    Participation, Event Attendance, and Facility Use Liability Waiver
  • This Waiver and Release of Liability ("Agreement") is entered into by the undersigned Participant, or the Parent or Legal Guardian of a Minor Participant, in favor of Mon Amie’s Business and Wellness Solutions, L3C, including all of its divisions, programs, subsidiaries, collaborative initiatives, officers, directors, employees, contractors, volunteers, affiliates, and representatives (collectively referred to as “Mon Amie’s”).

    This Agreement applies to all activities, programs, rentals, meetings, trainings, tutoring sessions, youth programs, athletic programs, corporate events, workshops, conferences, kidConnect programming, and any other engagement hosted, organized, sponsored, supervised, facilitated, or operated by Mon Amie’s, whether conducted:

    At Mon Amie’s principal office located at 1124 Villaggio Blvd, Bossier City, Louisiana 71111

    • At leased or shared facilities
    • At third-party venues
    • At schools or partner sites
    • At community centers
    • At athletic facilities
    • At conference locations
    • At outdoor or public locations
    • During travel to or from such events


    (Collectively referred to as “Activities.”)


    1. ASSUMPTION OF RISK
    Participation in Activities involves inherent risks that may result in injury, illness, property damage, or other harm. Such risks may include but are not limited to:

    • Slips, trips, or falls
    • Injuries during recreational or athletic activity
    • Accidents involving equipment or furnishings
    • Injury caused by other participants
    • Risks present at third-party locations
    • Transportation-related risks
    • Environmental conditions beyond Mon Amie’s control


    The Participant voluntarily assumes full responsibility for any risk of injury or damage that may occur while participating in Activities.


    2. RELEASE OF LIABILITY
    To the fullest extent permitted under Louisiana law, the Participant releases and agrees not to hold liable Mon Amie’s Business and Wellness Solutions, L3C and all affiliated divisions from any claims arising from:

    • Participation in Activities
    • Attendance at events hosted by Mon Amie’s
    • Rental or use of facility space
    • Participation in kidConnect programming
    • Youth, athletic, or educational programming
    • Activities occurring at off-site locations
    • Transportation related to Activities

    This release applies to claims arising from negligence to the extent permitted by Louisiana law.


    3. THIRD-PARTY VENUES
    When Activities occur at locations not owned or controlled by Mon Amie’s:

    • Mon Amie’s does not control the premises
    • Mon Amie’s is not responsible for facility conditions
    • Hazards at third-party venues may exist beyond Mon Amie’s control

    Participants assume all risks associated with entering or participating at such locations.


    4. RESTRICTED AREAS AND EQUIPMENT
    When Activities occur at Mon Amie’s facility:

    The following areas and materials are strictly off limits to visitors and participants:

    • Industrial equipment
    • Maintenance tools
    • Electrical panels
    • Storage areas
    • Staff-only areas
    • Business equipment and supplies

    Participants may not enter restricted areas or handle equipment not intended for participant use.

    Any injury resulting from unauthorized access to restricted areas is the responsibility of the participant or supervising adult.


    5. DESIGNATED USE AREAS
    Participants must remain only in areas designated for the specific Activity.

    Visitors may not:

    • Roam beyond assigned areas
    • Enter neighboring property
    • Use exterior amenities including waterfalls, pools, pond areas, landscaping features, or other public spaces not designated for the event
    • Mon Amie’s is not responsible for injuries occurring outside designated program areas.


    6. SUPERVISION OF MINOR CHILDREN
    Minor children must be supervised at all times.

    Parents or guardians are responsible for monitoring their child unless the child is actively enrolled in a supervised Mon Amie’s program.

    Children may not roam hallways, office areas, or exterior grounds without authorization.

    Mon Amie’s is not responsible for injuries resulting from lack of supervision.

    7. DROP-OFF AND SUPERVISION TRANSFER
    For programs allowing drop-off:

    Supervision transfers to Mon Amie’s only when the child has been formally checked in to a supervised program by authorized staff.

