This Supportive Housing Occupancy Agreement ("Agreement") is entered into between Angelic Housing Resources Foundation, Inc., a California nonprofit public benefit corporation ("AHRF"), and the Housing Participant identified below.

MOVE-IN FEE

Housing Participant agrees to pay a One-Time Move-In Fee of Two Hundred Dollars ($200.00) prior to occupancy.

The Move-In Fee is charged to offset administrative costs associated with participant onboarding, housing placement, room preparation, program orientation, processing, documentation, inspections, and move-in coordination.

The Move-In Fee is fully earned upon payment and is nonrefundable, regardless of whether Housing Participant voluntarily withdraws, fails to move in, moves out early, is removed from the program, transfers to another location, or otherwise ceases participation in the housing program.

The Move-In Fee is separate from and in addition to any Monthly Housing Fee, security deposit, or other charges that may be required under this Agreement.

OCCUPANCY TERMS, HOUSING FEES, AND NO REFUND POLICY

HOUSING FEES

Housing Participant agrees to pay the Monthly Housing Fee stated in the Occupancy Agreement.

Monthly Housing Fees are due in advance on or before the 3rd day of each month.

Any Monthly Housing Fee not received by the end of the 3rd day of the month shall be subject to a Fifty Dollar ($50.00) Late Fee.

Housing Participant acknowledges that timely payment of all Monthly Housing Fees is a material condition of participation in the housing program.

INDIVIDUAL RESPONSIBILITY

Housing Participant shall be solely responsible for their own Monthly Housing Fees, security deposit (if applicable), damages, fees, charges, and obligations arising under the Occupancy Agreement and related program documents.

Housing Participant shall not be responsible for the obligations, fees, damages, conduct, or actions of any other Housing Participant residing at the property.

ASSIGNED BED SPACE AND USE OF PREMISES

Housing Participant is granted the right to occupy their assigned bed space and designated portion of a shared bedroom together with shared use of common areas.

Housing Participant acknowledges that room assignments, bed assignments, and occupancy arrangements may be modified by Angelic Housing when reasonably necessary for program operations, participant safety, maintenance, occupancy management, or other legitimate program purposes.

COMPLIANCE WITH PROGRAM REQUIREMENTS

Housing Participant agrees to comply with the Occupancy Agreement, House Rules, program policies, and all applicable laws.

Failure to comply may result in warnings, corrective action, fees where permitted, termination of occupancy, or removal from the housing program, subject to applicable law.

NO REFUND POLICY

Housing Participant acknowledges that Angelic Housing incurs administrative, staffing, screening, placement, onboarding, room preparation, and operational expenses in connection with operating its supportive housing program.

Any reservation fee, holding fee, placement fee, administrative fee, or Move-In Fee paid to secure a housing opportunity shall be deemed earned upon payment and shall be nonrefundable unless otherwise required by law or approved in writing by Angelic Housing.

Housing fees are charged on a monthly basis and are not calculated on a daily occupancy basis.

Except as otherwise required by law, no refund, credit, or prorated adjustment shall be provided for:

• Early departure;
• Voluntary move-out;
• Program termination;
• Absence from the property;
• Incarceration;
• Hospitalization;
• Transfer to another location; or
• Any unused portion of a billing period.

TERMINATION

This Occupancy Agreement may be terminated by:

(a) Housing Participant's voluntary departure upon thirty (30) days' prior written notice;

(b) Mutual written agreement between Angelic Housing and Housing Participant; or

(c) Nonpayment of fees, violation of House Rules, violation of program policies, safety concerns, disruptive conduct, unauthorized occupancy, property damage, or any other material breach of the Occupancy Agreement.

Termination of this Occupancy Agreement shall not affect the rights or obligations of Angelic Housing or any other Housing Participant residing at the property.

ACKNOWLEDGMENT

Housing Participant acknowledges that they have read, understand, and agree to the terms of this Occupancy Terms, Housing Fees, and No Refund Policy Agreement.

* HOUSE RULES ADDENDUM

This House Rules Addendum is incorporated into and made part of the Supportive Housing Occupancy Agreement and all related program documents for the Premises.

All Housing Participants and their guests, invitees, service providers, caregivers, and visitors shall comply with these House Rules, all program policies, and all applicable federal, state, and local laws.

