BOOKING PROCESS*

BOOKING PROCESS: NON-REFUNDABLE DEPOSIT of $200 is required to reserve the portrait photography services detailed in this contract. The proposed contract will expire one (1) week from the date it is prepared if the non-refundable retainer and signed contract are not received. Portrait photography services are reserved on a first-come, first served basis. Therefore at the time the contract is signed by both parties and the non-refundabler deposit is paid, Sentimental Soul will reserve the date + time agreed upon for CLIENT and will not make another reservation for the date + time agreed upon. For this reason the deposit Is non-refundable.

TERMINATION BY CLIENT*

CLIENT may terminate this agreement if notice of such termination is given to Sentimental Soul Photography in the following manner: CLIENTS must send email notification and written response and acknowledgement from Sentimental Soul must be received. This is the method of cancellation agreed upon by all signing parties and the only method of cancellation that will be accepted. In the event of cancellation by CLIENT, Sentimental Soul shall retain CLIENT’s non-refundable payment as liquidated damages, this contract shall be cancelled, and both parties shall be relieved from further obligation and liability.

SESSION RESCHEDULING*

In the event that CLIENT needs to reschedule the session, Sentimental Soul Photography will allow for one session reschedule without penalty. In the event that CLIENT cancels and reschedules her session a second time, she shall be invoiced a $75.00 (USD) reschedule fee. In the event that CLIENT reschedules her session a third time, client will incur a $100 (USD) reschedule fee. Unless Leah Fry requests the reschedule no penalties will be incurred.

LATE ARRIVAL*

CLIENT acknowledges that he/she must arrive on time to her scheduled portrait session start time. If CLIENT is late to her scheduled start time, time will not be extended or rescheduled. Refunds are not available for portrait sessions cut short or entirely missed due to CLIENT'S late arrival.

TRAVEL FEES*

If the CLIENT’S session is less than 30 miles outside of DSM. CLIENT shall not incur any travel fees. If the CLIENT’S session is in excess of 30 miles outside of DSM $0.50 per mile will be charged in addition to session fee.

LOCATION ACCESS, FEES, PERMITS + HOUSE RULES*

If CLIENT wants to shoot at a location that charges for access or requires permits, CLIENT shall be responsible for all fees associated with shooting there, including but not limited to entrance fees and parking. CLIENT shall also be responsible for organizing access to the location and any permits required for doing so. Sentimental Soul Photography is limited by the guidelines of the location. CLIENT shall be responsible for negotiating deviations from the house rules.

ARTISTIC STYLE*

On CLIENT'S own behalf, and on behalf of the subject(s): CLIENT acknowledges that Sentimental Soul Photography requires and retains discretion as to how its services shall be provided (e.g. choice of poses, lighting, lenses, etc.); that CLIENT are familiar with the Photographer’s portfolio and is requesting Services with knowledge of the Photographer’s style; that Photographer’s work is constantly evolving; that Photographer’s services are of unique and artistic nature; that the images created may be different from images taken by the Photographer in the past; and that in creating the images, the Photographer shall use her personal artistic judgment to create images consistent with her personal vision of the session, which vision may be different from CLIENT and /or the Subject’s vision of the session. Accordingly, CLIENT acknowledge that the images shall not be subject to rejection on the basis of taste, esthetic criteria, or personal appearance.

COPYRIGHT & IMAGE USE BY Sentimental Soul Photography*

The photographs produced by Sentimental Soul Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without written consent. Sentimental Soul Photography owns all copyrights for any and all images produced in connection with this agreement, including the right to reproduce or publicly display such images, for any personal or commercial purpose, without compensation to CLIENT or notification to CLIENT before use. Sentimental Soul Photography also reserves the right to publicly display her work in any manner she sees fit. Copyrights will be dually released to client once full payment is received.

LIMITATIONS ON LIGHT*

Sentimental Soul Photography is primarily a natural light photographer, except for studio newborn portrait sessions. CLIENT acknowledge that in the event that any part of the portrait session occurs at a time or in a location where there is an absence of natural light, Sentimental Soul Photography will have to use artificial light sources and the images will look different than the natural light images CLIENT have seen in Sentimental Soul Photography's portfolio. Accordingly, CLIENT acknowledge that the images shall not be subject to rejection on the basis of taste, esthetic criteria, or personal appearance.

WEATHER LIMITATIONS FOR PORTRAIT SESSIONS*

CLIENT recognize that Sentimental Soul Photography prefers to shoot in outdoor, natural light for her portrait sessions. Therefore, Sentimental Soul Photography reserves the exclusive right to reschedule her portrait sessions due to weather conditions. Sentimental Soul Photography will notify the client via email or text a couple hours in advance of the portrait session if the session needs to be rescheduled due to weather conditions, including but not limited to rain, wind, snow, dust, extreme temperatures, etc.

PHOTOSHOP + EDITING*

After the portrait session, each image is put through a careful selection process, where Sentimental Soul Photography selects images that meet her high standards of quality. Images with eyes closed, unflattering poses, and duplicate images are removed permanently immediately after Sentimental Soul Photography completes this culling process. CLIENT acknowledges that Sentimental Soul Photography retains complete control over the culling and editing process. SS Photography color corrects and does portrait editing on all delivered images in Adobe Lightroom. During the retouching phase for images (i.e., acne) may incur additional charges for overall time commitment. Typically extreme acne on clients will result in a smaller quantity of images due to post work required. Any additional client requested edits, including but not limited to, removal of scars or birthmarks, removal of persons or things, body shaping, head swaps, glare removal, etc., shall be outsourced to our editors at $30 (thirty dollars USD) per image per round of revisions.

ARCHIVAL OF IMAGES*

Once Sentimental Soul Photography delivers the final JPEGs to CLIENTS The CLIENT accepts all responsibility for archiving and protecting their images if digitals are purchases. Sentimental Soul Photography does not permanently archive image files.

IRREVOCABLE MODEL RELEASE*

CLIENT must execute the model release in order to book a session with Sentimental Soul Photography, even if CLIENT elects to not to allow Sentimental Soul Photography to share images under the PRIVACY clause.

Downloads will come via online link and a password to protect your privacy. Digital images are your property and to be used and printed at your discretion.
