    • APPLICATION AND ENROLMENT PROCEDURE
      • Complete this application form and submit it to Evolution ;
      • Your application will be assessed by Evolution.
      • A Student Letter of Offer and Acceptance Agreement (LOO), will be issued only if you meet admission requirements and student visa requirements as assessed by Evolution. It will be emailed DIRECTLY to you and copy your education agent. The LOO will indicate the course(s) that you are to be enrolled in with start and end dates, any prerequisites necessary to enter the course(s), tuition, non-tuition and other fees, payment terms, refund policies, any conditions and any supplementary material that imposed to your enrolment.
      • Application for recognition prior learning is also assessed upon formal request and any initial status granted will be stated in the LOO.
      • Upon receipt of LOO, if satisfied please sign and return together with payment. Please note that the LOO is valid for 7 days from the issued date. Evolution reserves the right to change or withdraw the offer after the expiry date.
      • Once you have obtained your Student Visa, you are to inform Evolution and will be able to book and pay for your flight(s) to Australia. You should arrange to arrive in Australia at least 1 week before the Course Start Date.
      • You will receive an email related to the orientation, which outlines the date, time, location & requirements. Please note that Orientation Day is considered part of your course and is COMPULSORY. You must attend to gain important information about studying at Evolution.

       

      APPLICATION AND ENROLMENT CONDITIONS
      • Evolution reserves the right at its absolute discretion to reject any applications or enrolments, along with its necessity to disclose all reasons for its decision. Evolution may, as part of the application process, interview students who have applied for Evolution courses.
      • All students are bound to comply with the conditions stated in the Evolution Student Handbook on www.evolution.edu.au, which are subject to change in times as per notification given in advance.
      • VET students who apply for courses that require Work Experience/Workplace Integrated Learning are bound to comply with the terms and conditions to ensure that they are eligible to undertake Work Experience/Workplace Integrated Learning, which is subject to change in time as per notification given in advance. The terms and conditions are available on www.evolution.edu.au. The criteria for Work Experience/Workplace Integrated Learning will also be provided in writing at the orientation before the Course Start Date and any changes to the eligibility criteria will be advised in writing throughout the program and will apply from the effective date.
      • Evolution undertakes the obligation to systematically ensure that all students update their contact details at least every 6 months including address, mobile phone, home phone, email, etc.
      • FOR STUDENT VISA LODGEMENT PURPOSES:
           • Overseas Student Health Cover (OSHC) at minimum the student must have OSHC to cover the entire duration of the courses.
           • Students must provide ALL REQUIRED DOCUMENTS when lodging their visa application.
           • Regarding ENGLISH LANGUAGE REQUIREMENTS: The DEPARTMENT OF HOME AFFAIRS may request EVIDENCE of your English language skills at any time during the processing of your application, even if the DOCUMENT CHECKLIST tool indicates that evidence is not required at the time of application. Evidence of your English language skills must be ACCEPTED by the Department of Home Affairs. The result of the VERSANT ENGLISH PLACEMENT TEST by Pearson is for EVOLUTION'S ENROLMENT PURPOSES only.
           • FAILURE TO PROVIDE THE REQUESTED INFORMATION/DOCUMENTS TO THE DEPARTMENT OF HOME AFFAIRS, WHICH LEADS TO VISA REFUSAL, WILL RESULT IN THE STUDENT BEING INELIGIBLE FOR COURSE FEE REFUND.