Violation of these House Rules may result in warnings, additional fees where permitted, restrictions on privileges, termination of occupancy, or removal from the housing program, subject to applicable law.

1. PROGRAM ADMINISTRATION
There is no on-site house manager.

No Housing Participant, guest, or visitor may represent themselves as an employee, manager, board member, agent, or authorized representative of Angelic Housing Resources Foundation, Inc.

2. PROGRAM SERVICES AND INDEPENDENT LIVING
Angelic Housing Resources Foundation provides permanent supportive housing and housing-related services intended to assist independent adults in maintaining stable housing.

Angelic Housing does not provide healthcare, nursing care, caregiving services, transportation services, meal preparation services, or supervision.

This is an independent living program for adults only.

Men's and Women's housing programs are maintained separately. Co-ed occupancy is not permitted.

3. ASSIGNED BED SPACE AND USE OF PREMISES
Housing Participants are assigned a specific bed space and designated area within a shared bedroom.

Housing Participants are entitled to use common areas in accordance with House Rules and program policies.

Housing Participants may not occupy any room, bed, or area not assigned to them.

4. COMPLIANCE WITH PROGRAM REQUIREMENTS
Housing Participants shall comply with the Occupancy Agreement, House Rules, program policies, and all applicable laws.

5. CONDUCT AND RESPECTFUL BEHAVIOR
Housing Participants shall treat fellow participants, staff, neighbors, vendors, and visitors with dignity and respect.

Harassment, threats, intimidation, violence, discrimination, disruptive behavior, indecent exposure, sexual misconduct, sexual harassment, and displaying pornography to others are prohibited.

6. GUESTS AND VISITORS
Guests and visitors are not permitted inside the residence.

Exceptions may be granted for approved caregivers, case managers, medical providers, or service professionals with prior authorization from Angelic Housing.

Overnight guests are strictly prohibited.

Loitering in front of the property is prohibited.

7. ALCOHOL, DRUGS, SMOKING, AND VAPING
Alcohol is prohibited on the property.

Illegal drugs, drug paraphernalia, and unlawful activity are prohibited.

Smoking and vaping are permitted only in designated outdoor areas approved by management.

8. HYGIENE, CLEANLINESS, AND HOUSEKEEPING
Housing Participants shall maintain proper personal hygiene and a clean living environment.

Participants are expected to shower regularly, wash clothing and bedding at least weekly, and maintain their assigned living space in a clean and sanitary condition.

Bathrooms should not be occupied for excessive periods of time when other participants require access.

Shared areas must be cleaned immediately after use.

Housekeeping responsibilities may be assigned and rotated among Housing Participants.

New Move-In Requirements:

• Wash all clothing, bedding, linens, and fabric items using hot water and detergent and dry using high heat before bringing them into the residence.

• Shower and change into clean clothing before using provided bedding.

Failure to maintain sanitary conditions may result in corrective action, increased housing fees upon proper notice, room cleaning charges, or termination of occupancy.

Health and safety concerns may require staff entry into assigned living spaces without prior notice in accordance with program policies.

9. KITCHEN, FOOD STORAGE, AND COOKING
Housing Participants shall label personal food items.

Participants are limited to their assigned refrigerator and freezer storage areas.

Food belonging to other participants may not be used without permission.

Dishes, counters, appliances, and cooking areas must be cleaned immediately after use.

Perishable food shall not be left unattended.

Participants must remain present while cooking.

10. FURNITURE, APPLIANCES, AND PROPERTY
Furniture, mattresses, appliances, and large personal items may not be brought onto the property without prior written approval.

Used mattresses and used upholstered furniture are prohibited.

All furnishings, appliances, and equipment supplied by Angelic Housing shall remain on the property.

11. BELONGINGS, PERSONAL PROPERTY, AND RENTER'S INSURANCE

Housing Participant acknowledges that Angelic Housing Resources Foundation, Inc. does not provide insurance coverage for Housing Participant's personal property, belongings, vehicles, or personal liability.

Renters insurance is strongly recommended, but is not required, and Housing Participant is solely responsible for obtaining and maintaining any insurance coverage they deem appropriate.

