ATTENDEE WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT

Event: Swarmin the Swamp Biker Rally
Location: Bogue Chitto Swamp Cabins, Louisiana
Dates:September 3-7, 2026

1. ACKNOWLEDGMENT OF RISKS
I understand and acknowledge that attending and participating in the Swarmin the Swamp Biker Rally (“Event”) involves inherent and significant risks, including but not limited to:
• Motorcycle riding and transportation risks;
• Accidents involving motorcycles, vehicles, trailers, and equipment;
• Slips, trips, falls, uneven terrain, wildlife, weather hazards, water hazards, and fire hazards;
• Physical injury, disability, illness, property damage, and death;
• Risks associated with alcohol consumption and intoxicated individuals;
• Risks arising from biker games, contests, competitions, demonstrations, mechanical bull activities, tug-of-war, obstacle courses, races, stunt activities, and similar recreational activities;
• Exposure to loud music, bands, crowds, lighting equipment, stages, pyrotechnics, and event-related equipment;
• Conduct of other attendees, vendors, volunteers, performers, or third parties.

I voluntarily choose to attend and/or participate in the Event with full knowledge and appreciation of these risks.

2. VOLUNTARY PARTICIPATION
I certify that I am voluntarily attending and participating in the Event and that I am physically, mentally, and legally capable of participating. I agree to comply with all Event rules, safety instructions, posted warnings, and directions from Event staff, property owners, vendors, security personnel, and law enforcement.

3. ALCOHOL ACKNOWLEDGMENT
I acknowledge that alcohol may be served, consumed, or present at the Event. I certify that I am at least twenty-one (21) years of age if consuming alcohol. I accept full personal responsibility for my own alcohol consumption and conduct.

I agree:
• Not to drink and drive;
• Not to operate a motorcycle or vehicle while impaired;
• Not to provide alcohol to minors;
• To comply with all applicable federal, state, and local laws relating to alcohol consumption.

I understand that Louisiana law may limit liability relating to alcohol service in certain circumstances, but this waiver does not excuse illegal conduct or violations of law.

4. RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, I release, waive, discharge, and covenant not to sue the Event organizers, property owners, sponsors, hosts, promoters, staff, volunteers, vendors, entertainers, bands, security personnel, advertisers, affiliates, insurers, and all related entities and individuals (“Released Parties”) from any and all claims, demands, damages, losses, liabilities, causes of action, costs, or expenses arising out of or related to my attendance or participation in the Event, including claims relating to personal injury, illness, death, or property damage.

This release includes claims arising from ordinary negligence to the extent permitted by law, but does not waive rights that cannot legally be waived under Louisiana law.

5. ASSUMPTION OF RISK
I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with attending and participating in the Event, including risks caused by the actions or inactions of other participants or third parties.

6. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, costs, attorney fees, or expenses arising out of:
• My conduct at the Event;
• My violation of Event rules or applicable laws;
• Damage to property caused by me;
• Injury caused by me to another person.

7. MEDICAL AUTHORIZATION
In the event of injury or medical emergency, I authorize Event Personnel or anyone who is able and capable to obtain emergency medical treatment on my behalf. I understand that I am solely responsible for all medical expenses incurred.

8. PHOTO, VIDEO & MEDIA RELEASE
I grant permission to the Event organizers and their designees to photograph, record, and use my likeness, image, voice, or appearance in promotional, advertising, social media, and commercial materials without compensation or further approval. Note: There is no photography allowed by stage event. 

9. REMOVAL FROM EVENT
Event organizers reserve the right to remove or deny entry to any attendee for unsafe, illegal, disruptive, intoxicated, threatening, or inappropriate behavior without refund or compensation.

10. GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by the laws of the State of Louisiana. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. ACKNOWLEDGMENT
I have carefully read this Agreement, fully understand its contents, and sign it electronically and voluntarily. I understand that by signing this Agreement, I may be waiving certain legal rights. By electronically signing this i ackowledge all contents of this waiver provided. I acknowledge that I will not be able to attend this event wihtout signing this waiver and any purhcases made to attend the event are non-refundable.
