  • Wear a wet-suit (or wet suit bottom) while operating the PWC. Normal swimwear does not adequately protect against forceful water entry into the lower body opening(s) of both male and females. Severe internal injuries can occur if water is forced into body cavities as a result of falling into water or being near jet thrust nozzle.• Additional protective equipment (such as footwear, eyewear) may be needed.

  • Securely attach engine shut-off cord (lanyard) to your wrist or PFD (as directed) and wear it at all times. Then if you fall off the PWC, the engine will stop.

  • Know How to Start and Stop the Engine

  • • To start the engine, be sure that the lanyard is attached and push the start button.

    • To stop the engine, push the stop button. Stopping the engine will not stop the forward motion of the PWC and result in loss of steering.

  • • The throttle controls your speed. Apply the throttle lever on the handle to accelerate and release it to slow down.

    • The handlebars move the jet thrust nozzle directing thrust in different directions to steer the PWC. Without thrust you cannot steer the PWC.

    • Scan constantly for people, objects and other boats (including PWCs).
    • Be alert for conditions that limit your visibility or block your vision of others
  • Operate Defensively

    • Operate at safe speeds. Keep a safe distance away from people, objects and other boats (includingPWCs).
    • Do not follow directly behind PWCs or other boats. Do not go near others to spray or splash them with water.
    • Avoid sharp tums and other maneuvers that make it difficult for others to avoid colliding with you or that make it difficult for others to understand where you are going.
  • Avoid Aggressive Maneuvers

    • This is a high-performance boat—it is not a toy.
    • Ride within your limits and avoid aggressive maneuvers to reduce the risk of loss of control, ejection, and collision.
    • Sharp tums or jumping wakes or waves can increase the risk of injury (paralysis), facial injuries, and broken legs, ankles, or other bones.
    • Do not jump wakes or waves.
  • DO NOT APPLY THROTTLE WHEN ANYONE IS NEAR THE REAR OF THE PWC

    • Items such as long hair, loose clothing, or PFD straps can become entangled in moving parts resulting in severe injury or drowning.
    • Do not apply the throttle when anyone is standing or swimming toward the rear of the PWC. Water and/or debris exiting jet thrust nozzle can cause serious injury.
  • Know How to Right the PWC in Open Water

    • If you capsize in open water, swim to the rear of the PWC and turn it upright — be sure to turn it in the proper direction. Then board it from the rear
  • Follow Rental Agency Rules and Boating Laws

    • Review all rental agency rules and applicable boating laws.
    • Do not overload PWC. Do not tow unless the PWC is designed and equipped for towing. Know and follow all State requirements related to towing.

    • Know the area in which you will be operating and observe all navigational markers and signs.

  • Final Check

    • Do you understand that you should scan constantly, operate defensively and avoid aggressive maneuvers?
    • Do you understand that PWCs do not have brakes?
    • Do you understand that you should release the throttle when you are trying to steer away from people, objects, other boats (including PWCs)?
    • Do you have any question about the PWC or its operation?

    AS A CONDITION OF COVERAGE, APPLICANT(S) AGREES TO ADHERE TO THE FOLLOWING PROCEDURES:

  • Personal Watercraft Rental Agreement

  • In consideration of the agreement herein, ALL ISLAND WATERSPORTS, INC. OR ADVENTURE WATER SPORTS, INC. (hereinafter referred to as the LESSOR) agrees to lease to the undersigned (hereinafter referred to as the LESSEE) a Personal Watercraft(PWC)
    In the event, the craft is not returned at the time specified said LESSEE agrees to pay for OVERTIME at a rate of $75.00 per each half-hour.

    THE LESSEE CERTIFIES THAT HE/SHE WILL EXAMINE THE CRAFT AND EQUIPMENT AND FIND IT ACCEPTABLE AND SUITABLE FOR THE PURPOSE FOR WHICH IT IS LEASED. THAT HE/SHE WILL OPERATE THE CRAFT IN ACCORDANCE WITH ALL SAFETY RULES AND REGULATIONS IN THE PWC ORIENTATION CHECKLIST, PARTICIPANT SAFETY BRIEFING ACCEPTANCE OR ON THE CRAFT, AND FURTHER CERTIFIES THAT HE/SHE HAS READ AND UNDERSTANDS SAID RULES AND REGULATIONS.