Housing Participant understands that Angelic Housing is not responsible for loss, theft, damage, destruction, or disappearance of personal property, except as otherwise required by law.

12. STORAGE, GARAGE, AND SHEDS
Storage of personal belongings in garages, sheds, utility rooms, maintenance areas, or other unauthorized spaces is prohibited.

Garages and sheds shall not be used as living space.

13. PETS AND ANIMALS
Pets and animals are prohibited.

14. PEST CONTROL AND BED BUG PREVENTION
Housing Participants shall cooperate fully with all pest control inspections, monitoring, treatment procedures, and prevention efforts.

Required pest monitoring devices must remain visible and undisturbed.

Housing Participants shall follow all instructions provided by Angelic Housing and pest control professionals.

15. PLANTS AND LANDSCAPING
Planting or modifying landscaping is prohibited without prior written approval.

Marijuana cultivation is strictly prohibited.

16. SECURITY CAMERAS

For the safety and security of Housing Participants, staff, visitors, and property, Angelic Housing Resources Foundation utilizes audio and video surveillance systems in certain common areas and exterior portions of the property.

Security cameras may monitor and record activity in common areas, including but not limited to living rooms, kitchens, hallways, entrances, driveways, parking areas, exterior walkways, yards, and other shared spaces.

Security cameras are not installed inside bathrooms or within private sleeping areas where a Housing Participant would reasonably expect complete privacy.

Audio and video recordings may be used for safety, security, supervision, incident investigation, rule enforcement, training, risk management, insurance claims, law enforcement investigations, legal proceedings, and protection of persons and property.

Recordings may be stored electronically on Ring servers for a period determined by Ring and / or Angelic Housing and may be accessed by authorized staff, board members, legal counsel, law enforcement agencies, insurance representatives, contractors, or other authorized persons when reasonably necessary.

Housing Participants shall not tamper with, disable, obstruct, damage, disconnect, cover, relocate, interfere with, or otherwise impair the operation of any security camera, recording device, internet connection, power source, or related equipment.

Housing Participant acknowledges that common areas of the property are subject to audio and video monitoring and expressly consents to such monitoring as a condition of participation in the housing program.

17. SAFETY AND SECURITY
Doors and windows shall be secured when not in use.

Smoke detectors, carbon monoxide detectors, fire extinguishers, and other safety equipment shall not be tampered with.

Weapons are prohibited.

18. LOCKS AND ACCESS
Housing Participants may not alter, replace, install, or modify locks.

Bedrooms must remain accessible to assigned roommates and authorized staff.

19. UTILITIES, ENERGY CONSERVATION, AND INTERNET
Thermostat settings are controlled by Angelic Housing.

Participants shall not tamper with thermostat settings or utility systems.

Participants shall conserve water and electricity whenever possible.

Repairs, leaks, hazards, and maintenance concerns shall be reported promptly.

20. QUIET HOURS
Quiet Hours are observed daily from 10:00 PM through 7:00 AM.

Noise levels shall be kept to a minimum during Quiet Hours.

Televisions, music, phone calls, lighting, and other activities shall not interfere with roommates' ability to rest.

21. VEHICLES AND PARKING
Each Housing Participant may maintain one currently registered and operable vehicle.

Vehicle repairs, maintenance, and oil changes are prohibited on the property.

Parking is available on a first-come, first-served basis unless otherwise designated.

22. MAIL AND DELIVERIES
Housing Participants shall promptly retrieve mail and packages.

Angelic Housing is not responsible for lost, stolen, delayed, damaged, or misdelivered mail or packages.

Upon move-out, Housing Participants are responsible for updating their mailing address and forwarding arrangements.

23. EXTENDED ABSENCES

Housing Participants who will be away from the Property for more than seventy-two (72) consecutive hours must notify Angelic Housing Resources Foundation, Inc. in advance whenever reasonably possible. This requirement helps staff ensure participant safety, maintain accurate occupancy records, and avoid mistaken determinations that a bed space has been abandoned.

24. ENFORCEMENT AND PROGRAM TERMINATION
Violation of these House Rules may constitute a breach of the Occupancy Agreement.

Serious or repeated violations may result in warnings, corrective action, fees where permitted, termination of occupancy, or removal from the housing program, subject to applicable law.

