Providing Proper Notice in Quebec
As a tenant, you must respect your lease until it ends (Termination Date), except in very specific situations. Unlike Ontario, Quebec leases renew for a full year and do NOT continue month to month after the 1st year.
Unless an agreement is made between the owner and the tenant a lease termination request may only be submitted 3 to 6 months prior to your Termination Date. Requests submitted outside this window may not be granted.
Each year, 3 to 6 months before the termination date of your lease Peartree will send out a rental increase notice. Once you receive this notice you have one month from the date of reception to respond. You may respond in one of 3 ways:
- Accept the increase
- Decline the increase
- Request that the rent be fixed by the Regie du Logement
OPTION 1:
If you choose option 1 you don't need to do anything more. Your lease will renew automatically the day after the Termination date for one full year.
OPTION 2:
If you choose option 2 you or the owner may try to negotiate a new rental increase or accept your request for termination. You will then need to complete this form.
OPTION 3:
If you wish to stay and are unable to negotiate a rent increase between you and the owner you can request that the Regie du lodgement fix the rent increase.
Regardless of which option you choose, other than option 1, you must respond within 1 month of receiving your increase notification or your lease will automatically renew for a whole year at the new rental rate.
If you want to leave your rental unit at the end of the lease, you must let your landlord know between three and six months before the lease ends if the lease is for one year or longer.
Showings of Unit
You are required to let possible tenants visit your unit starting as soon as you give notice. Peartree's leasing agents try to provide a minimum of 24-hour notice when possible. You are not allowed to refuse showings to the unit however we will try to work with you as much as possible.
Resilliation of Lease Without Proper Notice
If you need to resilliate your lease prior to your lease termination date, Peartree will work with you and the landlord to reach an agreement.
If you and the landlord cannot reach an acceptable agreement, a tenant can also assign or sublet their lease. All sublets or assignments are subject to Peartree's approval. Please call our office if you wish to find out more about the sublet or assignment process.
