In participating in the City of Sweetwater, Tennessee 150th Celebration Box Car Race Esigner does hereby, permanently and completely, waive and release any and all claims and causes of action for personal injuries or property damage which Participant might have or hereafter acquire against City of Sweetwater or the 150th Celebration Committee arising as a result of such participation.

Participant shall not hold City of Sweetwater responsible for the conditions of any altered property, the condition of equipment, the operation of the activity, the conduct of participants, or any other cause which might give rise to injury or damage to Participant.

Participant acknowledges that these activities may be physically hazardous and voluntarily assumes the risk of such injury or death.

If Participant is a minor or under legal disability, this Waiver and Release is executed on behalf of Participant by Participant's custodial parent or legal guardian.

HOLD HARMLESS AGREEMENT FOR PARTICIPANTS

This Agreement entered into as of the date of the respective signatures of the representatives of the entities hereinafter names, by and between the City of Sweetwater, Tennessee, a Municipal Corporation.

Witnesseth:

In consideration of City hosting activities upon property owned by City, specifically McCaslin Avenue for a Box Car Race ,the parties agree as follows:

1. PARTICIPANT does hereby agree to indemnify and hold harmless City and volunteers of the 150th committee for and from any and all claims of every nature whatsoever for personal injury and damages to property, for and from occurrences upon property owned by City arising out of participation by members, participants, etc., in League/Sponsor sanctioned activities.

2. PARTICIPANT further agrees that in conducting its activities on property of City that it shall for itself, its agents, employees and participants at all times be subject to and adhere to all rules and regulations of City, and all Ordinances of City.

3. PARTICIPANT further agrees that as PARTICIPANT of activities I cannot participate without a signed waiver.

4. In the event any action is brought against the City by any person for injuries or damages occasioned upon City property and/or resulting from participation on City property, in addition to the provisions hereinabove set forth, Participant agrees to be liable for and indemnify City from any and all expenses incurred by City in defending said action and to pay all costs and/or judgments which ultimately might be assessed or adjudged against City.
