I understand at the time of adoption, I will be required to complete the final adoption agreement and paperwork. This FTA Agreement does not serve as the final adoption paperwork.I understand that CHDR operates as a team and that my Foster Mentor is my main point of contact. I will reach out to my Foster Mentor to provide updates on my foster dog or if I were to need any help. I will promptly contact my Foster Mentor, via email, regarding any matters of concern (loss or death of the dog, medical issues, behavioral concerns, etc.). I agree that while I am fostering-to-adopt a CHDR dog, CHDR remains the lawful owner of this dog, and I must have any medical decisions or procedures approved through CHDR administration prior to the medical procedure being done. When caring for the foster dog, I will treat them as such and take precautions against any preventative accidents or illnesses. This dog is not legally mine until I finalize the adoption at a date that is agreed upon my foster mentor and me.I understand that CHDR believes strongly in providing high quality medical care and takes great pride in helping give the dogs what they deserve. CHDR welcomes and rescues dogs from unknown histories and horrors. There is always a risk involved and CHDR does everything possible to minimize that risk. CHDR cannot guarantee that fosters will not be exposed to parvovirus, parasites, fleas, ticks, brucellosis, or any other possible risk. By signing this agreement, I knowingly and voluntarily assume full responsibility arising out of, or related to, fostering and all such dogs in my care. If I have any questions at any time, I will contact my Foster MentorIt is very important that foster dogs are current on routine veterinary care. I will coordinate appointments with a CHDR-authorized veterinarian to ensure the dog is up to date on all vaccinations and health care needs. I reaffirm and agree that I will not sue CHDR for all claims, actions and liabilities associated there within accordance with the terms of this Agreement. I will report any concerns, injuries or illness to my Foster Mentor immediately. Foster dog needs to be current on all vet-care prior to any adoption being finalized. I will document and maintain health records as per CHDR policy. I will retain original copies of all vet records.I will notify my Foster Mentor if any medical treatment or emergency arises and will ensure that the dog gets necessary medical treatment as soon as possible using CHDR approved veterinary clinics. See separate document for up-to-date list on approved clinics, Foster Mentor can also provide updated list anytime upon requestI understand that CHDR cannot and does not make any guarantees as to the health, temperament, mental disposition, or training of the dog. CHDR shall not be held liable for any illnesses or defects the dog may have or develop, or for any injury or damage that the dog may cause. As a FTA, Ido so at my own risk.I fully and completely release CHDR from all claims and liability for any illness that I or my animals might develop, even if said illness might have been procured from the foster dog.I will provide a safe and stable environment for my foster dog and have an area available to separate my foster from other pets and people. I will crate my foster dog when I’m gone to keep him as safe as possible to prevent bodily harm or damage to my home.I further understand that because CHDR is the lawful owner of the dog, I will not give, sell, or otherwise dispose of the dog to another person or organization. If the dog needs a temporary foster while I am away from home for an extended period of time, I will ask my foster mentor to help find a CHDR approved temporary foster home. I will give my foster mentor as much notice as possible and understand it can take anywhere from 48 hours to two weeks to find a temp placement.I agree that although many foster families choose to integrate foster dogs into all areas of their home and introduce them to other dogs right away, the safest option is to keep dogs separated until a veterinary examination and care has been completed.I will provide the dog with compassionate and loving care for as long as necessary. This care includes – but is not limited to –adequate food, water, shelter, attention, and medical care. I covenant and agree that the dog will be a household companion and will live in the house. The dog will never be left outside without proper adult supervision and will never be left outside when I am not home, even in a fenced yard. I agree to do so in accordance with all CHDR guidelines and recommendations from my Foster Mentor.I will provide the dog with affection and mental stimulation through play and training, socialization, and regular exercise, appropriate to his/her health and physical condition. I agree to do so in accordance with all CHDR guidelines and recommendations from my Foster Mentor.I will provide appropriate and humane behavior modification for behavioral problems. CHDR offers training and behaviorist resources - I will contact my Foster Mentor if I need to utilize them. I certify that if I do obtain such training and behavior resources by CHDR I will strictly comply with all documentation, and recommendations.It is crucial to provide a stable environment for each foster dog. Moving a dog from home to home can affect their well-being. I will be patient and tolerant during the transition period (which can last from a few days to a few months) and understand that some dogs may not be fully housebroken, that even housebroken dogs can have accidents in a new environment, and that my consistency in feeding, scheduled potty break, and supervision is crucial to avoid unnecessary accidents. I knowingly and voluntarily assume all costs and risks associated with the transition period.I understand that fostering-to-adopt a dog is a commitment until the dog is medically cleared to be adopted. In the rare and emergent situation that I am no longer able to FTA the dog, I will contact my Foster Mentor immediately and understand that CHDR has 2 weeks (not including weekends), to remove the dog from my home. I further agree to return the dog to a location designated by CHDR in this event.I understand I must use Coco's Heart Dog Rescue's Veterinary Clinic in Somerset, WI for all veterinary care. I understand that if an emergency occurs and I use a different veterinary clinic for any reasoning, I am responsible for all expenses.I covenant and agree to use an appropriately fitted collar/slip lead with attached identification