    LESSEE AGREES TO REPORT ANY ACCIDENT, MALFUNCTION OR BREAKDOWN OF RENTAL CRAFT TO LESSOR IMMEDIATELY.

    This certifies that I (We), the LESSEE (S) am/are experienced and capable in all aspects of the handling and operation of the craft, such as the one rented today. LESSEE agrees said craft will not be occupied by a greater number of persons that is shown in this rental agreement. l, the LESSEE (S) am/are aware of the NO WAKE areas and am/are responsible for any damaged caused by my wake. l, the LESSEE (S) will operate that said craft within the boundaries established by ALL ISLAND WATERSPORTS, INC.:

    I authorize and allow ALL ISLAND WATERSPORTS, INC. OR ADVENTURE WATER SPORTS, INC> to charge my credit card for any damages or loss of equipment.

    The LESSEE acknowledges he/she has carefully examined the craft and finds it suitable for the purpose for which it is leased, and that or other accessory equipment is in suitable and acceptable condition: that he/she will maintain both craft and equipment in a safe, dependable condition while in he/she has custody.

    A major credit card authorization (VISA, MasterCard, Discover, American Express or Debit) or CASH in the amount of five hundred dollars ($500.00) shall be retained by the LESSOR as partial compensation for failing to return said rental craft in as good condition, ordinary wear and tear excluded, as when received; for reimbursement of articles damaged, missing or broken; or to be applied to the rental charges upon return of craft by LESSEE.

    LESSEE acknowledges his/her responsibility for the safe and proper operation of the craft; and for the safety and welfare of other boaters, persons, and passengers. It is AGREED AND UNDERSTOOD BY LESSEE that the LESSOR shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of the rental craft. LESSEE FURTHER AGREES to indemnify and hold harmless the LESSOR and its agents, affiliates and personnel from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said rental craft. LESSEE further agrees to hold ALL ISLAND WATERSPORTS, INC.harmless should loss or damages occur to any LESSEE'S personal property while carried in, or on, the rental craft, including loss or damage by fire, water, theft or any other causes whatsoever.

    LESSEE expressly agrees to indemnify and hold LESSOR and its agents, affiliates and personnel, harmless of, from and against any and all loss, cost, damages, attorney fee and/or liability in connection with the enforcing of the forgoing rental contract by LESSOR, including expense incurred in connection with attempting to collect delinquent rent and in the event of suit by LESSOR, to recover possession of said rental property and/or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that Venue and any action hereunder shall be in the county of LESSOR.

    In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental craft the LESSEE will immediately report it to LESSOR. Continued use of it shall entirely at the LESSEE'S risk and thus LESSEE assumes all liability of injury and damage to all persons and property that may become involved by its continued use.

    LESSOR'S ability to provide a rental craft if reserved, is contingent upon and subject to the return of the unit by the previous lessee, or any other cause beyond LESSOR'S control.

    LESSOR reserves the right to cancel this rental agreement due to inclement or impending bad weather. Rental fees will be prorated based on time used.

    The rules and regulations contained herein and as posted in the office, on the craft and /or the grounds by the LESSOR are for the safety and welfare of all who use the facilities. The LESSEE certifies that he/she has read and understands said rules and regulations and further assumes the responsibility that his/her family and or guest(s) will obey the rules.

    Should any term or condition of Rental Agreement be held void or unenforceable, then that term shall be deemed severed from this Agreement and the unenforceable, then that term shall be deemed severed from this Agreement and the enforceability and the remainder shall not be affected and will remain in full force and effect.

    THE TERMS AND CONDITIONS OF THIS CONTRACT CONTAINS THE ENTIRE
    UNDERSTANDING BETWEEN LESSEE AND LESSOR AND NO OTHER REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN, HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT. I (WE) HAVE READ ALL PAGES OF THE AGREEMENT AND FULLY UNDERSTAND THE TERMS AND CONDITIONS AS SET FORTH; THAT (WE) ACKNOWLEDGE RECEIPT OF A COPY OF THIS AGREEMENT BY EMAIL.

