WAIVER AND RELEASE OF LIABILITY FOR GPN PROGRAMS
In exchange for use of the property/facilities of Great Park Neighborhoods Community Association (“GPN”) at Irvine, CA, I, on behalf of myself, and/or as the parent/guardian for FULL NAME* (“Member Participant”), of * agree to the following:
I/Member Participant acknowledge that services and/or activities (hereinafter “services”), are provided by (“Instructor”). The services and/or activities are NOT provided by GPN.I/Member Participant agree to observe and obey all posted rules and warnings in regards to the CC&R’s, and further agree to follow any oral instructions or directions given by GPN, or the employees, representatives or agents of GPN.
I/Member Participant recognize that there are certain inherent risks associated with the activity provided by Instructor and I assume full responsibility for personal injury to myself and further release and discharge GPN for injury, loss or damage arising out of my use of or presence upon the facilities of GPN, whether caused by the fault of myself, GPN or other third parties. Such waiver is not intended to waive gross negligence by GPN.
I/Member Participant agree to indemnify and defend GPN against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my use of or presence upon the facilities of GPN and/or in connection with the activity/service provided by Instructor.I/Member Participant agree to pay for all damages to the facilities of GPN caused by my negligent, reckless or willful actions.I/Member Participant agree to be photographed as a participant of the instructions for publicity uses including, but not limited to, newsletters, websites, newspapers, and any and all GPN promotional materials. I further agree that I will not receive any compensation for such use of my likeness, name, quotations and/or photographs.Any legal or equitable claim that may arise from participation in the above shall be resolved under California law.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
