Event will provide a minimum of 1 port-a-jon per 20 participants on Grand Overland.  If the riverside picnic area is used, one port-a-jon must be placed at the field's edge near the river area entrance.  Otherwise, port-a-jons may be placed near the buildings for ease of location by vendors, and central to the trail system.
            
Event will carry a minimum of one million dollars insurance to cover all aspects of the event.  A copy of the insurance policy, with Grand Overland named as additional insured will need to be on file before any aspect of the event may begin.  The Event Organizers and organization HEREBY RELEASES, DISCHARGES, WAIVES, INDEMNIFIES, AND HOLDS HARMLESS Grand Overland District, LLC, its owners, heirs, officers, manager, members, agents, employees, and other participants, sponsors, and owners or lessors of the premises used for the event. (hereinafter individually and collectively referred to as "Releasees"),  WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, loss or damage to  person or property related in any way to Participant’s presence on any property owned, leased, or operate by Grand Overland, or participation in the Event, whether arising in Contract or tort, including the negligence of the Releasees or any other cause to the fullest extent permitted by law.
            
Event organizer agrees to supervise and exercise control over event activities, using trustworthy guides and coordinators to ensure activities are maintained within the guidelines of Grand Overland.  Timed events are prohibited as they routinely result in excessive damage to property and trails.  Events will be operated with a priority for operator safety, vehicle protection, and property and trail preservation.
            
The Event agrees that any claim or dispute arising out of or related to this Agreement or any activity covered by this Agreement, whether asserted in CONTRACT OR TORT, including claims or disputes alleging negligence, gross negligence, willful conduct or any other cause, shall be submitted to BINDING  ARBITRATION in accordance with the North Carolina Revised Uniform Arbitration Act.
            
This Agreement shall be governed and construed in accordance with the laws of the State of North Carolina, and the exclusive jurisdiction and venue for the litigation or arbitration of any claim or dispute arising out of or related to this Agreement and any activity covered by this Agreement shall be in the State or Federal Courts located in Montgomery County, North Carolina.
