LIABILITY WAIVER

As legal guardian of my designated student(s) (student(s)), I hereby consent to all student(s) participating in this facility's program(s). I recognize that potentially severe injuries can occur in any activity involving height or motion, including tumbling and related activities including cheerleading, tumble tramp, trampoline, stunting, pyramids, dance, swimming, martial arts, gymnastics and physical activity in general. I understand that it is the express intent of all staff and personnel to provide for the safety and protection of my student(s) and, in consideration for allowing my student(s) to use these facilities, I hereby COVENANT NOT TO SUE and FOREVER RELEASE this facility, affiliated and partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, coaches, owners, directors and other members involved in this facility's program(s), from all liability and for any and all damages and injuries suffered by my student(s) during any and all classes, lessons, camps, birthday parties, competitions, open workouts or extra activities.

*Photo Release: I hereby grant Aerials Gymnastics and their agents the absolute right and permission to use photographic portraits, pictures, digital images or videotapes of My Child, or in which My Child may be included in whole or part, or reproductions thereof in color or otherwise for any lawful purpose whatsoever, including but not limited to use in any social media, advertisement or website, without payment or any other consideration. I hereby waive any right that I may have to inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein My Child’s likeness appears, or the use to which it may be applied.

TUITION PAYMENT
Tuition is due by the first class of each pay period. Classes at Aerials run continuously from Sept -June and are broken down into 4 payment periods, due every 10 weeks. You are responsible for payment in full by the first class.  In sessions where your class day falls on a holiday where the gym is closed your tuition will be prorated.

MANDATORY INSURANCE FEE
Supplementary student accident insurance is required to participate at Aerials Gymnastics.  Insurance Fee of $85 per child or $125/ family is due before your child participates in their first class.  This fee is non-refundable and runs from 9/1 to 8/31 of the following year.  Discounted insurance is available for Summer only enrollments for $35 per child or $55/ family.  Please note there is a $500 deductible that you are responsible for should you choose to access this coverage.

SECURITY DEPOSIT
A refundable deposit equal to one month worth of tuition must be on file with the gym at all times in order to hold your child's place in class.  Security is collected before a new members first class or can be carried over from previous seasons.

SUMMER CANCELATION POLICY
Cancel any time with 100% refund up until June 1st.  After which we require four weeks notice to withdraw from class with a written withdrawal notice.  Withdraw any time, we will refund unused tuition with four weeks notice.

LATE PAYMENT FEE
A $25 late payment fee will be assessed to accounts with outstanding balances of more than 15 days late.  After 30 days, an additional $25 late fee will be added.  Balances overdue for 90 days will be sent to collection.

RETURNED CHECK FEE
Returned checks must be settled in cash along with a fee of $40.

WITHDRAWAL FROM CLASS
Aerials requires one month written notice to withdraw from class for any reason.  Please email your intent to withdraw to aerialsgym10@gmail.com.

ATTENDANCE
Your security deposit reserves your place in class and failure to attend any or all classes does not reduce your tuition.  We do not issue refunds or credits for missed classes.

MAKE-UPS
Make-up classes are provided as a courtesy to those who give advance notice of absence.  Make-ups can be scheduled at the front desk up to one week in advance.  If you are unable to attend your make-up class please call to cancel or reschedule.  Failure to do so will result in loss of that make-up class.  All make-ups must be completed in the session they are missed and do not roll over to future sessions.

SAFETY
Safety First, Safety Always!!
• Gymnasts must stay at a safe distant behind the performing gymnast
• Gymnast must only perform the skills and techniques as instructed and/or supervised by their coach
• Gymnasts must be aware of their surroundings during class, i.e. other gymnasts, obstacles, equipment, etc.
• Gymnasts must let the coach know IMMEDIATELY if injured
• No use of equipment without an instructor present
• Students must respect their coaches and fellow gymnasts

ARRIVALS AND DEPARTURES
If dropping off please be sure that your children are safely in the building
before you leave. Students are required to remain in the gym until their parents arrive for pick up. Parents who have children in 55 min classes are required to stay in the building until the class is over.

GYM ETIQUETTE
Boys or Girls may wear tucked in T-shirts and shorts OR Leotards for Girls. NO chewing gum or dangling jewelry. Hair should be pulled neatly and securely away from the face so that is stays up for the entire workout. Girls should not wear bows or other large hair ornaments that may cause discomfort during activity. Personal items should be left in cubby holes. Jewelry should not be worn during classes. PLEASE LEAVE JEWELRY ARTICLES AT HOME. This facility's staff will not be responsible for ANY items that may be lost or stolen. Be sure your student's personal items are marked with their name.

No Food, Drinks or Cell Phones Allowed on the Gym Floor.

BILLING AUTHORIZATION

I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.

I hereby authorize this facility to charge my ACH draft, or credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
