• In the event Bright Lotus Photography is not able to provide services on your scheduled date and time due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness or emergency, your session will be rescheduled or your session fees refunded. This would only be, if absolutely necessary and is not expected to be a possibility.
• If Bright Lotus Photography cannot perform this contract due to fire or other casualty, strike, act of God or other cause beyond the control of the parties, or due to the Photographer’s illness or emergency, and the retainer fee is refunded to the client, Bright Lotus Photography shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event Bright Lotus Photography fails to perform for any other reason, Bright Lotus Photography shall not be liable for any amount in excess of all monies paid.
• Indemnification: The Photographer is not responsible for any and all injuries inflicted upon any participating parties. Client(s) will be responsible for all of their children and for themselves and release photographer from any claims against their person or their business during the course of the photography session and while on the premises of the photographer's studio.
• Attorney’s Fees: If either party to this Contract brings a legal action against the other party to this Contract to secure the specific performance of this Contract, collect damages for breach of this Contract, or otherwise enforce or interpret this Contract, the prevailing party shall recover reasonable attorney’s fees and all costs, premiums for bonds, fees, and other expenses expended or incurred in the action in addition to any other relief that may be awarded.
• Responsibility: Upon receipt of photos, Client accepts all responsibility for archiving and protecting the photographs. Bright Lotus Photography is not responsible for permanently archiving image files and does not guarantee the lifespan of any digital media or printed material provided.
• Refunds: With the completion of the shooting portion and delivery of the promised number of final edited images, all sales are final and there will be no refunds of the session fee for any reason.
• If the client purchases the digital download of images, Bright Lotus Photography will provide detailed printing instructions. To ensure the best print quality, avoid altering the images before printing. The photographer is not responsible for printing errors or for quality of prints or products printed elsewhere.
• Additional images may be purchased individually for $25 each or complete gallery for $300 extra.
• Bright Lotus Photography does not give out RAW, unedited files. Your edited photos will be delivered via private online gallery in 3 weeks.
