged.

2. I understand that an authorization will be processed against my credit card to be used against the final bill, equal to the estimated total charge, plus a security deposit, and I authorize Wilderness Sports to charge any amounts due as a result of the rental, plus any damages, if applicable, to my credit card or other payment method provided, regardless of who is/was using the ski or snowshoe equipment.

C. Entire agreement and disputes.

1. This agreement contains the entire understanding between and among the parties and supersedes any prior understandings and agreements among them respecting the subject matter of this agreement.

3. Minors: Prospective participants under the age of 18 years are required to have a parent or legal guardian read and also sign this release. The parent and the participant under 18 have read, understand, and agree to comply with this Release.
