DISCLAIMER
I acknowledge that I have either had a physical examination and have been given my physician’s permission to participate or that I have decided to participate in the exercise activities, programs, and use of equipment without the approval of my physician and do hereby assume all responsibility for my participation in said activities, programs, and use of equipment.
I acknowledge that I am over the age of 18.
I understand and agree to adhere to the rules and etiquette of the Concordia Fitness Centre. I acknowledge that any infraction of the rules may be cause for termination of Fitness Centre membership.
In consideration of Concordia allowing me the use of and entry into its Fitness Centre, I, the undersigned for myself, my heirs, executors, administrators, and assigns release and agree to indemnify Concordia, its respective officers, servants, agents, employees and volunteers, and each of them, from and against any claims, demands, damages, actions or causes of action (including, without limitation, those arising from any negligence or misconduct, in tort or contract but excluding willful misconduct and gross negligence), I ever had, now have or which I, my heirs, executors, administrators, or assigns, or any of them, shall or may have for known or unknown loss, damages and/or injury to person or persons or to property by reason of, arising out of or in consequence of my attending at or using the Fitness Center and all equipment and facilities associated therewith.
I am in proper physical condition to participate in any and all of those activities which I choose to engage in while in the Fitness Center, and am aware that participation could, in some circumstances, result in physical or medical injury or aggravation of any existing physical or medical condition.
I acknowledge that my attendance at and use of the Fitness Centre and all equipment and facilities associated therewith is entirely at my own risk, that I voluntarily assume the risk of all loss, damages and/or injury to person or property of any nature arising from or in connection with such attendance and use, and that no liability whatsoever shall attach to Concordia, its servants, agents or employees in respect of or arising out of my attendance or use of the Fitness Center, equipment and facilities.
I agree not to make any claim or take any proceeding against any person, firm or corporation who may claim contribution or indemnity from Concordia, its officers, directors, servants, agents, employees, and volunteers, or any of them, under the provisions of any statute or otherwise. All clauses and covenants contained in this document are severable and in the event any of them are held to be invalid by any Court, this document shall be interpreted as if such invalid clauses or covenants were not contained herein.
I acknowledge that I have read this document and fully understand the nature and consequence of signing it, and I have executed the document freely without any influence or duress by Concordia, its officers, directors, servants, agents, employees and volunteers or any of them.
