AGREEMENT
Brigham Young University ("BYU") hereby grants you ("Student/Faculty/Staff or Administrative Employee") permission to use and display the material ("Photograph") described below according to the terms and conditions stated herein. All rights not expressly granted in this Agreement are reserved to BYU. This approved use is on a quitclaim basis, without representations or warranties of any kind whatsoever by BYU, express or implied. BYU expressly reserves the right to revoke this permission for any reason, for no reason at all, and in its sole discretion upon notice to Student.
RESTRICTIONS:
- You may use and/or display the Photograph only as a part of or in connection with your personal portfolio or dossier. No other permission is granted herein.
- You agree not to alter the Photograph without express written permission from BYU.
- You agree not to use the Photograph in a manner that is derogatory to BYU.
- You acknowledge that the copyright in the Photograph belongs to BYU. You shall take all reasonable precautions to protect the copyright in the Photograph in conformity with the United States Copyright Act and other applicable statutes, regulations, treaties, or conventions, hereinafter enacted or enabled. The following copyright/credit line must appear with each copy of the Photograph.

BYU will not be held responsible for any direct, indirect, or consequential, incidental or punitive damages or any damages whatsoever arising out of or relating to your use or misuse of the Photograph. Accordingly, you agree to indemnify, defend and hold BYU, its parent, affiliates and officers, employees, agents, successors, and assigns, harmless, from and against any and all claims, suits, judgments, obligations, damages, losses, or other liability including attorney’s fees and other costs, fees, and expenses, suffered or incurred by, or asserted or alleged against BYU arising out of your use of the Photograph or a breach of any provision of this Agreement.
The terms of this Agreement may not be modified or amended, except in writing signed by the party to be charged. This Agreement and all matters relating to it shall be governed by the laws of the State of Utah. Any dispute arising hereunder shall be resolved in the courts of the State of Utah, and the parties consent to the personal jurisdiction of those courts, provided, however, that the parties hereto agree that they will make concerted efforts to settle any dispute between them in an amicable manner without the necessity of litigation.
