PAGOSA LAKES PROPERTY OWNERS ASSOCIATION Rental Aggreement

• Completion of the request form should be noted as a preliminary step and does not constitute a definitive reservation. Each request is subject to thorough review, during which we will assess the availability of the requested space and determine its compatibility with your intended rental purposes, as well as your current membership status in relation to the established usage guidelines.

• The Pagosa Lakes Clubhouse is made available for rental exclusively to Pagosa Lakes members who are currently in good standing. To secure a reservation, prospective renters are obligated to furnish a damage/cleaning deposit, a fully completed user agreement packet, and proof of adequate insurance coverage.

• Please be advised that the Clubhouse cannot be leased for public events, with the exception of a limited few. The permissible exceptions to this policy encompass occasions such as funeral services and non-profit events which require ticketing or fundraising.

• I agree that neither I nor any other person attending the function described herein will sell any alcoholic beverages on Pagosa Lakes Property Owners Association premises. I further agree that no admission or other charges will be collected if alcoholic beverages will be available, and I agree that I will not seek any donations to cover the costs of the alcohol, food, or other beverages being served. I understand that if alcoholic beverages are served or consumed on the premises that:
  1. I will personally indemnify and hold Pagosa Lakes Property Owners Association harmless from any and all losses, liability, damages, and expenses (including attorney’s fees) resulting from any injury or damage in any way associated with the use of clubhouse premises and with the consumption of any alcoholic beverages on those premises; and
  2. I will personally assume responsibility for compliance with the Colorado drinking age law.

Selling of alcoholic beverages is only allowed at an advertised public event, and I will obtain a Special Events Permit from the County Commissioners office

• I hereby, for myself and my guests, waive and release any and all claims for damages alleged due to negligence or for any reason, which I or my guests may have against the Pagosa Lakes Property Owners Association, its Directors and all employees, representatives, successors and assigns for any and all injuries suffered by myself or my guest.

Clubhouse hours are 8:00am – Midnight only.

• I understand that the key is to be returned the following workday after use (Monday if used on the weekend) or a charge of $5 per day will be deducted from the deposit.
