  • in favor of Esperanza, together with their respective past, present, and future parents, subsidiaries, affiliates, successors, assigns, directors, officers, employees, agents, contractors, and volunteers (collectively, “Released Parties”).


    The Volunteer desires to serve as a volunteer for Esperanza and engage in the activities related to being a volunteer (the “Activities”). The Volunteer understands that the Activities may include construction, deconstruction, rehabilitating buildings, working in the communities, working at special events, experiences to encounter Mexico, the culture and people, and living at Posada Esperanza.

  • PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!

    The Volunteer hereby freely, voluntarily, and without duress executes this Release under the terms below:
  • 1. Release and Waiver

    Volunteer does hereby release, waive, and covenant not to sue the Released Parties from and against any and all liability, claims, demands, actions, or causes of action of whatever kind or nature, in law or in equity, known or unknown, suspected or unsuspected (including those under California Civil Code §1542, which Volunteer expressly waives), which arise or may hereafter arise from or relate to Volunteer’s Activities with Esperanza, excluding only claims that cannot be released as a matter of applicable law. Volunteer understands that this Release discharges the Released Parties from any liability or claim that the Volunteer may have with respect to any and all bodily injury, personal injury, illness, death, or property damage that may result from Volunteer’s Activities with Esperanza, including arising from the ordinary negligence of any Released Party, but excluding gross negligence, willful misconduct, or claims that cannot be released as a matter of law. Volunteer also understands that Esperanza does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness, and Volunteer is solely responsible for all costs associated with any injury, loss, or damage arising from the Activities.

    VOLUNTEER UNDERSTANDS THAT THIS RELEASE DISCHARGES ESPERANZA FROM ANY LIABILITY OR CLAIM THAT THE VOLUNTEER MAY HAVE AGAINST ESPERANZA WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM VOLUNTEER'S ACTIVITIES WITH ESPERANZA, WHETHER CAUSED BY THE NEGLIGENCE OF ESPERANZA OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS OR OTHERWISE. VOLUNTEER ALSO UNDERSTANDS THAT ESPERANZA DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.

  • 2. Medical Treatment

    Volunteer authorizes the Released Parties to obtain emergency medical or dental treatment deemed necessary by medical professionals and consents to such treatment; Volunteer does hereby release and forever discharge the Released Parties from any claim whatsoever arising out of or related to any first aid, treatment, or service rendered in connection with the Volunteer’s Activities with Esperanza, excluding claims resulting from gross negligence or willful misconduct.

  • 3. Assumption of Risk

    The Volunteer understands that the Activities include work that may be hazardous to the Volunteer, including, but not limited to, physical labor, construction, loading and unloading, equipment operation, transportation, exposure to tools, heavy machinery, uneven terrain, weather conditions, vehicular travel, and cross-border travel risks. The Volunteer hereby expressly and specifically assumes all such risks and releases the Released Parties from all liability for injury, illness, death, or property damage resulting from the Activities to the fullest extent permitted by law.

  • 4. Insurance

    The Volunteer understands that Esperanza does not carry or maintain health, medical, disability, workers’ compensation, or unemployment insurance coverage for any Volunteer. Each Volunteer is required to maintain valid primary medical insurance and to obtain traveler’s medical insurance (including coverage for emergency evacuation and repatriation) while the Volunteer is working in Mexico, and to provide proof of such coverage upon request.

  • 5. Photographic Release

    Volunteer does hereby grant and convey unto Esperanza a perpetual, worldwide, royalty-free license to use, reproduce, display, distribute, and create derivative works from any photographic images and video or audio recordings made during the Volunteer’s Activities with Esperanza for promotional and organizational purposes, without further approval or compensation.

  • 6. Indemnification

    Volunteer shall indemnify, defend, and hold harmless the Released Parties from and against any and all losses, costs, expenses, liabilities, damages, fines, penalties, and reasonable attorneys’ fees and costs of investigation arising out of or relating to: (a) Volunteer’s acts or omissions (including violation of laws or site rules); (b) injury to persons or damage to property caused by Volunteer; or (c) any claim by third parties related to Volunteer’s participation in the Activities, except to the extent finally determined to have been caused by the gross negligence or willful misconduct of a Released Party.

  • 7. Other

    Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California and that this Release shall be governed by and interpreted in accordance with the laws of the State of California, without regard to its conflicts-of-law principles, and any dispute shall be brought exclusively in the state or federal courts located in San Diego County, California, and the parties consent to personal jurisdiction and venue therein. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

  • 8. COVID-19 Prevention and Requirements

    I hereby agree to follow Esperanza’s COVID-19 and communicable disease policies as outlined on its website, which may be updated from time to time, and acknowledge such policies are incorporated by reference. I understand that there is no direct medical health coverage afforded to me by Esperanza International during my trip. I acknowledge that I will follow these guidelines whether in the United States or Mexico. Volunteer assumes the risk of, and releases the Released Parties from, any claims arising from exposure to COVID-19 or other communicable diseases in connection with the Activities, to the fullest extent permitted by law.

  • 9. Data Protection & Privacy Policy

    By signing, I acknowledge that I have read and agree to Esperanza International’s Data Protection & Privacy Policy and consent to the secure collection, cross-border transfer, and use of my information for volunteer coordination and safety purposes, subject to my rights under applicable law.

  • I agree to comply with the written instructions above. Failure to comply with these written instructions or verbal instructions from staff may result in my volunteer privileges being removed and I may be asked to leave the premises.

     

    By signing below, the Volunteer and, if applicable, the parent/guardian, acknowledges having carefully read this Release, understands its terms (including the assumption of risk, release of claims, and indemnification), and signs it voluntarily with full knowledge of its legal effect.
