Exclusivity
Tricia V Photography will be the exclusive professional photographer, included in your package, for the purpose of photographing the event. Family and friends of the Clients are welcome to photograph the event as long as they will not interfere with the duties of the Tricia V Photography. While every reasonable effort will be made to produce and deliver outstanding photographs/coverage of the wedding events, the Photographer's entire liability to the Clients for any claim or loss arising from the Photographer's performance is limited to a refund to the Clients in the amount of what the Clients paid for this portion of our services. Because a wedding or vow renewal is an uncontrolled event, Tricia V Photography cannot guarantee delivery of any specifically requested images(s)/coverage.
Cancellation
The security deposit paid at the signing of the contract is non-refundable. If the Client cancels the terms of this contract more than 60 days prior to the event date, the remaining charges will not be owed and all payments already made above the security deposits will be refunded less material charges incurred up to time of cancellation. If the Client cancels the event with the intent to reschedule, Enchanted Forest Weddings extends the option to re-book a new date and apply the retainer fee towards that booking.
Substitution
In the event of illness or sudden event out of the control of both parties, Enchanted Forest Weddings will attempt to substitute a photographer, venue or Officiant at no cost to client. This contract will be transferable to said professional.
House Rules
Enchanted Forest Weddings is limited by the guidelines of the venue and event officials and/or management. Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the Client's responsibility; Enchanted Forest Weddings will offer alternative recommendations only.
Creative License
Venue decor and style is at the discretion of Tricia Vogt with the Clients input but is a creative process so may exactly match photo examples. Images may be edited at the photographer’s discretion, and delivered images may not include all images shot. The photographer reserves the creative right to edit and release only those deemed professional in quality and within the photographer’s artistic standards. To insure the quality of imagese no Raw files will be released. By signing this contract, the client is aware of the style of photography that Tricia V Photography produces.
Deliverable Items
Marriage Certificate: A decorative Certificate will be signed and presented to the couple on the day of the wedding. Official legal certificates and documents will be mailed withing California guidelines.
Proof Gallery: Clients will recieve a link to their online proof gallery within 7 days of their wedding day. Proof gallery will be password protected and Tricia V Photography encourages the Client to share their gallery and password with family and friends. Tricia V Photography will host the gallery for 180 days, after that time the Client may request the gallery remain open at an additional fee.
Digital Image Files: Tricia V Photography will keep your digital files on hand for 24 months from your wedding date. If digital files are included in Client's photo package, once delivered, it is the Client’s sole responsibility to protect and retain their images for the future. It is highly recommended that DVDs or USB drives be duplicated and stored in multiple locations that are cool and dry. (Technology can be fickle; one of the best ways to ensure the Client’s images will last for generations is for the Client to print them.) If Client requires old files to be duplicated by the photographer, and they are still within the photographer’s possession, a restocking fee may be applied.
Albums and Prints: Client has 90 days from receipt of their proof gallery to choose their favorites for the album and/or print package(if included in the Client's package) after that, Tricia V Photography reserves the right to select the album and/or prints package images. Tricia V Photography will provide an album proof, delivered electronically, to the Client for approval before printing. Prints and albums will not be printed until approval is recieved from Client. Client agrees that once album proof is approved, Tricia V Photography will not be held liable for any errors, so please thoroughly review your proofs. The Client has 30 days from the receipt of the album proof in which to request any changes. Due to possible unforseen changes with album vendors Tricia V Photography reserves the right to make substitututions to album materials if necessary.
Copyright & Usage
Clients will have the limited rights to make and use copies of the digital images provided, for their own use in print, email and on personal web pages. Clients will not make copies for the purpose of circumventing the sale of images by Tricia V Photography, nor will the Clients authorize any reproductions of the images for commercial use or for photographic competition or display without approval from Tricia V Photography. Tricia V Photography will furnish the client with a written release, which will allow the Client to make copies, prints and other reproductions for personal, non-commercial use and distribution. Tricia V Photography retains the copyright in all images created and will have the right to make reproductions for portfolio samples, self-promotion, and professional competition. Agreement This agreement is not valid until signed by the Clients. This Agreement incorporates the entire understanding between the clients and Circle Road Photography. Any modifications of this Agreement must be in writing and signed by all parties.
All parties understand and agree to all that is above. Client(s) agree(s) to only sign if they have read and agreed to the terms of service in this contract and they believe all information is deemed correct to the best of their knowledge.