25. DISPUTE RESOLUTION
Any dispute arising out of participation in the housing program shall first be submitted to mediation before a mutually agreed mediator.

If mediation is unsuccessful, disputes may be submitted to binding arbitration as permitted by applicable law and any separate arbitration agreement executed by the parties.

26. ATTORNEY FEES
To the extent permitted by law, the prevailing party in any action arising from the enforcement of the Occupancy Agreement or House Rules shall be entitled to recover reasonable attorney fees and costs.

ACKNOWLEDGMENT AND SIGNATURES
By signing below, Housing Participant acknowledges that they have read, understand, and agree to comply with these House Rules and all related program policies.

ANGELIC HOUSING RESOURCES FOUNDATION, INC.

ENTRY RIGHTS, ROOM INSPECTION, AND HEALTH & SAFETY ADDENDUM

Housing Participant acknowledges that Angelic Housing Resources Foundation, Inc. ("Angelic Housing") operates a supportive shared housing program that requires ongoing property oversight, health and safety monitoring, maintenance, inspections, occupancy management, and program administration. As a condition of participation in the housing program, Housing Participant agrees to the following:

RIGHT OF ENTRY

Housing Participant authorizes Angelic Housing, its officers, directors, employees, volunteers, contractors, agents, case managers, maintenance personnel, and authorized representatives to enter bedrooms, sleeping areas, storage areas, and common areas without advance notice whenever reasonably necessary for health, safety, maintenance, inspections, occupancy management, rule enforcement, wellness checks, emergencies, or any other legitimate program-related purpose.

Housing Participant acknowledges and agrees that Angelic Housing is not required to provide twenty-four (24) hour advance notice prior to such entry and expressly consents to such entry to the fullest extent permitted by law.

PURPOSES OF ENTRY

Entry may occur for any legitimate housing or program-related purpose, including but not limited to:

• Health and safety inspections;
• Wellness or welfare checks;
• Emergency situations;
• Maintenance, repairs, cleaning, pest control, or remediation services;
• Investigation of complaints;
• Investigation of suspected violations of House Rules, program policies, or occupancy requirements;
• Verification of occupancy;
• Fire, life-safety, and environmental inspections;
• Property condition inspections;
• Bed assignments, room assignments, transfers, or occupancy reviews;
• Compliance with insurance, governmental, licensing, funding, or program requirements;
• Protection of Housing Participants, staff, visitors, neighbors, or property.

ROOM INSPECTIONS

Housing Participant understands and agrees that Angelic Housing may conduct announced or unannounced inspections of bedrooms, sleeping areas, closets, storage areas, furnishings, and common areas to ensure compliance with House Rules, occupancy requirements, cleanliness standards, health and safety requirements, pest-control requirements, and program policies.

SHARED HOUSING ACKNOWLEDGMENT

Housing Participant acknowledges that Angelic Housing operates a shared housing environment in which bedrooms and common areas may be shared with other Housing Participants. Housing Participant further acknowledges that periodic entry, inspections, wellness checks, maintenance activities, and program oversight are necessary components of participation in the housing program.

PROHIBITED ITEMS, SAFETY HAZARDS, AND POLICY VIOLATIONS

During inspections or authorized entry, Angelic Housing may observe and document prohibited items, unauthorized occupants, sanitation concerns, pest-related issues, health hazards, fire hazards, property damage, illegal activity, or violations of House Rules and program policies.

Any condition or item that presents an immediate threat to the health, safety, welfare, security, or property of Housing Participants, staff, visitors, or neighbors may be addressed, removed, secured, reported, photographed, documented, or otherwise handled as deemed reasonably necessary by Angelic Housing.

PRIVACY

Angelic Housing will make reasonable efforts to respect the privacy and dignity of Housing Participants whenever practical. However, Housing Participant acknowledges that health, safety, compliance, maintenance, operational, and program-related needs may require entry without prior notice.

FAILURE TO COMPLY

Refusal to permit authorized entry, interference with inspections, obstruction of staff, concealment of unauthorized occupants, violation of occupancy requirements, or other actions that impede the safe and orderly operation of the housing program may constitute a violation of House Rules and may result in warnings, corrective action, additional charges where permitted, termination of occupancy, or removal from the housing program, subject to applicable law.

