I am extremely honored that you chose Deanna Webber Photography to photograph this special time for you! This letter sets forth the terms and conditions of our engagement.

BOOKING RETAINER: Your $350 non-refundable session retainer fee is due at the time of booking. Deanna Webber Photography shall have the right to cancel your session date or to give it to another client if it does not receive full payment according to the guidelines set forth in this contract. The fee shall be good for services performed on the originally scheduled date. In the event that you need to re-schedule that date, pricing and availability to provide services on such date will be reviewed. In the event of a cancellation, your session fee will be honored one reschedule date. If that date is also cancelled, a new session fee will apply for future sessions.

YOUR SESSION RETAINER COVERS PRE-SESSION PLANNING, ACCESS TO DWP STYLE CLOSET, PROFESSIONAL HAIR AND MAKEUP, YOUR 2.5 HOUR SENIOR SESSION, AND AN IN-PERSON (OR ONLINE VIA ZOOM) GALLERY REVEAL.

AS WITH THE CUSTOM NATURE OF YOUR SESSION, IMAGES AND PRODUCTS ARE SEPARATE FROM THE SESSION RETAINER. WHAT YOU ORDER IS FULLY TAILORED TO YOUR STYLE AND NEEDS. WE OFFER SEVERAL COLLECTIONS OF ARCHIVE QUALITY PHOTO PRINTS AND PRODUCTS, AS WELL AS HIGH RESOLUTION DIGITAL IMAGES.

  

MODEL RELEASE: Photographer reserves the right to use images created under this contract for advertising, display, publication or other purposes. The Client signing this contract gives permission for photographer to use their name, images and photographic likeness in advertising, display, publication or other purposes including social media websites and Facebook. Negatives, digital files, websites and previews remain the exclusive property of Photographer.

GALLERIES: A sneak peek will be given typically the night of your session unless you request one not be shown.Your completed gallery will be ready within 2 weeks from our session date in which time we will meet for your Gallery Reveal and ordering appointment. Should you purchase digital images they will be ready for you same night. 

GALLERY REVEAL/ORDERING APPOINTMENT: Your Gallery Reveal will be the time you view you gallery and decide on which products you would like to showcase your images. Please make sure all financial decision makers are present for this. Post session prep materials will be given to you after your session and will help you have a purchase plan heading into the orderin appointment. 

PRODUCT ORDERS: A minimun order purchase of $600 is in place for all sessions with Deanna Webber Photography at this time. All product orders can be paid in full or put on a payment plan. If you would like to choose products and make payments, products orders will not be placed until final payment has been received. For your convenience DWP accepts cash, check, and all major credit cards. 

COMPLETED ORDERS: You will be notified when your product order is ready. Your order will be delivered to you at your earliest convenience. While I anticipate that print orders will be filled in approximately 2-3 weeks, Deanna Webber Photography makes no guarantees in this regard. Rush orders can be placed for an additional fee. Once your portraits are picked up, there are no returns or exchanges due to the personalized nature, so please be certain to inspect your order carefully. If you choose to have your order shipped, I must be notified within 24 hours of any problems.

Deanna Webber Photography’s liability for its provision of products and services hereunder shall be limited to the amounts paid to Deanna Webber Photography hereunder.

OTHER: Deanna Webber Photography reserves the right to terminate any session due to any failure of the client to adhere to the requirements set forth in this Agreement or if the subject(s) being photographed are unwilling to be photographed or if anyone in the session is behaving in a manner that the photographer deems inappropriate or inconsistent with the purposes of the session. In the event of any such termination, Deanna Webber Photography may offer to schedule a new session in its sole discretion; provided, however, that it is under no obligation to do so. Under no circumstances will the session fee be refunded.

Deanna Webber Photography is not responsible or liable for any failure to provide any services due to any act of God, weather event, act of government or any other occurrence, act or event which is outside of Deanna Webber Photography's exclusive control. In addition, Deanna Webber Photography shall not be responsible for equipment failure or the failure of any software or other computer or electronic medium which results in any damage to any proofs, negatives, digital files, prints or photos or which result in the inability to print or duplicate any of the foregoing.

