PRIVACY CONDITIONS
- Access to personal information about the student may be shared between Evolution Hospitality Institute (EHI) and the Australian Government and designated authorities. This information includes personal and contact details, course enrolment details and changes, and the circumstances of any suspected breach by the student.
- Personal information that has been disclosed to Commonwealth and State or Territory government departments and authorised agencies and National Centre for Vocational Education Research (NCVER) for the following purposes:
  - populating authenticated VET transcripts;
  - facilitating statistics and research relating to education, including surveys and data linkage;
  - pre-populating RTO student enrolment forms;
  - understanding how the VET market operates, for policy, workforce planning and consumer information; and
  - administering VET, including program administration, regulation, monitoring and evaluation.
- The student agrees for EHI to obtain from a credit-reporting agency containing a personal credit information about the student in relation to credit provided by EHI.
  - to assess an application by the student; and/or
  - to exchange information with other credit providers as to the status of the student’s credit account, where the student is in default with other credit providers; and/or
  - to assess the credit worthiness of the student.
- The student agrees for EHI to obtain further information if necessary, from any relevant educational institution or previous employer or designated authorities as required.
COMPLAINT & APPEALS
- Complaints and appeals should be made and will be addressed consistently with the Grievance, Complaints and Appeals Policy.
- The right to make complaints and seek appeals of decisions and action under various processes, does not affect the rights of the student to take action under the Australian Consumer Law if the Australian Consumer Law applies.

- I agree to be bound by EHI’s rules and regulations, and acknowledge that all disputes arising from the details and conditions contained in the application shall be governed by and constructed in accordance with the laws of Australia and be submitted to the jurisdiction of the courts of Australia.
- I understand that I may receive a NCVER student survey.
- I authorise EHI to obtain further information if necessary, from any relevant educational institutions or previous employers as required.
- I confirm that I understand and accept that my personal information may be issued by EHI to any Government Agency for the purposes of monitoring our RTO compliance and standards of training and assessment. The Information contained on my enrolment form may be used by my RTO for administrative, regulatory and research purposes:
  - Government departments and agencies and authorised VET related bodies
  - VET regulators
- I give permission for my image, testimony or written comments to be used in EHI's marketing material, website and social media.
- I agree not to post (on any form of social media) negative or misleading information that may cause harm to persons or to EHI as a provider of training and assessment.
- I allow EHI to contact me by e-mail and/or SMS regarding course requirements.
- I understand that I must update my contact details, including e-mail, mobile phone numbers and residential address with EHI during my enrolment.

understand and agree that, under the National Vocational Education and Training Regulator (Data Provision Requirements) Instrument 2020, Evolution Systems for Training & Development Pty Ltd (t/a Evolution Hospitality Institute) is required to collect personal Information (Information or an opinion about me), collected from me, my parent or guardian, such as my name, Unique Student Identifier, date of birth, contact details, training outcomes and performance, sensitive personal Information (including my ethnicity or health information) and other enrolment and training activity-related Information (together Personal Information) and disclose that Personal Information to the National Centre for Vocational Education Research Ltd (NCVER).

My Personal Information (including the personal Information contained on my enrolment form and my training activity data) may be used or disclosed by Evolution Hospitality Institute for statistical, regulatory and research purposes. Evolution Hospitality Institute may disclose my personal Information for these purposes to third parties, including:

• School – if I am a secondary student undertaking VET, including a school-based apprenticeship or traineeship;

• Employer – if I am enrolled in training paid by my employer;

• Commonwealth and State or Territory government departments and authorised agencies, including the NSW Department of Education (Department);

• NCVER;

• Organisations (including the Department) conducting student surveys; and

• Researchers.

Personal Information disclosed to NCVER may be used or disclosed for the following purposes:

• issuing a VET Statement of Attainment or VET Qualification, and populating Authenticated VET Transcripts;

• facilitating statistics and research relating to education, including surveys;

• understanding how the VET market operates, for policy, workforce planning and consumer information; and

• administering VET, including program administration, regulation, monitoring and evaluation.

I may receive an NCVER student survey which may be administered by an NCVER employee, agent or third party contractor. I may opt out of the survey at the time of being contacted.

NCVER will collect, hold, use and disclose my Personal Information in accordance with the Privacy Act 1988 (Cth), the VET Data Policy and all NCVER policies and protocols (including those published on NCVER’s website at www.ncver.edu.au).

The Department may disclose my Personal Information to other Australian government agencies, including those located in States and Territories outside New South Wales.

The above government agencies may use my Personal Information for any purpose relating to the exercise of their government functions, including but not limited to the evaluation and assessment of my training, the determination of my eligibility to receive subsidised training or for any Fee Exemptions or Concessions. My Personal Information may also be disclosed to other third parties if required by law.

I also acknowledge and agree that the Department may contact me by telephone, email or post, during or after I have ceased subsidised training with Evolution Hospitality Institute for the purposes of evaluating and assessing my subsidised training.