ACKNOWLEDGMENT

By initialing below, Housing Participant acknowledges that they have read, understand, and voluntarily agree to the terms of this Entry Rights, Room Inspection, and Health & Safety Addendum.

BED BUG, MOLD, LEAD BASED PAINT, & ENVIRONMENTAL CONDITIONS ADDENDUM

Supportive Housing Occupancy Agreement and all related program documents between Angelic Housing Resources Foundation, Inc. ("Angelic Housing") and the Housing Participant.

BED BUG ACKNOWLEDGMENT AND RESPONSIBILITIES

Housing Participant acknowledges that bed bugs may be introduced into shared housing environments through luggage, clothing, furniture, bedding, personal belongings, visitors, service providers, or other sources beyond the control of Angelic Housing.

Housing Participant agrees to:

• Inspect personal belongings prior to move-in whenever reasonably possible;

• Promptly report any suspected bed bug activity, bites, infestations, or signs of bed bugs to Angelic Housing;

• Fully cooperate with all inspections, monitoring, treatment, cleaning, laundering, relocation, extermination, and prevention efforts;

• Follow all instructions provided by Angelic Housing and pest control professionals;

• Refrain from bringing discarded mattresses, upholstered furniture, infested items, or items of unknown origin onto the property.

Failure to promptly report suspected bed bug activity or cooperate with treatment efforts may result in additional charges where permitted, corrective action, termination of occupancy, or removal from the housing program.

Housing Participant acknowledges that treatment efforts may require room entry, inspections, temporary relocation, laundering of clothing and bedding, disposal of personal property, and multiple treatment procedures.

MOLD AND MILDEW ACKNOWLEDGMENT

Housing Participant acknowledges that mold and mildew may occur where moisture, humidity, water intrusion, condensation, plumbing failures, or inadequate ventilation exist.

Housing Participant agrees to:

• Maintain their assigned living space in a clean and sanitary condition;

• Promptly report plumbing leaks, roof leaks, moisture intrusion, water damage, condensation issues, or visible mold growth;

• Use ventilation systems, fans, and windows appropriately when available;

• Avoid blocking ventilation systems or restricting airflow;

• Immediately notify Angelic Housing of any condition that may contribute to mold or mildew growth.

Housing Participant shall not intentionally create conditions that contribute to excessive moisture, mold, mildew, water damage, or unsanitary conditions.

Housing Participant acknowledges that prompt reporting is essential to prevent the spread of mold and mildew.

LEAD-BASED PAINT DISCLOSURE ACKNOWLEDGMENT

For housing constructed before 1978, Housing Participant acknowledges that lead-based paint and lead-based paint hazards may exist.

Housing Participant acknowledges receipt of any federally required lead-based paint disclosures and educational materials provided by Angelic Housing.

Housing Participant agrees to promptly report peeling paint, chipping paint, damaged painted surfaces, deteriorating building materials, or other conditions that may present a lead-related concern.

ENVIRONMENTAL CONDITIONS

Housing Participant acknowledges that Angelic Housing cannot guarantee a completely allergen-free, pest-free, mold-free, smoke-free, dust-free, fragrance-free, or environmentally controlled living environment.

Housing Participant understands that communal living environments may expose individuals to ordinary environmental conditions, including but not limited to:

• Dust;
• Pollen;
• Allergens;
• Insects;
• Rodents;
• Mold spores;
• Environmental pollutants;
• Airborne irritants;
• Communicable illnesses introduced by other Housing Participants, visitors, caregivers, vendors, or third parties.

Housing Participant agrees to promptly report any health, safety, sanitation, pest, moisture, mold, mildew, or environmental concerns to Angelic Housing.

RIGHT OF ENTRY FOR INSPECTION AND TREATMENT

Housing Participant authorizes Angelic Housing and its authorized employees, contractors, maintenance personnel, pest control professionals, and representatives to enter bedrooms, sleeping areas, storage areas, and common areas without prior notice when reasonably necessary to inspect, investigate, monitor, prevent, treat, remediate, document, or address bed bugs, pests, mold, mildew, water intrusion, environmental hazards, sanitation concerns, maintenance issues, or related conditions.