Deanna Webber Photography shall have the right to use all negatives, files, proofs, photos, prints and all images and likenesses thereon in connection with its display and marketing efforts and you grant to Deanna Webber Photography a royalty-free, fully paid and irrevocable license to use all such materials for its commercial and artistic purposes and you represent that you have the authority to grant the same.

You agree to be responsible for any damage occurring to any of Deanna Webber Photography equipment or property during or as a result of the event or the actions of any session attendees, or as a result of any condition or occurrence at an on-location session which results in damage, other than damage which results solely from Deanna Webber Photography’s negligence.

While Deanna Webber Photography strives to provide its clients with the utmost in photography services, Deanna Webber Photography is, first and foremost, an art studio with an established style and reputation. While Deanna Webber Photography regularly works with its clients to deliver photographs which will meet their individualized needs, Deanna Webber Photography reserves the right to exercise full artistic control over the nature, number and types of pictures it creates.

Client understands that when sharing photos online via personal website, Facebook, Instagram, etc., Deanna Webber Photography asks that the client not edit the photos in any way, including removing the watermark (if present), cropping the image, adding filters, or any other creative alterations.

Under no circumstances will RAW/unedited images be delivered.

RELEASE AND WAIVER OF LIABILITY DURING COVID-19

 

 I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND CONSTITUTES A CONTRACT BETWEEN ME AND DEANNA WEBBER PHOTOGRAPHY “PHOTOGRAPHER”.

 I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT DURESS OR COERCION AND I AM AND HAVE BEEN FULLY INFORMED OF THE CONSEQUENCES OF MY SIGNATURE HERETO.

 I AM AWARE THAT PARTICIPATION IN THIS SESSION MAY INVOLVE INTERACTION THAT COULD POTENTIALLY LEAD TO INJURY, SICKNESS OR EVEN DEATH. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES AND INTERACTIONS WITH KNOWLEDGE OF THE DANGER INVOLVED AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN. I AM EXPRESSLY ASSUMING THE RISKS ASSOCIATED WITH MY PARTICIPATION IN THIS ACTIVITY. I AM EXPRESSLY ASSUMING THE RISKS ASSOCIATED WITH THE CURRENT COVID-19 PANDEMIC AND CONTINUE THIS ACTIVITY AGAINST CENTER FOR DISEASE CONTROL AND/OR GOVERNMENTAL DIRECTIVES.

I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death, or loss of personal property and expenses as a result of those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.

 

I hereby waive, release and forever discharge PHOTOGRAPHER (“Released Parties”) from any and all claims I may have now or arising in the future related to my participation in the photography session. I covenant and agree not to sue any Released Parties for any such claims. I hereby waive, release and forever discharge the Released Parties from all of the following (the “Claims”): any and all claims, liabilities of every kind, demands, damages (including direct, indirect, incidental, special and/or consequential), losses (economic and non-economic), and causes of action, of any kind or nature, which I have or may have in the future (including court costs, attorneys’ fees and litigation expenses), that may arise out of, result from, or relate to my participation in the session or my travel to and from such activities . I understand and acknowledge that these Claims include, but are not limited to, causes of action for death, personal injury, partial or permanent disability, negligence, and property damage or theft; causes of action relating to the provision of first aid, medical care, medical treatment, or medical decisions; and claims for medical or hospital expenses, including medical transportation services. I understand and agree that the foregoing waiver, release and discharge applies even if the Claims are caused by the negligent acts, omissions, or carelessness of any Released Parties. I understand that this waiver, release and discharge operates for myself as well as on behalf of my spouse, children, parents, guardians, heirs, next of kin and any legal or personal representatives, executors, administrators, successors and assigns, or anyone else who might claim or sue on my behalf. I further agree to indemnify and hold harmless all released parties from any claims which I might make or which might be made on my behalf by others or which might be made against me by others, arising from my participation in the activities provided by the released parties, my travel to or from such activities.

 

This waiver shall remain valid unless expressly revoked by the participant or parent or guardian of a minor, in writing, with receipt acknowledged by the released parties.