     

     

  • LIABILITY WAIVER AND RELEASE I UNDERSTAND THAT THERE ARE INHERIT RISKS INVOLVED WITH JET SKI, BOATING & WATER SPORTS RECREATIONAL ACTIVITIES, including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions, and I HEREBY ASSUME SUCH RISKS.

    I UNDERSTAND THAT I HAVE A DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO.
  •  Florida Disclaimer - This Waiver and Release Agreement is applicable to all renters, operators, passengers, and users of equipment provided by ALL
    ISLAND WATERSPORTS, Inc. OR ADVENTURE WATER SPORTS, INC.*(For purposes of this Waiver and Release, the terms "ALL ISLAND WATERSPORTS, Inc. and ADVENTURE WATER SPORTS, Inc." includes all principles, directors, officers, employees, agents, representatives, servants, assigns, successors, insurers and subsidiaries of ALL ISLAND WATERSPORTS, Inc. and ADVENTURE WATER SPORTS, Inc.  (ALL ISLAND WATERSPORTS, Inc. is abbreviated "AIWS") and (ADVENTURE WATER SPORTS, Inc is abbreviated "AWS"). If any other rental agreement is supplemented with this Release, the provisions of this Release will prevail over any clauses in the rental agreement that are inconsistent with this Release.

     

    I assert that I am physically fit to ride on a Jet Ski and/or participate in Water Sports Recreational Activities, and/or Ride on a Boat and I will not hold AIWS and AWS responsible if I am injured as a result of ANY problems (medical, accidental, or otherwise) which occur while chartering the equipment or otherwise participating in the trip.

    I fully understand that AIWS and AWS has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.

    AIWS and AWS, have made no representations to me, implied or otherwise, that they or their Employees can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold AIWS and AWS, or their Employees responsible for their actions in attempting the performance or rescue of first aid.

    I agree to forever discharge and release AIWS and AWS from any and all responsibility or liability for any and all injuries to myself, to others and damages to the property belonging to AIWS and AWS.

    I agree NOT to make a claim against or sue AIWS and AWS for injuries. I further specifically agree, on behalf of myself, and my heirs, to indemnify and hold harmless AIWS and AWS for any and all causes of action arising as a consequence of any incidents which might occur during my participation in any activities with or involving AIWS and AWS.

    NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

    READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF ALL ISLAND WATERSPORTS, INC AND ANY CREW MEMBERS OR CAPTAINS ASSOCIATED USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED.

    BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM ALL ISLAND WATERSPORTS, INC. IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND ALL ISLAND WATERSPORTS, INC. or ADVENTURE WATER SPORTS, Inc. HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM

     

    NATURAL GUARDIANS as defined in Florida Statutes 744.301 is: The parents jointly are the natural guardians of their own children and of their adopted children, during minority. If one parent dies, the surviving parent remains the sole natural guardian even if he or she remarries. If the marriage between the parents is dissolved, the natural guardianship belongs to the parent to whom sole parental responsibility has been granted, or if the parents have been granted shared parental responsibility, both continue as natural guardians. If the marriage is dissolved and neither parent is given parental responsibility for the child, neither may act as natural guardian of the child. The mother of a child born out of wedlock is the natural guardian of the child and is entitled to primary residential care and custody of the child unless the court enters an order stating otherwise.

  • BANANA BOAT RIDES BY REBEL WATER SPORTS

  • RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND WAIVER OF JURY TRIAL WITH MANDATORY NON-BINDING MEDIATION AND BINDING ARBITRATION

    As a condition to participating in the banana boat activities offered by Rebel Water Sports, I am being asked to carefully read each of the following paragraphs and accept the conditions set forth therein.
  • ASSUMPTION OF RISK:  I am aware that engaging in banana boat activities ("Activity") involves inherent risks, including, but not limited, to possible physical injuries such as pulled muscles, sprangs, broken bones, contusions, concussions, heart attack, heat exhaustion, and potentially loss of life.  Notwithstanding my specific acknowledgement of the inherent risk of this Activity, I choose to voluntarily participate in this Activity with the full knowledge that this Activity may be hazardous to me and potentially any personal property that I have.

