Exterior Maintenance (Guidelines & Standards; Page #15) : Each Owner shall maintain his or her Lot and the improvements and landscaping thereon in good repair.
-Garbage Containers/Screenings(Arch Guidelines- Pages 17-20) Where garbage bins are not placed inconspicuously, and are located where visible to street views, garbage storage shed or screening is required against the side of the house. Horizontal Storage shed and Screening (maximum height of 6 feet) require approval by ACC. Dimensions of Storage bins and screening structures must be limited to contain bins only (two 96 gallon bins, approximately 6 feet wide and 4 feet tall). Permanent structures, including a custom design screen should match the aesthetics of the home in terms of design, including color scheme and materiality. Some approved containers are listed in the guideline. If approved containers or screens listed are not available or desired, a similar type and design can be submitted for approval. Please note the screen panel sizes below: homeowner may need to purchase a minimum of three panels to cover the width of two garbage bins.
Inoperable Vehicles (Guidelines & Standards; Page #16) : No inoperable or wrecked vehicles of any type are allowed on the Property, either temporarily or permanently. No repairs to any vehicles or other personal property shall be made in parking spaces or driveways, except in the case of emergency.
-Lawn Maintenance (Guidelines & Standards; Page #11) : Grass, hedges, shrubs, vines and mass planting of any type on any Lot or any portion of the Property shall be kept trimmed and shall at regular intervals be mowed, trimmed and cut so as to appear neat and attractive. It shall be each Owner’s responsibility to water the lawn and the plants on its Lot at regular intervals. Trees, shrubs, vines and plants which die shall be promptly removed. No leaves, trash, garbage or other similar debris shall be burned.
Parking/Storage of Prohibited Vehicles (Guidelines & Standards; Page #8-9) : No vehicles of any type shall be parked on the streets right of way within the Property, except for short term guest parking. Short term is defined as 6 or less hours. No vehicle shall be parked or stored on any part of the Lot other than in the garage or driveway of such Lot. No vehicle may be parked on or across any sidewalk or any part of a Lot other than in areas improved for that purpose. No boat, trailer, recreational vehicle, camper, camper truck, utility trailer, other water crafts, commercial or recreational vehicles may be parked, stored or left on any portion of the Property.
-Sports Equipment (Guidelines & Standards; Page #6): The placement of a basketball goal requires prior approval of the ACC. Permanent basketball goals are to be placed on the rear third (toward the house) of the driveway or parking pad and must be mounted on a single pole cemented into the ground. Portable basketball goals 1) may not be stored on common area; 2) must remain upright at all times; 3) must not impede on neighboring lots, traffic or pedestrians in any way; and 4) may not create a noise nuisance.
Unapproved Exterior Change (Covenants; Article 13.01): No building, swimming pool, spa, statuary, flag pole, mailbox, basketball goal or other sports equipment, play equipment, fence, wall, gazebo, or any other structure or improvement shall be placed, erected, commenced, constructed, demolished, rebuilt or altered upon any Lot or attached or affixed to any improvement upon any Lot or upon the Common Area nor shall any exterior addition to or change or alteration of a residence building be made...until an application, including plans and specifications showing the nature, kind, shape, height, materials, finishes, colors and location of the same shall have been submitted to and approved in writing by the Architectural Control Committee. No window mounted AC units.
Exterior Lighting/ Holiday Light- Rules and Regulations- Except for seasonal holiday decorative lighting, all significant exterior lighting changes must be approved by the ACC. The ACC may take into consideration the visibility and style of the fixture and its location. Exterior lighting shall be shielded and must be directed so as not to shine directly on another Lot. Holiday lights should be removed no later than one (1) month after the holiday.
Pets & Animal Control- Rules & Regulation v.2023 Section D-The Board may adopt a rule prohibiting certain pets, except that such rule shall not apply to animals residing in the Lake Castleberry neighborhood at the time such rule is adopted.● All animals must be kept on a leash when in Common Areas and public areas.● Owners must clean up after their pets, including, but not limited to Owner Lots, CommonAreas, streets, right-of-ways, sidewalks, buffer areas, etc. Feces, including baggedexcrement, may not be left on any surfaces other than the Owner’s Lot● Animals shall not be permitted to reside solely outdoors in an enclosed yard.● No animal, including domesticated cats, shall roam free within the Common Areas andotherwise shall be kept on an overnight basis within homes. This requirement supersedesany other language contained in the Declaration.● No animals, livestock, or poultry of any kind shall be kept or maintained on any portion ofthe Lake Castleberry neighborhood or in any home except that dogs, cats or other household pets may be kept or maintained provided that they are not kept or maintained for commercial purposes, that they do not create a nuisance (in the judgment of the Board), such as, but without limitation, by number, noise, odor, damage or destruction of property or refuse, and further provided that they are kept and maintained in compliance with all laws and ordinances of applicable governmental authorities relating thereto. In no event shall more than a total of three (3) dogs and/or cats be regularly kept on any Lot except for newborn offspring of such household pets which are under nine (9) months in age. The Board may prohibit or require removal of any dog or animal, which after consideration of factors such as size, breed and disposition of the animal, interferes with the peaceful enjoyment by other Owners of their Lots, and the security measures taken by the Owner with respect to such animal, the Board, after affording the Owner of such animal Notice and Opportunity for Hearing, deems to be undesirable, a nuisance or a safety hazard.
