1. Definitions
“Client/you” means the person or organisation making the booking.
“Consumer” means an individual acting mainly outside their trade, business, craft or profession.
“Event” means the hire described in your booking form.
“Full Venue Hire” means exclusive private use of the venue.
“Area Hire” means exclusive use of one or more designated seating areas while the venue remains open to the public.
“Areas” means any of: Long bench (up to 14), Smaller bench (up to 8), Small booth (up to 6).
“Minimum Spend” means the minimum amount you agree to spend, calculated using the tariff in clause 4.
“Guaranteed Headcount” means the number you confirm for charging purposes for Area Hire (and staffing/service planning).
“Weekend” means Friday, Saturday and Sunday. Public holidays are treated as Weekend unless we confirm otherwise in writing.
2. Booking request and acceptance
2.1 Submitting the form is a request only. A booking is not confirmed until we confirm by email.
2.2 We may request additional information before confirming (for example, timings, service plan, or pre-order details).
2.3 We reserve the right to refuse or cancel a booking where required for licensing, safety, capacity, or operational reasons. If we cancel after taking payment, we will refund amounts paid for services we do not supply (see clause 10).
3. Deposit (Full Venue Hire only)
3.1 A £100 deposit is required for Full Venue Hire and must be paid within 48 hours of our confirmation email to secure the date.
3.2 The deposit is credited against your final bill.
3.3 If the deposit is not paid within 48 hours, we may release the date.
4. Minimum spend tariff (no separate hire fee)
4.1 We do not charge a separate venue hire fee. Instead, your booking is subject to a Minimum Spend.
4.2 Full Venue Hire Minimum Spend
January to November, Weekdays: £600
January to November, Weekends: £900
December, Weekdays: £1200
December, Weekends: £3000
4.3 Area Hire Minimum Spend (per person, based on Guaranteed Headcount)
January to November, Weekdays: £15 per person
January to November, Weekends: £25 per person
December (all days): £35 per person
4.4 For Area Hire, you may select multiple Areas. Your Minimum Spend is calculated using the total Guaranteed Headcount across the Areas you select, multiplied by the applicable per-person rate.
4.5 If your actual spend is below the Minimum Spend, the shortfall will be charged as a venue/service fee to make up the difference.
4.6 Minimum Spend is assessed on the total bill for the Event (drinks and any agreed food or add-ons). Discounts, promotions, and Happy Hour offers do not apply unless we confirm in writing.
5. Guaranteed headcount rules (Area Hire)
5.1 For Area Hire, you must provide a Guaranteed Headcount (for charging and staffing).
5.2 You may increase your Guaranteed Headcount at any time before the Event, subject to capacity and service ability.
5.3 You may reduce your Guaranteed Headcount up to 7 days before the Event. Within 7 days, the Guaranteed Headcount cannot be reduced
5.4 If more guests arrive than your booking safely allows, we may (at our discretion) offer an additional Area, adjust the layout, or limit entry to comply with capacity and licensing.
6. Area Hire: exclusivity and public opening
6.1 Area Hire gives you exclusive use of your booked Areas with table service. Other parts of the venue remain open to the public.
6.2 We will identify your Area(s) on arrival. You may decorate within your Area(s) only (see clause 8).
6.3 We cannot guarantee the rest of the venue will be quiet, and normal venue operations, music, and public guests will be present.
7. Drinks pre-orders
7.1 If you select drinks pre-orders, we will confirm the available packages, pricing, and the deadline to finalise your order in writing.
7.2 Pre-orders may require payment in advance. Once we have ordered stock specifically for your Event, pre-orders are generally non-refundable, unless we cancel or cannot supply the agreed items (in which case we will offer substitutions or a refund for the unavailable items).
7.3 We may substitute brands or specific products where supply changes, with items of similar style and value, unless you tell us in advance that substitution is not acceptable.
8. Age, entry, licensing and welfare
8.1 Over-18s only. Challenge-25 identification checks apply.
8.2 We operate a refusal of service policy and may refuse entry or service to intoxicated or disorderly persons to comply with licensing obligations.
8.3 Water is available throughout. Tell us about allergies in advance and on arrival; we will take reasonable care, but we cannot guarantee a completely allergen-free environment.
9. Client responsibilities and damage
9.1 You are responsible for your guests’ conduct and for compliance with staff instructions and house rules.
9.2 No confetti cannons, glitter, smoke devices, naked flames, or external alcohol. Decorations must use low-tack fixings only.
9.3 You are liable for loss or damage caused by you or your guests (reasonable wear and tear excepted). We may charge reasonable cleaning, repair, or replacement costs.
10. Changes, cancellation and refunds
10.1 Your contractual cancellation policy:
Cancel 15 days or more before the Event: deposit (if paid) is forfeited; no further charge.
Cancel 8 to 14 days before: charge 50% of the Minimum Spend, less any amounts already paid.
Cancel 0 to 7 days before: charge 100% of the Minimum Spend, less any amounts already paid.
10.2 December bookings: because December is peak trading, we may apply stricter terms for specific dates. If so, we will state them clearly in our confirmation email before you pay.
10.3 If we cancel: If we must cancel due to reasons beyond our control (for example, safety, licensing, or force majeure), our liability is limited to refunding amounts you have paid for services not supplied, and we will offer alternative dates where possible.
10.4 Statutory cancellation rights (Consumers): If you are a Consumer and your booking is made online or otherwise at a distance, Guernsey Trading Standards rules may provide statutory information and cancellation rights for certain contracts. 11. Payments (including SumUp)
11.1 Card payments are processed by SumUp (or other payment providers we notify you about). We do not store full card details.
11.2 We may share booking identifiers and payment references with payment providers for taking and reconciling payments.
12. Timing and overruns
12.1 Please arrive promptly. Your hire is for the agreed times only.
12.2 Overruns are at our discretion and may incur additional charges.
13. Liability
13.1 Nothing limits liability for death or personal injury caused by negligence, or for fraud.
13.2 Subject to clause 13.1, our total liability for claims connected with the Event is limited to the total amounts paid by you to us for that Event. We are not liable for indirect or consequential loss.
14. Data Protection (Data Processing Notice)
Controller: L.P. Entertainment Limited (trading as Bad Habits).
Law: We process personal data in line with the Data Protection (Bailiwick of Guernsey) Law, 2017 and related guidance, and organisations established in Guernsey are required to register with the ODPA where applicable. guernseylegalresources.gg+1
What we collect: booking details (name, contact, date/time, Areas, headcount), preferences, allergy notes, drinks pre-order details, payment references, and any consents you provide. CCTV operates for security.
Why we use it (lawful bases): performance of a contract, legal obligations (accounting and compliance), legitimate interests (security, fraud prevention, service and complaint handling), and consent (optional marketing and identifiable images). guernseylegalresources.gg+1
Sharing: form provider (Jotform), email/IT providers, and payment processors (for example, SumUp) acting as processors under contract.
Retention: financial and booking records are generally kept for up to 6 years; CCTV typically up to 31 days unless required longer for an incident; incident and safety logs typically up to 3 years; marketing consents until withdrawn.

15. Fairness and transparency (Trading Standards)
We aim to present key charges and rules (Minimum Spend, Guaranteed Headcount, deposits, and cancellation charges) clearly and prominently, and we do not rely on unfair or hidden terms. gov.gg+2gov.gg+2
16. Governing law
These terms are governed by the laws of the Bailiwick of Guernsey. The Royal Court of Guernsey has jurisdiction.