when walking the dog. Dog will always be leashed when outside and only allowed to run loose in a safe, securely fenced area. I understand that dog parks introduce a liability if an issue were to arise in which either a foster dog gets hurt or a foster dog hurts another dog at the park. I understand that as the FTA,I am financially liable if an incident were to occur with a CHDR dog (or the other dog) while at a dog park. I will utilize dog parks at my own risk.I understand that all reimbursements related to CHDR must be pre-authorized by my FosterMentor. Reimbursement for mileage and/or other items must be pre-authorized by CHDR. I will contact my Foster Mentor for information regarding the reimbursement policy. Any unauthorized purchases will be considered a donation.I will check all voicemails, texts or Emails from CHDR admin or foster mentor daily and respond within 24 hours. I will follow up within 24 hours and will always ensure to carbon copy (“cc”) the CHDRAdoption Coordinator and Foster Mentor on all email correspondence between myself and CHDR.I authorize CHDR to make periodic visits as deemed necessaryI will immediately notify CHDR of any changes of my address, email, or telephone number.I acknowledge that CHDR reserves the right to terminate this agreement and reclaim the dog at any time and that I will return the dog immediately upon said request.I agree to pay the adoption fee prior to welcoming the Foster-To-Adopt and understand that only 50% of the adoption fee (not including tax or processing fees) is refundable should I not finalize the adoption of my Foster-to-Adopt. The refund will be issued per normal CHDR protocols.A penalty charge of $50 plus all applicable bank fees will be assessed for payments that are returned NSF or stopped payments. We also have the right to immediately confiscate and pursue legal channels to do so at your expense. (Including but not limited to; court fees, attorney, paralegal fees and admin fees)If the dog I am pursuing a Foster-to-Adopt for has NOT had an intake examination I understand there could be unforeseeable conditions diagnosed at the time of an intake exam. This means that there is a potential for medical conditions to be found upon examination that we are not currently aware of. I agree to follow the Foster-to-Adopt agreement in its entirety. My adoption fee (not including tax or processing fees) will be refunded minus $100.00 if I choose to not finalize an adoption for any reason (medical, behavioral, change my mind, etc...). If an animal is placed in our Mighty Mutts program, and I choose not to finalize, my adoption fee will be refunded minus $100 (not including tax or processing fee). The refund will be issued per normal CHDR protocols.I understand it is my responsibility to notify CHDR (johanna@cocosheartdogrescue.org) via e-mail within 24 hours from the intake exam to receive the adoption fee (not including sales tax or processing fee) minus $100. If 24 hours + has passed before notifying via e-mail, my adoption fee will then be 50% refunded if I chose to not move forward with the adoption. The refund will be issued per normal CHDR protocols.There will be a $50 penalty fee required immediately should I miss or no-show to a veterinary appointment. This is to cut down on the FTA who are no-showing for veterinary care appointments.I understand there is a $100 rescheduling fee for needing to cancel or reschedule a veterinary appointment within 72 hours of an appointment.I understand fostering to adopt is considered the trial period. I will not receive an additional week trial once the adoption agreement is signed.We understand accidents happen, but if the animal goes missing while in your care, we do require you immediately to contact our Lost Dog Coordinator and follow all instructions to try and safely retrieve the animal back. This can be a large time commitment. The partial adoption fee will not bere funded, even if the animal goes missing, unless the animal is safely surrendered back to Coco's HeartDog Rescue. If the animal is not found, or if the animal is found deceased, the adoption fee is not refunded.
I certify that I have read this Foster-to-Adopt Agreement in full and that I understand and agree to be bound to all the terms and conditions, including that I am giving up substantial rights by signing this document. I have had an adequate opportunity to discuss this Agreement with legal counsel of my choice, and now sign it freely and voluntarily. I understand that if I made any misrepresentation about myself, home, environment, or if I don’t abide by all of the terms and conditions of this agreement and my failure to do so in any way jeopardizes or adversely affects the health and welfare of the dog, that CHDR can terminate this agreement for FTA and reclaim the dog without notice, irrespective of any expenditures that I have made, and may pursue legal means to do so if necessary. If legal action is pursued, I am responsible for all fees included in such actions. I understand that CHDR may pursue legal means to redress any harm done to the dog. I understand that this agreement for FTA is legal and binding and will be governed by the laws of the State of Minnesota & Wisconsin.

I fully and completely release CHDR, its founder, board of directors and volunteers, from all claims and liability, including, but not limited to, any defects or illnesses the dog may have or develop, and for any injury or damage to persons, property, or other household pets, which may be caused by the dog. This includes all manner of actions and causes of actions, suits, debts, dues, accounts, bonds, covenants, agreements, judgments, claims and demands whatsoever arising from or relating to the adoption, placement, and/or possession of the dog. I further agree to indemnify and hold CHDR harmless against all claims and liability, including, but not limited to, those asserted by third parties for any injury or damage to persons or property caused by the dog. And I agree to defend, indemnify, and hold harmless CHDR from all claims, demands, losses, expenses, damages, or any liability whatsoever arising out of or related to the Animal including, without limitation, all legal expenses incurred by CHDR (including reasonable attorneys’ fees and costs) in any dispute, demand, lawsuit, administrative or other proceedings. I understand and agree that CHDR shall have the right to control its own defense and select counsel of its choice, and that I shall be responsible for any defense costs incurred by CHDR as they become due.