                  I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISK OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY ME AS A RESULT OF PARTICIPATION IN SAID ACTIVITY.  I UNDERSTAND THAT THE OPERATOR, REBEL WATER SPORTS, HAS TAKEN CARE TO AVOID SUCH INJURIES,  THE VERY NATURE OF SUCH ACTIVITY THOSE INJURIES CANNOT BE ELIMINATED.

                  I HEREBY CERTIFY THAT I AM AT LEAST 18 YEARS OF AGE AND LEGALLY COMPETENT TO SIGN THIS RELEASE FORM.  FURTHER, IF IA M UNDER THE AGE OF 18 YEARS OF AGE, I HAVE HAD MY LEGAL PARENT OR GUARDIAN SIGN THIS AGREEMENT ALONG WITH MYSELF.

                  I FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS REBEL WATER SPORTS AND ALL ISLAND WATERSPORTS, INC. TOGETHER WITH EACH ENTITY'S OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS FROM ANY LOSS, LIABILITY, JUDGEMENTS, SETTLEMENT FOR DAMAGES, INCLUDING COURT COSTS, AND ATTORNEY FEES, THAT MAY OCCUR AS A RESULT OF OR IN ANY WAY RELATING TO PARTICIPATION IN SAID ACTIVITY.  WHETHER CAUSED BY REBEL WATER SPORTS, ALL ISLAND WATERSPORTS, INC., THEIR RESPECTIVE OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES NEGLIGENCE OR OTHERWISE.

                 I FURTHER WAIVE A TRIAL BY JURY AND STIPULATE TO MEDIATION AND ARBITRATION.  IN ADDITION, I ACKNOWLEDGE THAT BY EXECUTING THIS AGREEMENT THAT I NOT ONLY WAIVE MY JURY TRIAL RIGHTS, BUT I WAIVE PROCEEDINGS IN A COURT OF COMPETENT JURISDICTION IN FLORIDA AND STIPULATE THAT ANY AND ALL DISPUTES ARISING OUT OF THIS AGREEMENT OF WHATEVER NATURE SHALL BE RESOLVED BY A TWO (2) STEP ALTERNATE DISPUTE RESOLUTION PROCEDURE, CONSISTING OF NON-BINDING MEDIATION IN ACCORDANCE WITH FLORIDA STATUTE §44.1011 et seq CONDUCTED BY A CERTIFIED FLORIDA CIRCUIT COURT MEDIATOR WHO IS QUALIFIED UNDER THE RULES OF THE FLORIDA SUPREME COURT.  IN THE EVENT THAT NON-BINDING MEDIATION IS UNSUCCESFUL IN RESOLVING DISPUTES, THE IN SUCH EVENT I FURTHER STIPULATE AND SUBMIT THAT ALL SUCH DISPUTES SHALL BE RESOLVED BY BINDING ARBITRATION PURSUANT TO FLORIDA STATUTE §44.1011 et seq CONDUCTED BY AN AUTHORIZED FLORIDA ARBITRATOR WHO HAS FULFILLED THE REQUIREMENTS OF THE FLORIDA RULES FOR COURT APPOINTED ARBITRATIONS QUALIFIED UNDER THE RULES OF THE FLORIDA SUPREME COURT.

                I HEREBY REPRESENT THAT I HAVE READ THIS RELEASE FORM IN ITS ENTIRETY AND UNDERSTAND ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN AND I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING THIS DOCUMENT.

               I AM SIGNING THIS DOCUMENT VOLUNTARILY OF MY OWN FREE ACT AND THAT NO REPRESENTATIONS OR STATEMENTS OTHERWISE OR INDUCEMENTS APART FROM THIS RELEASE HAVE BEEN MADE
