Shooting Academy Canada Ltd. offers archery training and lessons, range use, air/BB gun target shooting and training, and knife throwing (hereafter referred to as “shooting activities”), which allows participants to use personal or club provided equipment, as well as participating in training programs to obtain licences for firearm and hunting. NOW & SETFORTH, in consideration to follow the instruction or not, the mutual covenants and conditions of this release, and other goods and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, therefore participants agree as follows:
SECTION 1: REGISTRATION OF PARTICIPANTS.
A. The listed individual or participants, who wish to participate with or without instructions, and/or to shooting activities at our facility. B. Participants declare that he/she/they has/have no medical condition or impairment of any kind that would prevent understanding of instructions, performing target shooting as instructed, safely using bows, air/BB guns and/or knives without harm to himself/herself and others, including pregnant women and their unborn child. Participants acknowledge and certify that he/she is not under the influence of any legal or illegal drug or alcohol.
SECTION 2: RIGHT TO REFUSE PARTICIPANT(S).
Participants understand and agree that Shooting Academy Canada Ltd. may refuse to allow participation in instructions or limit the extent of any activity if our staff or other guests believe in their sole judgment that such action may present or cause any safety hazard to him/her/themselves or others. Refusal may result in the inmediate termination of participation in any activity, and without any refund subject to cause of termination determined by the owner.
SECTION 3: WARNING AND ASSUMPTIONS OF RISK.
Participants understand that there are inherent elements of risk and danger always present in any of these activities, while using equipment or receiving instructions, despite all typical safety precautions. The participant accepts that they are well familiar with the operations associated with these activities.
SECTION 4: RELEASE OF LIABILITY AND INDEMNIFICATION.
Participants understand and agree, except in the event of an intentional act by Shooting Academy Canada Ltd. representatives, that participants accept all the responsibilities and have agreed not to make any legal claim against Shooting Academy Canada Ltd. or any of its representative for bodily or personal injury, property damage, death, medical expense and all other losses, which is sustained by participant arising from or associated with instruction or other activities. Participant hereby releases, indemnifies, and holds Shooting Academy Canada Ltd. harmless from any liability concerning any damage or injuries. Parents or guardian hereby agrees to indemnify and defend the representatives of Shooting Academy for any claims or lawsuit arising in connection with any minor participant(s) on whose behalf of parent(s) or guardian(s) has executive this release.
SECTION 5: PUBLICITY.
Participants hereby grant permission to SHOOTING ACADEMY CANADA Ltd. to publish any photographs or videos while partaking in any activities, and agreed that participant(s) is/are not due for any payment or compensations from Shooting Academy for publishing it on our (photo-gallery) website, but not to sell it to any third party.
SECTION 6: EXPIRY.
I have read all pertinent information regarding the purchases of present and future specials, programs, memberships, and packages. I am aware of their expiration dates, either verbally, on the website, and/or on the price lists posted at the range. I acknowledge and agree that there are no refunds to any specials, programs, memberships, and packages. Special consideration such as illness, and other unforeseen circumstances may be given on a case to case basis. Memberships, packages, and programs are not permitted to be used by any other person than the original purchaser. We have the right to refuse without any compensation time or monetary value due to participant negligence, or disrespect towards range rules including waiver violations and range representatives of Shooting Academy Canada Ltd. and its members/participants. All new equipment such as bows have 30 days exchange program. Items damaged due to carelessness, dry fire or damaged bows, arrows & other used equipment will have absolutely no warranty. Repaired bows and strings/cables will have only 10 days warranty from the day of its pickup, unless customer tests & uses their bow at our range prior to leaving, which will void its warranty.