    Supervision transfers back to the parent or guardian when:

    • The program ends
    • The child is signed out
    • The child leaves the designated program area

    Parents remain responsible for minors who arrive early or remain after scheduled program hours.


    8. THIRD-PARTY EVENTS HOSTED AT MON AMIE’S FACILITY
    Mon Amie’s may rent or provide space for events organized by outside individuals or organizations.

    When Mon Amie’s staff are not present to supervise the event, the event host, event coordinator, and/or responsible guardians assume full responsibility for:

    • Participant supervision
    • Emergency response
    • First aid or medical assistance
    • Safety monitoring during the event
    • Ensuring compliance with facility rules

    Mon Amie’s does not provide medical supervision, emergency equipment, or safety personnel for third-party hosted events unless agreed to in writing.


    9. TRANSPORTATION
    If transportation is provided, coordinated, or recommended by Mon Amie’s, the Participant acknowledges the risks associated with travel and assumes responsibility for such risks.

    If transportation is arranged independently, Mon Amie’s bears no responsibility for transportation safety.


    10. PROPERTY DAMAGE
    Participants agree to be financially responsible for any damage caused to property owned, leased, or used by Mon Amie’s or third-party venues.


    11. MEDICAL AUTHORIZATION
    In the event of a medical emergency, Mon Amie’s representatives may seek medical assistance for the Participant.

    The Participant or Parent/Guardian accepts financial responsibility for any resulting medical treatment.


    12. PARTICIPANT CONDUCT AND SAFETY RULES
    To maintain a safe environment, the following behaviors are prohibited:

    • Running indoors unless part of a supervised activity
    • Pushing, shoving, or roughhousing
    • Climbing on furniture or fixtures
    • Throwing objects that may cause injury
    • Unsafe use of equipment
    • Entering restricted areas
    • Touching industrial equipment or supplies
    • Any conduct that endangers others

    Participants must follow staff instructions at all times.


    13. SAFETY COMPLIANCE AND RIGHT OF REMOVAL
    Failure to follow safety rules or staff instructions may result in immediate removal from the premises or event location.

    Mon Amie’s reserves the right to deny participation to individuals whose behavior creates safety concerns.

    Removal does not create liability on the part of Mon Amie’s.


    14. BEHAVIORAL DISMISSAL OF MINORS
    If a minor participant engages in behavior that is unsafe, disruptive, aggressive, or repeatedly violates program rules, Mon Amie’s reserves the right to remove the minor from the activity.

    Parents or guardians may be required to pick up the child immediately.

    Repeated violations may result in suspension or removal from future participation.

    15. PERSONAL BELONGINGS
    Participants are responsible for their personal belongings, including but not limited to phones, tablets, backpacks, clothing, and personal equipment.

    Mon Amie’s is not responsible for lost, stolen, or damaged personal property.


    16. COMMUNICABLE ILLNESS ACKNOWLEDGMENT
    Participants acknowledge that exposure to communicable illnesses may occur in public environments.

    Participation in Activities constitutes acceptance of this risk.

    Participants who are experiencing symptoms of illness should refrain from attending Activities.


    17. PHOTO AND VIDEO RELEASE
    Participants grant permission for Mon Amie’s to photograph or record video during Activities for promotional, educational, and marketing purposes.

    Participants may opt out by providing written notice prior to participation.


    18. INDEMNIFICATION
    Participants agree to indemnify and hold harmless Mon Amie’s Business and Wellness Solutions, L3C and its affiliates from any claims, damages, or legal expenses arising from participation in Activities.
     

    19. DISPUTE RESOLUTION AND GOVERNING LAW
    This Agreement shall be governed by the laws of the State of Louisiana.

    Any legal action arising from participation in Activities shall be filed exclusively in courts located in Bossier Parish, Louisiana.


    20. SEVERABILITY
    If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.


    21. ACKNOWLEDGMENT
    By signing below, the Participant acknowledges that they have read and understand this Agreement and voluntarily accept its terms.
