Contractual Agreement
1. The retainer fee is non-refundable and required at the time of booking. The retainer fee goes toward the session package total. If the client cancels, the deposit will not be refunded. If the Photographer fails to appear at the place and time specified above, the deposit shall be refunded to the client. 2. Tenley Grace Photography accepts cash, check, or 3 major credit cards: Visa, MasterCard, and American Express. Session fee must be paid at the time of the session. 3. Digital images will be available within approximately 2-3 weeks from your session date. Images will be delivered via online gallery. 4. Images will be kept on file for six months from the date of creation for your convenience in case of you needing more copies. 5. If, in the opinion of the photographer, inclement weather, a child's disposition, or other adverse conditions prevent the photography session from occurring as planned, Tenley Grace Photography may suggest rescheduling the portrait session. 6. Tardiness: minutes late to the session will be deducted from the length of the session. After 30 minutes, the photographer has the right to leave the session meeting place and/or cancel the session. Please contact the photographer prior to the start time in the event of tardiness. 7. Because it can be distracting (especially to small children), other cameras are not allowed at the photo session. 8. The Photographer retains copyright of the photographs, and hereby grants the client unlimited but non-exclusive rights to use or reproduce the photos for which the client pays. 9. The client expressly releases the photographers from all claims, damages, and liabilities that may result from accidents or incidents that occur during the portrait session. This waiver of liability includes waiver of any claim that may be a result of negligence. 10. The client has read and understood the terms above. The person signing this contract agrees to act as a representative of all people photographed, and represents their agreement to these terms and conditions. I hereby give to Tenley Grace Photography the absolute and irrevocable right and permission with respect to the photographs that have been taken of myself and/or my minor child in which he/she may be included with others: a) To copyright the same in the photographer's name or any other name that she may select; b) To use, re-use, publish, and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium selected below in social media now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy. Social Media: The photographer may use the images from your session to further promote their services, including portfolio, website, display, advertisements, and editorial use on any social media websites, including but not limited to Facebook, Instagram, and Pinterest. The photographer retains all copyrights to the images and derivative works. Full name typed below indicates agreement to the above statements.
