    • General release and waiver of liability agreement

By submitting this participation form, paying the fee, and attending the event you are agreeing to the following:
    • I represent that I am an adult and can sign on my own behalf, and on the behalf of my minor child(ren) and that I wish to participate in courses, attend or take part in group or individual educational, artistic, ceremonial, therapeutic, meditative, or recreational activities or programs offered by Partease Productions LLC, the Center for Symbolic Studies, Inc. and Stone Mountain Farm LLC (collectively, “PP/CSS/SMF”).

I understand that integral to the educational and philosophical purposes of PP/CSS/SMF is the preservation and appreciation of wilderness in general, and of the wildness that remains in our Hudson Valley and Catskills Bioregion. PP/CSS/SMF promotes, hosts, or provides programs and experiences which encourage the direct experience of local woodlands, cultivated and uncultivated meadowlands, rocky hills and cliffs, wildlife, and other nature-based and outdoor experiences (“Programs”). I acknowledge that I desire to participate in the Programs at PP/CSS/SMF.

I understand that there are potential and inherent risks and hazards, both known and unknown, associated with the Programs, including without limitation, hiking or running on undeveloped forest paths, or in pathless, un-mowed meadows, fallen or falling timber, ruts/holes, crossing wetlands or streams, being in the vicinity of unfenced ponds, or scrambling upon and over rocky areas and old stone walls, and exposure to plants, including Poison Ivy and Poison Oak which grow commonly in this vicinity. I am aware that the Programs may result in exposure to local wildlife (such as raccoon or deer) and diseases such as Lyme Disease or Rabies, which are dangerous to human beings, and poisonous snakes such as the Timber Rattler and Copperhead. I understand that by participating in the Programs I may also be passing through pastures where horses are at large, or taking part in activities in the barn, hayloft, or in or near sheds or areas where farm machinery is stored or in use; and I know that I should look carefully wherever I walk, run, climb, or ride.

In consideration of participation in the Programs and for entrance on to, crossing, using, or otherwise being present in, on, or upon the premises operated and/or owned by PP/CSS/SMF (the “Land”), and for other good and valuable consideration, I do hereby freely release, discharge, agree to indemnify and hold harmless PP/CSS/SMF from any and all liability, costs, and responsibility whatsoever, for any and all damages, claims, demands, or causes of action for any loss, illness, personal injury, death, or property damage that may arise from or pertain to my participation in the Programs and my presence in, on, or upon the Land, whether caused by negligence of PP/CSS/SMF, by accident, omission, or otherwise.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any Programs. I understand the risks associated with the Programs and I agree to follow all instructions so that I may safely participate in the Programs.

In addition, I agree that I will maintain a respectful distance from all residences and farm buildings; and I understand that no hunting or discharge of firearms is permitted on Stone Mountain Farm. I will be respectful of the hazards of farm and woodland, and behave with appropriate caution. I understand it is my duty to be attentive to instructions or advice from teachers or personnel at PP/CSS/SMF, and to inform my minor child of these hazards and of the need to be attentive to teachers and other personnel. I understand that neither PP/CSS/SMF, nor their principals, employees, assigns, or agents can prevent accidents, and I do not expect them to do so.

I also acknowledge that if I hike, swim, dance, rock-climb, ride a horse or bicycle, engage in trapeze, high or low ropes course, zipline, or other vigorous activities, or participate in a Sweat Lodge at Stone Mountain Farm, I assume the risks, known and unknown, of these activities, and do so entirely at my own risk; and if I allow my minor child to participate in any of these activities, it is with the same understanding.

I also acknowledge that I cannot bring dog(s), horse(s) or other animals to PP/CSS/SMF.

I hereby specifically release, indemnify and hold the Center for Symbolic Studies, Inc., Stone Mountain Farm LLC, and Partease Productions, LLC, and their respective members, trustees, directors, heirs, counsel, assigns, and/or their employees or agents harmless from liability for any claims which may arise out of my participation in the Programs or on the Land, including those listed explicitly in this Agreement, and other known or unknown risks associated therewith.

WARNING: KNOW WHAT YOU ARE SIGNING: This form restricts or eliminates your ability to file a lawsuit against Partease Productions, LLC, the Center for Symbolic Studies or Stone Mountain Farm LLC and/or its employees or agents, and farm owners, for injuries you may sustain while on the premises.