LIMITATION OF LIABILITY

Housing Participant acknowledges that Angelic Housing will make reasonable efforts to address reported environmental concerns, maintenance issues, pest activity, bed bug infestations, mold conditions, and sanitation concerns.

However, Angelic Housing shall not be responsible for conditions arising from Housing Participant's failure to report issues, failure to cooperate with inspections or treatment efforts, misuse of the property, introduction of pests or prohibited items, violation of House Rules, or other actions or omissions of Housing Participant or their guests, except as otherwise required by law.

ACKNOWLEDGMENT

Housing Participant acknowledges that they have read, understand, and voluntarily agree to the terms of this Bed Bug, Lead-Based Paint, Mold, Mildew, and Environmental Conditions Addendum.

 

ANGELIC HOUSING RESOURCES FOUNDATION, INC.

ASSUMPTION OF RISK, RELEASE OF LIABILITY, HOLD HARMLESS, AND INDEMNIFICATION AGREEMENT

Housing Participant acknowledges that participation in the Angelic Housing Resources Foundation, Inc. ("Angelic Housing") supportive housing program is voluntary and that Housing Participant has chosen to reside in a shared housing environment with other independent adults.

VOLUNTARY PARTICIPATION

Housing Participant understands that Angelic Housing provides supportive housing opportunities and housing-related services but does not guarantee the conduct, behavior, health status, sobriety, compliance, actions, or omissions of any Housing Participant, guest, visitor, vendor, contractor, caregiver, service provider, or third party.

ASSUMPTION OF RISK

Housing Participant knowingly and voluntarily assumes all ordinary risks associated with participation in the housing program and occupancy of the property, including but not limited to:

• Shared living arrangements with other Housing Participants;

• Interactions with Housing Participants, guests, visitors, vendors, contractors, caregivers, service providers, and third parties;

• Use of bedrooms, bathrooms, kitchens, laundry facilities, parking areas, yards, walkways, and common areas;

• Slips, trips, falls, and other commonplace accidents;

• Theft, loss, damage, or disappearance of personal property;

• Exposure to communicable illnesses, allergens, pests, environmental conditions, or other conditions commonly associated with communal living;

• The actions or omissions of other Housing Participants, guests, visitors, vendors, contractors, caregivers, service providers, or third parties.

Housing Participant acknowledges that Angelic Housing cannot guarantee a completely risk-free living environment.

PERSONAL PROPERTY

Housing Participant is solely responsible for securing, protecting, maintaining, and insuring their personal property.

Renters insurance is strongly recommended but is not required.

Angelic Housing shall not be responsible for the loss, theft, damage, destruction, or disappearance of money, valuables, vehicles, documents, electronics, clothing, medications, furniture, personal belongings, or other property belonging to Housing Participant or Housing Participant's guests, except as otherwise required by law.

MEDICAL AND SUPPORT SERVICES DISCLOSURE

Housing Participant understands and acknowledges that Angelic Housing is not a hospital, nursing facility, assisted living facility, healthcare provider, mental health treatment provider, substance abuse treatment facility, emergency shelter, or medical service provider.

Housing Participant remains solely responsible for obtaining medical care, mental health services, prescriptions, counseling, transportation, insurance coverage, emergency services, and any other healthcare or supportive services that may be needed.

RELEASE OF LIABILITY

To the fullest extent permitted by law, Housing Participant releases, waives, and discharges Angelic Housing Resources Foundation, Inc., its officers, directors, employees, volunteers, agents, contractors, board members, affiliated organizations, property owners, and representatives from any claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or relating to Housing Participant's participation in the housing program or occupancy of the property.

This release shall not apply to claims arising from gross negligence, willful misconduct, fraud, or conduct that cannot legally be waived under applicable law.

HOLD HARMLESS AND INDEMNIFICATION

Housing Participant agrees to defend, indemnify, and hold harmless Angelic Housing Resources Foundation, Inc., its officers, directors, employees, volunteers, agents, contractors, board members, affiliated organizations, property owners, and representatives from and against any claims, damages, liabilities, losses, fines, penalties, costs, expenses, or attorney's fees arising from:

• Housing Participant's actions or omissions;

• Violations of House Rules, program policies, occupancy requirements, or applicable laws;

• Damage caused by Housing Participant or Housing Participant's guests;

• Injury caused by Housing Participant or Housing Participant's guests to any person or property;

• Claims brought by Housing Participant's guests, visitors, invitees, family members, caregivers, or representatives.