      PRIVACY CONDITIONS

      • Access to personal information about the student may be shared between Evolution and the Australian Government and designated authorities. This information includes personal and contacts details, course enrolment details and changes, and the circumstances of any suspected breach by the student.
      • Personal information that has been disclosed to Commonwealth and State or Territory government departments and authorised agencies and National Centre for Vocational Education Research (NCVER) for the following purposes:
           • populating authenticated VET transcripts;
           • facilitating statistics and research relating to education, including surveys and data linkage;
           • pre-populating RTO student enrolment forms;
           • understanding how the VET market operates, for policy, workforce planning and consumer information; and
           • administering VET, including program administration, regulation, monitoring and evaluation.
      • The student agrees for Evolution to obtain from a credit-reporting agency containing personal credit information about the student in relation to credit provided by Evolution.
           • to assess an application by the student; and/or
           • to exchange information with other credit providers as to the status of the student’s credit account, where the student is in default with other credit providers; and/or
           • to assess the creditworthiness of the student.
      • The student agrees for Evolution to obtain further information if necessary, from any relevant educational institution or previous employer or designated authorities as required.

    • SECTION 7: FEES, CHARGES, REFUND POLICY & PROCEDURES  
    • FEES
      • Currency is in Australian Dollars (AUD).
      • Fees Structure & Disclosure: all tuition fees, non-tuition fees and other fees are disclosed on Price Lists, Enrolment Forms and LOO.
      • Flexible Payment in paying Tuition Fees upfront. 
        o    Students and their guarantors do not need to pay more than 50% in advance; however, they can pay more if they wish.
        o    If the course duration is 25 weeks or less, the above condition will not apply. 
      • Cooling-Off Period:
        o    Students will be provided with a 3-day cooling-off period from the date of submission of the signed LOO provided the period is more than 7 days before the Course Start Date.
        o    If a student enrols into a program at Evolution 7 days or less before the Course Start Date, the cooling-off period will not apply.
        o    If a student enrols as a “Late Enrolment” into a program at Evolution after the Course Start Date, the cooling-off period will not apply. 
      • CoE will be issued after Evolution received
        o    the completed, signed & dated LOO, and
        o    fully paid initial payment (amount as stated on the LOO and Tax Invoice), and
        o    all additional required document(s).
      • Bank Fees and Surcharges: the student will need to pay for any bank fees and surcharges.
      • Tax Invoice will detail the course name, amount, any relevant tax portions, and the due dates. 
      • Overpayment: if a student pays a greater amount of their tuition fees than invoiced, then Evolution will credit the excess into the next instalment. If it is an overpayment of the total tuition fee, the excess amount will be refunded.
      • Recognition of Prior Learning: refer to Incidental Fees & Charges.
      • Airport Pickup and/or Organise Accommodation: students will organise these services with their agents. If they do not have one, Evolution can recommend a third party.
      • Fees Protection: the unspent tuition fee is protected under The Tuition Protection Service (TPS) scheme. Evolution has designated account(s) to hold tuition fee payments from international students who have not yet commenced their course.
      • Tuition Fees Due Date: students and their guarantors must pay the tuition fee, by the due date; and provide a receipt as proof of payment that the student is confirmed as enrolled in the next study period (for continuing students) or before CoE(s) is issued (for new students).
      • Unpaid Fees may result in students being excluded from participating in their program or not receiving testamurs or academic transcripts until the outstanding fees are paid. Where fees remain unpaid, Evolution is required to follow the process of cancelling a student’s enrolment due to non-financial.
      • Late Payment Fees on outstanding fees applies after the due date. Please refer to Incidental Fees & Charges.
       
      REFUND ENTITLEMENT
      • Refunds:
        o    will only be processed for the amount paid.
        o    will be deducted if the student owes outstanding debts to Evolution.
        o    will be credited to the student’s account or as stated on the Cancellation/Refund Application Form.
        o    requests must be made in writing, and the signature needs to match that on the passport.
        o    will be calculated according to the ESOS Act and related regulations, legislative instruments, and standards. 
      • Course fee is not refundable if:
        o    The student fails to comply with the conditions of enrolment at Evolution.
        o    The student breaches the visa requirements imposed by the Australian government.
        o    The student provides false, inaccurate, or misleading information.
        o    The student fails to provide information and/or documents as requested by the Department of Home Affairs.There is an unexpected interruption in services due to events such as staff strikes, natural disasters, pandemics, critical incidents, or other similar events outside Evolution’s control that result in the cancellation of classes. In such cases, Evolution will arrange alternative classes to ensure course completion.
       
