Terms and Conditions:
Photo Booth Service Agreement
- This agreement ("Agreement") is entered into by and between Visalia Photo Booth Company (hereinafter referred to as "Provider") and the undersigned client (hereinafter referred to as "Client") for the provision of photo booth services at the event detailed below:
Service Period:
- The service period shall commence at [Please fill in] and continue until [Please fill in]. The Provider agrees to operate the photo booth during this period, with occasional interruptions for maintenance.
Payment Terms:
- A non-refundable booking fee of $40 is due upon signing this contract. The remaining balance is payable on or before the day of the event.
- Payments can be made in cash, via credit card, or through PayPal, Cashapp, Venmo, Zelle. Personal checks are not accepted.
- Additional rental time beyond the agreed service period will be billed at a rate of $125.00 per hour. Any additional services requested during the event must be paid for in cash or by credit card before the service commences.
Delivery and Setup:
- The event location must be accessible for photo booth delivery and setup at least one hour before the start of the event.
- The Client is responsible for ensuring a clear space of at least 10 feet by 10 feet by 10 feet for each booth tower and providing a standard 120V electrical outlet within 10 feet of the desired location.
Travel:
- A travel fee of $1 per mile will apply if the event site is located over 45 miles away from 93277 (Provider's office location).
Standby Time:
- Setup will commence one hour before the event start time.
- If the Client requires the photo booth to be operational beyond the agreed service period, a standby charge of $125.00 per hour will apply.
Date Changes & Cancellations:
- Any request for a date change must be made in writing at least 10 days prior to the original event date and is subject to availability.
- Cancellations made less than 10 days before the event date will forfeit all payments received.
Liability and Damage:
- The Client is liable for any damage or loss to the Provider's equipment caused by misuse or theft.
- Abusive behavior towards Provider's staff will not be tolerated and may result in event termination without refund.
Children Under 12:
- Children under the age of 12 must be supervised by an adult at all times when using the photo booth.
Weather and Force Majeure:
- The Client agrees to pay the total fee regardless of event modifications due to weather or force majeure.
Attorney Fees and Choice of Law:
- Each party shall bear its own attorney fees in case of litigation. Any legal disputes shall be governed by the laws of the state of California.
Miscellaneous:
- If any provision of this agreement is deemed unenforceable, the remaining provisions shall remain valid.
- The Client agrees to resolve any disputes via arbitration.
- If the Provider fails to supply a working photo booth for at least 80% of the service period, the Client shall receive a prorated refund.