NO GUARANTEE OF SAFETY

Housing Participant acknowledges that Angelic Housing cannot and does not guarantee the safety, security, behavior, sobriety, compliance, health status, actions, or conduct of any Housing Participant, guest, visitor, vendor, contractor, caregiver, service provider, or third party.

SEVERABILITY

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT

Housing Participant acknowledges that they have carefully read this Agreement, understand its contents, understand that they are assuming certain risks and waiving certain legal rights, and voluntarily agree to be bound by its terms.

 

ANGELIC HOUSING RESOURCES FOUNDATION, INC.

ABANDONED PERSONAL PROPERTY ADDENDUM

Housing Participant shall remove all personal property from the Premises upon vacating, termination of occupancy, transfer, hospitalization, incarceration, institutionalization, or any other departure from the Premises.

Any personal property remaining after Housing Participant vacates or abandons the Premises may be considered abandoned and handled in accordance with California Civil Code Sections 1980 through 1991.

If personal property is left behind, Angelic Housing may remove and store the property in a safe location. Angelic Housing may provide a Notice of Right to Reclaim Abandoned Property as required by California law. Housing Participant shall have not less than fifteen (15) days to reclaim the property if the notice is personally delivered, or not less than eighteen (18) days if the notice is mailed.

Housing Participant shall be responsible for reasonable storage, removal, handling, transportation, and disposal costs to the extent permitted by law. Angelic Housing may require payment of lawful storage charges before releasing the property.

If the property is not timely reclaimed, Angelic Housing may donate, dispose of, sell, or otherwise handle the property as permitted by California Civil Code Sections 1987 and 1988.

Housing Participant may authorize another person to retrieve property by providing a written authorization bearing Housing Participant's handwritten signature or legally valid electronic signature. Angelic Housing may require identification from the authorized representative before releasing property.

Angelic Housing is not a storage facility and shall not be liable for loss, theft, deterioration, damage, or destruction of abandoned property except as required by law.

Extended Absence and Notice of Belief of Abandonment

Housing Participants are expected to occupy their assigned bed space as their primary residence while participating in Angelic Housing Resources Foundation, Inc.'s ("AHRF") supportive housing program. If a Housing Participant expects to be absent from the Property for more than seventy-two (72) consecutive hours, the Participant must notify AHRF in advance whenever reasonably possible. In the event of an emergency, hospitalization, incarceration, or other unforeseen circumstance, the Participant or someone acting on the Participant's behalf should notify AHRF as soon as reasonably practicable. Failure to provide notice may be considered, together with other relevant circumstances, in determining whether the assigned bed space has been abandoned.

If AHRF reasonably believes that a Housing Participant has abandoned the assigned bed space or room, AHRF may serve a Notice of Belief of Abandonment in accordance with applicable California law. In determining whether abandonment has occurred, AHRF may consider factors including, but not limited to:

Failure to occupy the assigned bed space for an extended period without notice.
Failure to pay required housing fees.
Removal of substantially all personal belongings.
Failure to respond to reasonable attempts at communication.
Statements by the Participant or reliable third parties indicating the Participant has moved.

The condition of the assigned space indicating it has been vacated.
Information received from an emergency contact, case manager, hospital, correctional facility, or other reliable source regarding the Participant's intent not to return.

Any other facts or circumstances that reasonably indicate the Participant has permanently vacated the Property.
No single factor shall be determinative.

If AHRF reasonably believes the assigned bed space has been abandoned, AHRF may serve a Notice of Belief of Abandonment by any method authorized under California law. Unless the Participant timely responds in writing within the time permitted by law, this Occupancy Agreement shall terminate on the date specified in the Notice. Any personal property remaining after termination shall be handled in accordance with applicable California laws governing abandoned personal property.

Nothing in this section limits AHRF's right to terminate this Occupancy Agreement through any other lawful means or to pursue any other remedies available under California law.
