SECTION
Nondisclosure and Noncompetition.

(a) At all times while this agreement is in force and after its expiration or termination, __________________________ agrees to refrain from disclosing Essential Foundations customer lists, trade secrets, or other confidential material. _____________________________ agrees to take reasonable security measures to prevent accidental

(b) While this agreement is in force, the employee agrees to use his/her best efforts to fulfill and to abide by the nondisclosure and noncompetition terms of this agreement; the employer agrees to compensate the employee as follows: bi-weekly at the rate agreed upon by management when/if the terms are completed by employee. After expiration or termination of this agreement, _______________________________________ agrees not to compete with Essential Foundations for a period of 2 years within a 50 (fifty) mile radius Essential Foundations of Bowie, Maryland. This prohibition will not apply if this agreement is terminated because Essential Foundations violated the terms of this agreement.

Competition means owning or working for a business of the following type: tutoring, mentoring, or academic enrichment.

I agree that the Essential Foundations Tutoring, have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose consistent with Essential Foundations Tutoring, missions. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the Internet.
