I hereby represent and certify that I am at least 21 years of age and that I possess a valid driver's license issued by the state of Texas that authorizes me to operate the specific type of vehicle that I intend to test drive. I understand that the improper operation or use of this vehicle, motorcycle or scooter, such as failure to observe and obey all laws and safety rules, may pose a risk of serious injury to the operator and or other persons or vehicles. Although I am aware of the possible risks incident to operating such vehicle, motorcycle or scooter, I wish to take a test drive. I desire to test drive a vehicle, motorcycle or scooter at AF1 Racing to decide whether or not I wish to make a purchase. I AM VOLUNTARILY REQUESTING A DEMONSTRATION RIDE AND I EXPRESSLY AGREE TO ASSUME THE ENTIRE RISK OF ANY AND ALL ACCIDENTS OR PERSONAL INJURY, INCLUDING DEATH, WHETHER DUE TO AF1 Racing's NEGLEGENCE OR NOT. I participate in the ride knowing the existing weather conditions, terrain conditions, and other conditions and factors which might affect this ride are outside the control of AF1 Racing. For and in consideration of the opportunity to engage in a free demonstration ride of a vehicle, motorcycle or scooter, on behalf of myself, heirs, personal relatives, successors and assigned, I give the following releases and hold AF1 Racing harmless from any liability to myself or my heirs.
I DO HEREBY AGREE TO RELEASE FROM LIABILITY AND AGREE NOT TO SUE AF1 RACING INC., the manufacturer of the vehicle, motorcycle or scooter, and each and all of their related companies, officers, directors, and employees, for injury, damages or death which occurs during, or as a result of my test ride. I forever release and discharge the dealer named below, the manufacturer of the vehicle, motorcycle or scooter and each and all of their related companies, officers, directors, and employees, from any and all claims, demands, causes of action or liability of any kind whatsoever, which I may now or in the future have, known or unknown, which in any way result from or arise out of or during course of my demonstration ride whether arising from the NEGLIGENCE of those persons released herein, or my own negligence.
This Release and Waiver of Liability Agreement extends to any and all claims I may have with respect to the NEGLIGENT design, manufacture, repair, or maintenance of the vehicle, motorcycle or scooter which I will be riding, or with respect to NEGLIGENT conditions, qualifications, instructions, rules or procedures under which the demonstration ride is conducted.
Customer hereby agrees to the following:
- Customer shall only drive the Vehicle within 20 (number of miles) miles of the store location and must return the vehicle within 20 (number of minutes) minutes.
- Customer, and Customer's primary vehicle Insurance, shall be responsible for any and all liabilities (civil, criminal or otherwise) incurred while driving the Vehicle, Motorcycle or Scooter.
- Customer shall not use the Vehicle for any purpose deemed illicit or illegal, or for any purpose which is otherwise in violation of federal, state or local laws.
This Agreement shall in no way imply the transfer of ownership of the Vehicle from AF1 Racing, Inc. to Customer. Failure to comply with the terms of this Agreement, including failure to return the Vehicle at or before the Test Drive End Time, may result in criminal and/or civil proceedings being brought against Customer.
I HAVE READ, UNDERSTAND, AGREES TO AND VOLUNTARILY SIGN THE RELEASE AND WAIVER OF LIABILITY AGREEMENT, AND further agree that no oral representations, statements, or inducements apart from the foregoing written agreement have been made. Any dispute regarding this Agreement will be heard in Travis County, Texas as the exclusive jurisdiction regarding this matter.
