The member company is familiar with, undertakes to comply with and to subscribe to the Code of Ethics at all times, including inter alia, to have a compliant franchise agreement and disclosure document, and to operate honestly, compliantly and ethically.I further declare that as the duly authorised representative of the applicant company, that the company is financially sound and that the information given by me in this application is to the best of my knowledge and belief accurate and complete.As the duly authorised representative of the applicant company, I agree and understand that should this application be unsuccessful for any reason, an administration fee of R3,500 excluding VAT would be deducted from the membership fees paid to FASA and the balance refunded to the applicant company. It is to be noted that the once-off legal fee paid by the applicant company (if applicable) is not refundable. The Franchise Association of South Africa will not pay interest on any membership or any other fees paid by an applicant or existing member.That membership of FASA (Franchise Association of South Africa), once granted, continues and automatically renews annually, unless the member company informs FASA, in writing, during the month of October, of its intention to cancel its membership for the ensuing year. Should FASA not receive a cancellation notification in writing during the month of October, a membership invoice will be raised thereafter for the membership fees for the ensuing year.I, the undersigned, who is a duly authorised representative of the applicant, acknowledge that the Franchise Association of South Africa (FASA) or any of its agents, financial institutions or credit bureau may conduct a credit check and exchange of such information on the applicant company for purposes of assessing the company as a potential member of FASA.I understand that FASA membership includes a free mediation service. I agree to consider the arbitration process in the event the mediation fails.As a member of the Associaton, your franchisees automatically become members, therefore we request that you agree to supply us with a list of your franchisees contact information in order to receive industry information, invites to events, conferences, workshops, awards etc. and certifications.FASA may inform your franchisees, should your franchise company’s membership (franchisor’s membership) status lapse or be cancelled.
