GGDR Foster Waiver

This Liability Waiver and Release Agreement (the "Agreement") is entered into as of the date of signature by the undersigned (the "Participant or Foster") and is made in favor of Shelley Gilmore, Antonio Gilmore, Gilmore Gardens Dog Rescue LLC 501(c)(3), and Dog Friendly NC LLC (collectively referred to as "the Organizations").

 

1. Acknowledgment of Risks

The Participant acknowledges that working for, with, or volunteering time for the Organizations involves potential risks, including but not limited to:

- Dog bites or other dog-related injuries;

- Any injuries sustained while working, volunteering, or engaging in activities related to the Organizations;

- Property damage or loss related to activities with the Organizations;

- Any other injuries or damages related to the handling, care, or interaction with animals under the Organizations' care.

2. Release and Waiver of Liability

The Participant, on behalf of themselves, their heirs, successors, assigns, and legal representatives, hereby releases, waives, and discharges the Organizations and their owners, directors, officers, employees, volunteers, and agents from any and all liability, claims, demands, or causes of action arising out of or related to participation in activities associated with the Organizations.

3. Assumption of Risk

The Participant acknowledges and voluntarily assumes all risks associated with activities related to the Organizations, including any risks of personal injury, death, disability, property damage, or any other harm that may result from such activities.

4. Indemnification

The Participant agrees to indemnify and hold harmless the Organizations from and against any and all claims, losses, liabilities, damages, costs, or expenses (including attorney’s fees) arising from their participation in the Organizations' activities.

5. Binding Effect & Termination

This Agreement shall be valid and enforceable from the date of signature and shall remain in full force indefinitely unless terminated in writing by both parties. Any modification or termination of this Agreement must be made in writing and signed by both the Participant and an authorized representative of the Organizations.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Organizations operate.

7. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

 

Participant Acknowledgment & Signature

By signing below, the Participant acknowledges they have read and fully understand this Agreement and voluntarily agree to its terms.
