Terms and Conditions

MINI SESSION FEE: The mini session fee includes 30 minutes of the photographer's time and talent at the location of photographer's choice, and retouching of your final images. Full payment of the session fee is due at the time of booking and guarantees your appointment time. Please submit the session fee payment along with these forms as soon as possible. Session fees are non-refundable. *

LOCATION: Location of mini sessions will be determined by the photographer. *

Client agrees that photographs may not be edited, changed, and/or cropped in any way by themselves or any other party (friends, family, other photographers etc.) outside of JB Photography. *

LIABILITY: Participant agrees to hold Happy Hooves Equine Rescue and JB Photography and all successors, assigns, subsidiaries, franchisees, affiliates, officers, directors, employees, and agents completely harmless and not liable and releases them from all liability whatsoever and Agrees not to sue them on account of or in connection with any claims, causes of actions,injuries, damages, costs or expenses arising out of Participants use of or presence of Equine Professional's property and facilities, including without limitation, those based on death, bodily injury, property damage, including consequential damages, except if damages are caused by the direct, willful and wanton gross negligence of the Equine Professional. *

PAYMENT: JB Photography shall reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. For this reason, in the event that the client cancels the contract (session) for any reason, all monies paid shall be retained by JB Photography in order to offset its loss of business. *

INCLEMENT WEATHER: If inclement weather or other adverse conditions prevent the session from meeting the photographer's artistic standards she may elect to reschedule. RAIN DATE WILL BE THE DATE AFTER unless weather doesn't permit. *

FAILURE TO PERFORM: If the photographer cannot perform due to illness or emergency, the session will be rescheduled. If a reschedule cannot be obtained client will get a gift certificate to use for a future session. The photographer will have no further liability to the contract. This limitation on liability also applies in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. *

EXCLUSIVE PHOTOGRAPHER: Only bring those people being photographed for the session. There is no other photography allowed from family and friends during the portrait session. *

COPYRIGHTS: the photographs produced by JB Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without JB Photography explicitly written permission. *

DIGITAL FILES: The CLIENT understands JB Photography still owns the copyright to all photos that are placed on disk or digital download. The photos must not be edited, cropped or change in any way without written permission from JB Photography. Photos are to be used for personal use only. The CLIENT accepts all responsibility for archiving and protecting the photographs. Replacement DVDs may be purchased at the current list price if needed. JB Photography is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is the CLIENT'S responsibility to make sure that digital files are copied to new media as required. *

MODEL RELEASE: I hereby give JB Photography the irrevocable right to use my picture, portrait, or photograph in all forms and in all media and in all manners, without any restriction as to changes or alterations for advertising, trade, promotion, exhibition, or any other lawful purposes, and I waive any right to inspect or approve the photograph(s) or finished version(s) incorporating the photograph(s), including written copy that may be created and appear in connection there with. *

Digital Download and Disk Terms and Conditions

Client understand that no unauthorized internet postings are allowed without photographer’s permission. *

Client agrees not to enter photographs into contests or publish them in any media sources without photographer’s permission. *

Client agrees that pictures will only be used for printing purposes and social media only and not used commercially. *

Mini Session Details

Thank you for participating in JB Photography’s mini session! This is an outline on what you can expect at your session!

During Your session
-Today you will receive 30 minutes of photography time.

After Your Session
-You will be able to view your photos within 3 weeks at: www.johnnabowker.smugmug.com

-After your session, you will have two weeks from your session date to inform me which photo you will like to choose. If I do not have your choice by this time you will forfeit your photos.

-If you wish to order extra prints or digital files you may do so. All orders must be made within one month of your session. At this time your gallery will close and if you wish to reopen your gallery there will be a $20 fee. Payment for any print orders must be paid in advance.

By signing you understand and agree to all terms and conditions set forth by JB Photography.
