Service Overview

This pathway is for counsel seeking a confidential, behind-the-scenes expert. While some situations may seem to call for a dual-role expert, experienced litigators recognize the immense strategic value of separating the roles. As a pure consultant, Dr. Long can provide far broader and more candid analysis across all facets of the case—unconstrained by the limitations of a potential testifying role. The work performed is intended to be permanently shielded by the attorney work-product doctrine and will not lead to testimony.

Professional Role Definition

This is an exclusively non-testifying role. To protect your legal strategy and our professional integrity, once retained as a consultant under this pathway, Dr. Long will not be designated as a testifying witness in the same matter.

If there is a possibility that you will need a testifying expert, please use our separate Pathway 2: Independent Expert Witness intake form.

What This Pathway Includes

As your non-testifying consultant, Dr. Long can provide:

Strategic assessment of psychological factors affecting liability and damages.
Analysis of an opposing expert's report to prepare for cross-examination.
Guidance on witness preparation from a psychological perspective.
Full integration with your litigation team's strategy.

Engagement Options

You can engage our consultation services via one of two options:

1. Flat-Fee Psycho-Legal Case Analysis Report
Flat Fee: $3,000
This service provides a robust, structured, and privileged report that is fully adapted to the specific objectives, legal questions, and case theory you outline in your referral. It includes a thorough review of all provided records and a one-hour attorney strategy conference. Ongoing consultation beyond this initial package is billed at our standard hourly rate.

2. Standard Hourly Consultation
Engage our services on an as-needed basis under a standard retainer agreement. Ideal for ongoing support, deposition preparation, or specific, limited inquiries.

Consultant Qualifications

Dr. Long maintains licensure under the Psychology Interjurisdictional Compact (PSYPACT), authorizing telepsychological services in participating states.

Attorney Acknowledgment & Conditional Retention Agreement

By submitting this form, I acknowledge and agree to the following:

I have read and understood the service description for Pathway 1: The Strategic Consultant.
I understand this is an exclusively non-testifying role and that this designation is permanent for this matter to protect the attorney work-product privilege.
I am requesting to retain Dr. Long & Associates for either the Flat-Fee Psycho-Legal Case Analysis Report or under a Standard Hourly Consultation agreement, as will be confirmed in the formal engagement letter.
Conditional Retention: This submission constitutes my request for consultation services. Upon Dr. Long's review and written acceptance via email, this document shall automatically constitute our executed retention agreement for Phase 1 services, establishing attorney-client privilege and work-product protection from the date of acceptance. Payment of the $3,000 is due within 48 hours of acceptance.

I understand that upon Dr. Long's acceptance, this establishes a protected consulting relationship under attorney work-product doctrine, and this electronic signature shall have the same legal force and effect as a handwritten signature.
