Non-Commercial Commission Terms of Service

General Terms:

Prices are subject to change based on demand, and Gavin has the right to reject any request for any reason.

Payment:

Currency accepted in USD and can be paid through PayPal, Venmo, or another mutually approved method/payment platform. The full payment is due before the start of the commission; Don't send any payment before I, Gavin Hester (the artist) have agreed to give you a slot and have requested that you send payment.

Copyright & Usage:

- I, Gavin Hester (The Artist): Reserve the right to cancel and refund the order at any time for any reason; retain all copyrights over commissioned artwork; will not claim the intellectual property (IP) of the commissioned artwork; will not directly profit further from the commissioned artwork unless you (the customer) break any of the terms OR grant Gavin permission otherwise; reserve the right to post the commissioned artwork online, in my portfolio, on Patreon, and in publications such as but not limited to art books.
- You (the commissioner): may upload the commissioned artwork on any website and social channels; may not make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, making prints, etc.); may not alter the commissioned artwork without Gavin's consent; retain the rights to the IP; may NOT use the commissioned artwork for commercial purposes.
- The commissioned art is not to be used for, with, or in Ai in any way without Gavin's written and verbal consent.

Cancellation & Refund Policy:

The buyer is not allowed a full refund once Gavin has started working on the commission. If for any reason Gavin is unable to start your commission, you will receive a full refund; if you cancel your order before Gavin starts it, you can get a full refund.