      PROVIDER DEFAULT
      Evolution arranges
      1. for the student to be offered a place in an alternative course at Evolution’s expense, if the student accepts the offer in writing,
      OR
      2. Evolution issues a refund of the amount worked out under the legislative instrument of any unspent pre-paid fees received by Evolution in respect of the student.
      Refund amount = Weekly Tuition Fee x Weeks in default period
       
      If Evolution does not find the student a suitable course or offer a refund within 14 days, the TPS will help the student.

      Evolution provides education services in good conscience, with the provision to exercise discretion in compassionate or compelling circumstances which are outside of an individual's control. 
      Referring to student default; ESOS Act 2000, Section 47A (1) (c), the registered provider of the course refuses to provide, or continue providing, the course to the student at the location.

      100% of paid tuition fees will be held for up to 12 months.
      After the Current Study Period commences any unspent tuition fees will be held for up to 12 months.
      Once the 12 months after deferment lapses, the fee will be forfeited. A student is required to re-apply.
       
      COURSE CHANGE ENTITLEMENT

      Before the Current Study Period commences 100% of paid tuition fees will be transferred to the new course(s).
      After the Current Study Period commences any unspent tuition fees will be transferred to the new course(s).
      A course change request is subject to availability. If the fee for the new course is greater than the original course, students must pay the difference before the new CoE(s) are issued. Any promotions and scholarships cannot be transferred to the new course(s).
    • SECTION 8: COMPLAINT, APPEALS & DISCLAIMER

      • Complaints and appeals should be made in accordance with the Complaints and Appeals Policy.
      • The right to make complaints and seek appeals of decisions and action under various processes does not affect the rights of the student to take action under the Australian Consumer Law if the Australian Consumer Law applies.

      • Evolution will not accept any liability for any unexpected interruption in services through events such as staff strikes, natural disasters, critical incidents, and other similar events which cause the cancellation of classes. Evolution will arrange alternative classes for the students to ensure course completion.

      • I have read, understood and will abide by the terms and conditions in the Fees, Charges & Refund Policy & Procedures and the Code of Conduct and Code of Practice outlined in the Student Handbook and marketing material including Course Brochures and understand the courses entry requirements, including English language requirements available on Evolution Website;
      • I agree to be bound by Evolution’s rules and regulations; acknowledge that all disputes arising from the details and conditions contained in the application shall be governed by and constructed following the laws of Australia and be submitted to the jurisdiction of the courts of Australia;
      • I authorise Evolution to obtain further information if necessary, from any relevant educational institutions or previous employers as required;
      • I may receive several student surveys from government bodies and Evolution;
      • I need to request and be issued a formal Letter of Release to formally withdraw from the course, and I must gain a Letter of Release from Evolution if I want to withdraw and transfer to another provider before completing 6 months of my principal course of study;
      • I understand that I will receive confirmation of my timetabled class in the student portal before the commencement of the corresponding study period;
      • I permit for my image, testimony or written comments to be used in Evolution's marketing material, website and social media;
      • I give consent for Evolution to provide my Education Agent with personal information and notifications that pertain to my continued studies;
      • I allow Evolution to contact me (including but not limited to e-mail, phone calls, and SMS) regarding course requirements;
      • I must update my contact details, including e-mail, mobile phone numbers, residential address and emergency contact details with Evolution;
      • I have read and consented to the collection, use and disclosure of my personal information according to the information detailed in USI Privacy Notice;
      • my personal information may be disclosed by Evolution to any Government and designated authorities (Commonwealth and State or Territory government departments and authorised agencies);
      • I declare that I have read and clearly understood this application before signing;
      my signature is true and correct and matches the signature in my passport;
      • If I instruct an agent to complete this application form on my behalf, I do so on the basis that the agent is acting for me and it remains my responsibility to read the Terms and Conditions of Enrolment.
