THIS IS A RELEASE OF LIABILITY, A HOLD HARMLESS AGREEMENT AND AN EXPRESS ASSUMPTION OF RISK
The Tahoe Trampers is a voluntary recreational hiking and social group. In consideration for my participation in activities led, hosted and/or sponsored by Tahoe Trampers, including but not limited to: Tahoe Trampers led walks and hikes in forested, mountainous, remote and backcountry areas, rafting, kayaking, biking, camping, backpacking and social gatherings, and all other related activities (collectively, the “Activity”) that are led, hosted by and/or sponsored by, or with the assistance of Tahoe Trampers and/or the officers, directors, employees, affiliates, agents, contractors, and other persons associated therewith, I / WE HEREBY INTEND TO AND VOLUNTARILY AGREE TO THE FOLLOWING:
RELEASE AND ASSUMPTION OF RISKS: I / We are aware and understand that during the activity that I / we are participating in under the arrangement of Tahoe Trampers, certain risks and dangers exist that are foreseen and unforeseen, which are inherent in each activity, including, but not limited to:
• Travel by automobile or other conveyance and vehicular travel in mountainous terrain,
• Forces of nature,
• Walking or hiking on uneven surfaces and treacherous terrain,
• Harmful animal wildlife,
• Property damage,
• Accident,
• Injury, illness, paralysis or death
• And all of such occurring in remote places without rapid means of evacuation or medical facilities.
I / We understand further that property damage, accident, injury, illness, paralysis or death can occur by natural causes, or by my actions or omission, or other persons’, by animal, by other Trampers members, and by any combination of these and that I / we must exercise extra care for my own person and for others around me in the face of these risks.
I / We also understand that Tahoe Trampers makes no representations or warranties regarding the qualifications, practices, training or abilities of any leader, officer or other member.
I / We acknowledge that Tahoe Trampers has not tried to minimize or contradict my understanding of the risks and injuries and damages.
In consideration of, and as part payment for, the right to participate in such activity, and services arranged for me by Tahoe Trampers, its members, hike leaders, officers, directors, trustees, agents and associates, I have full knowledge of and do hereby assume all of the above risks and will hold them harmless from any and all responsibility, negligence, actions or suits of any kind or nature whatsoever, even if caused by negligence by me, Tahoe Trampers’ members, hike leaders, officers, board members, trustees, agents and associates (or any of them) for loss or damage to property or personal injuries and death sustained or occurring during any of the Activity or activity of any related nature.
This shall serve as release and assumption of risk for myself, my heirs, administrators, executors, and for all members of my family including minors who may be accompanying me.
I / We agree that if I sue or make any claims against Tahoe Trampers, in violation of this release and waiver, I shall be liable to Tahoe Trampers for all costs and attorneys' fees incurred by Tahoe Trampers in defending itself from such action or claim.
I / WE FURTHER AGREE TO HOLD HARMLESS, INDEMNIFY AND DEFEND Tahoe Trampers against all claims, causes of action, damages, judgments, cost and/or expense, including attorney’s fees and other costs, which may in any way arise from my participation in the Activity and activity of any related nature, or my use of, or presence at, any property or facility used by Tahoe Trampers .
I / WE FURTHER REPRESENT AND WARRANT that I am currently able to participate in the Activity, which I have evaluated to my satisfaction and chosen to participate in. I further represent and warrant that I have read and will observe, or will read and observe before engaging in any Trampers Activity, the Policies, Duties and Responsibilities of the Tahoe Trampers for safety and enjoyment (available on the Tahoe Trampers website: www.tahoe trampers.com).
I / WE AGREE that the venue for any legal or equitable claim that may arise from my participation in the Activity shall be governed by the laws of the State of Nevada, County of Washoe. This agreement is intended to be as broad and inclusive as permitted by law. If any part of this agreement is held to be invalid or unenforceable for any reason, the remainder of this agreement shall not be affected and shall remain valid and fully enforceable.
Participants under the age of 18 years are required to have a parent or legal guardian read and sign this Agreement.
I / WE HAVE READ AND UNDERSTAND THIS RELEASE OF LIABILITY AND WAIVER OF CLAIMS AND I / WE UNDERSTAND THAT BY SIGNING THIS DOCUMENT I / WE ARE VOLUNTARILY WAIVING CERTAIN LEGAL RIGHTS AND AGREEING TO INDEMNIFY AND HOLD HARMLESS TAHOE TRAMPERS. This waiver shall be interpreted in accordance with the laws of the State of Nevada:
