I.*

On signing of this agreement by both parties hereto, the Photographer(s) will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable even if the date is changed or if the event becomes cancelled for any reason.
II.*

Clients shall receive an online folder containing edited, finalized digital copies of the images. Images can be re-edited by the Photographer to Client specifications no more than one time within 10 business days after delivery without charges.
III.*

All original negatives and files will be the sole property of the Photographer(s). Final, edited images in the form of digital copies and/or prints will be owned jointly by the Client and the Photographer(s) and can be used free from discretion of the Photographer(s) as long as proper credit is given, such as watermarks, tags, etc. is given on all social media, but cannot be used for profit without express consent of the Photographer(s). The Photographer(s) has/have the right to use any of the resulting images in any form of promotion but will not engage in the individual sale of the images without express consent of the Client(s).If there are any copyright violations by CLIENT without written consent of Ernest Tyler Broome, CLIENT will be charged at fifteen (15) times the published rates at the time of the violation as liquidated damages, since actual damages would be difficult to calculate.
IV.

I, the client, understand that there is absolutely no monetary compensation or reimbursement for this shoot. Unless previously discussed.
V.*

I, the client, acknowledges that I must arrive on time at the time I schedule. *Note: Models that are periodically late to his/her scheduled start time, will not be extended or rescheduled.
VI.*

Ernest Tyler Broome grants CLIENT a non-exclusive, non-transferable, perpetual personal-use license to download and copy the accompanying copyrighted digital images in their gallery, according to the following terms: COPYRIGHT AND OWNERSHIP: Ernest Tyler Broome retains all rights, license, copyright, title, and ownership of the media, now and in the future. WARRANTIES; AS IS: There are no warranties associated with the copyrighted digital images in this gallery, express or implied. The media is provided "as is." LOSS: Ernest Tyler Broome is not responsible for the loss of your digital images once they have been delivered. It is your responsibility to back up your images upon receipt. THIRD PARTY CLAIMS: Neither Ernest Tyler Broome nor outside vendors will be liable for any third party claims or incidental, consequential, or other damages arising out of this license or buyer's use of the media. PERSONAL WEB USE: Ernest Tyler Broome permits clients to post the copyrighted digital images in this gallery for personal use on social media ONLY IF credit is given to Tyler Broome Photography/Ernest Tyler Broome and a link is provided back to Tyler Broome Photography. The copyrighted digital images may not be posted on business social media pages without the express written consent of Ernest Tyler Broome. PERSONAL PRINT USE: Ernest Tyler Broome permits clients to print the copyrighted digital images in this gallery for personal use in the following ways: prints up to an 8x12, greeting cards, photo gifts, photo books, and other small personal items. Prints larger than an 8x12 should be ordered through Ernest Tyler Broome, as we cannot guarantee the quality of the images large than an 8x12 printed through any other lab. ALTERATION OF DIGITAL IMAGES: The alteration of the digital images in this gallery through the use of personal digital image enhancement software, including but not limited to Instagram, Picasa, Lightroom, Photoshop, etc., in any way, is strictly prohibited and is considered a copyright violation under Federal Copyright Law. COMMERCIAL USE/PERSONAL USE FOR MONETARY GAIN: Commercial use, or personal use for monetary gain, on the web or in print is strictly prohibited, unless written permission has been obtained from Ernest Tyler Broome and credit is given to Ernest Tyler Broome. Clients' vendors may email etbroomephotography@gmail.com for written permission. OTHER TERMS: Any other utilization or reproduction is specifically prohibited without the express written consent of Ernest Tyler Broome. Nothing contained herein shall be deemed a release of Ernest Tyler Broome's copyright on any of the digital images.
VII.*

I understand that clothing for the shoot will not be provided to me, I must bring my own, in accordance to the info sheet sent out by the photographer.
VIII

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk I (or anyone that I bring to my session) may be exposed to or infected by COVID-19 by attending my session and that such exposure may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the location of the shoot may result from the actions, omissions, or negligence of myself and others, including, but limited to, Ernst Tyler Broome, volunteers, and other participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, or death), illness, damage, loss, claim, liability, or expense, of any kind, that I, or my household may experience or incur in connection with my attendance at the shooting location or participation in a photography session with Ernest Tyler Broome.On my behalf, and on behalf of my household, I hereby release, covenant not to sue, discharge, and hold harmless Ernest Tyler Broome, its assistants, agents, and representatives, of and from Ernest Tyler Broome of Tyler Broome Photography, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions of Ernest Tyler Broome, its assistants, agents and representatives, whether a COVID-19 infection occurs before, during, or after participation in any photography session.
TERMS:*

For good and valuable Consideration, receipt of which is hereby acknowledged, I grant to Photographer, Ernest Tyler Broome, his heirs, successors and assigns, my unlimited permission to license, use, reproduce and distribute images of me and/or my property, in any country, at any time, in any Media, for any purpose. Such permissible use may include but is not limited to: commercial use, personal use, advertising, trade, exhibition, competition, promotion, marketing, stock photography, product packaging, video, print, publication or editorial work. I understand and agree that my images may be altered and modified to the point where I may even be unrecognizable. My images may be combined with other pictures, text or graphics. You may even combine my name or an alias name with my images. I understand that I will have no right to inspect or approve the final use of my images or copy that may accompany it. I agree that I have absolutely no right to compensation for use of my images. I warrant I will make no claim against Photographer or his assigns for compensation relating to the use of my images. I agree that this contract will be binding not only upon me, but upon my heirs, successors and assigns as well and that this release is irrevocable and enforceable worldwide, to the fullest extent possible under the law. Any dispute relating to this agreement will be governed by the laws of the State of Georgia, USA. RELEASE: By signing below, I hereby release, acquit, indemnify, hold harmless and discharge the Photographer, his employer, heirs, agents, successors and assigns, from any damages, actions, claims, attorney fees, costs and suits arising in any way whatsoever from the uses permitted and described more fully above that may arise in any way whatsoever from the use of my images. If any suit is brought challenging the enforceability of this agreement, I agree to indemnify Photographer or his assigns for attorney fees and expenses. I represent and warrant that I am at least 18 years of age and have the full legal capacity to execute this release.
