ASSUMPTION OF RISK, RELEASE FROM LIABILITY AND AGREEMENT (the “RELEASE AGREEMENT”)
A. EVENT: The undersigned (the “Participant”) is executing this RELEASE AGREEMENT in connection with the Participant’s voluntary services at the David Weekley Serce Day (“HomeAid North Texas Event”), which is sponsored by HomeAid North Texas, whose address is 2800 Highway 121, Suite 1000 #1014, Euless, TX 76039.
B. EVENT LOCATION: The HomeAid North Texas event is taking place on Friday, May 5th, 2026 at CleanUp USA, located at 1760 E Airport Fwy, Irving, TX 75062 (the “Property”).
C. VOLUNTEER STATUS: The Participant has applied to volunteer and participate in the HomeAid North Texas event, and HomeAid North Texas has agreed to allow the Participant to volunteer and participate in the same, subject to the terms and conditions contained in this RELEASE AGREEMENT. Participant acknowledges and
agrees that Participant is not an employee or contractor of HomeAid North Texas and shall not receive any monetary compensation, including any wages, for the time, services and/or labor that Participant provides towards the HomeAid North Texas event.
D. TASKS: Participant’s volunteer tasks are expected to include one or some of the following: Building wooden bed frames, assembling items into care kits, and prepping and painting a bus.
E. DIRECTION: Participant agrees to follow all direction provided by HomeAid North Texas, including but not limited to, the scope of tasks assigned and the hours of service as defined by HomeAid North Texas. Unless permitted by HomeAid North Texas, Participant agrees that Participant will conduct no other work or business while volunteering at the HomeAid North Texas event.
F. NO HARM TO OTHERS OR PROPERTY: Participant agrees that Participant will not cause any physical harm to any person or property while volunteering for the HomeAid North Texas event. Participant acknowledges and agrees that HomeAid North Texas will not defend, indemnify or otherwise be responsible for any harm to any person or property caused by the acts or omissions of Participant.
G. ASSUMPTION OF RISK: Participant acknowledges and understands that participation at the HomeAid North Texas event as a volunteer may, due to the acts or omissions of other persons, participants or organizers of said HomeAid North Texas event, involve the risk of personal or psychological injury, pain, suffering, temporary or permanent disability, death, property damage, and/or financial loss to Participant. Further, Participant is also aware that Participant may be exposed to, or contract, a medical disease (such as that resulting from COVID or other bacterial or viral agents) (hereafter “Disease”) by being on the Property and engaging in the HomeAid North Texas event, which may result in illness, personal or psychological injury, pain, suffering, temporary or permanent disability, death, property damage, and/or financial loss. Participant acknowledges that these risks may result from, or be compounded, by the actions, omissions, or negligence of others, including other volunteers, persons acting on behalf of HomeAid North Texas, and/or emergency response or rescue operations conducted at the HomeAid North Texas event. Participant understands that HomeAid North Texas cannot and does not guarantee that Participant will not be injured or become infected with the Disease while on the property and/or during Participant’s participation in the HomeAid North Texas event.
NOTWITHSTANDING THESE RISKS, PARTICIPANT ACKNOWLEDGES THAT PARTICIPANT IS VOLUNTARILY COMING ONTO THE PROPERTY AND PARTICIPATING IN THE HOMEAID NORTH TEXAS EVENT WITH FULL KNOWLEDGE OF THE RISKS INVOLVED. PARTICIPANT HEREBY AGREES, ACCEPTS AND ASSUMES ALL RISKS OF ILLNESS, PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS ARISING THEREFROM, WHETHER CAUSED BY HOMEAID NORTH TEXAS OR OTHERS. THE PARTICIPANT HEREBY AGREES TO ACCEPT AND ASSUME ANY AND ALL SUCH RISKS TO THE PARTICIPANT BY SIGNING BELOW.
H. RELEASE OF LIABILITY; INDEMNIFICATION – In consideration for being permitted to participate in the HomeAid North Texas event as a volunteer, Participant agrees on his/her/their behalf and on behalf of any of the Participant's assignees, heirs, executors, guardians, successors, legal estate, family members, and legal representatives of the Participant (collectively, the “Releasing Parties”), to release and hold harmless HomeAid North Texas and each of its past, present and future respective officers, directors, representatives, heirs, executors, administrators, successors, assigns, agents, attorneys, affiliates, subsidiaries, partners, coventurers, owners, other volunteers, and employees (the “HomeAid Released Persons”) from and against any and all claims, actions, causes of action, demands, rights, damages, obligations, liabilities, cost and expenses (including without limitation attorney’s fees, court costs and litigation expenses) (collectively, the “Liabilities”) for injury or damage arising out of, or in any way relating to, the acts or omissions of HomeAid North Texas, the HomeAid Released Persons or any other participant or volunteer in the HomeAid North Texas event, including, any
first aid or medical treatment that the Participant may receive at the HomeAid North Texas event, or any other injury or damage that might otherwise result from the Participant's participation in the HomeAid North Texas event. In addition, Participant agrees to indemnify, defend, and hold harmless HomeAid North Texas and any HomeAid Released Persons from any and liabilities and claims arising from or related to Participant’s conduct, acts or omissions while a volunteer at the HomeAid North Texas event.
I. HEALTH INSURANCE – The Participant understands that HomeAid North Texas does not carry or maintain health or disability insurance coverage for any participant in the HomeAid North Texas event. EACH PARTICIPANT IS EXPECTED AND ENCOURAGED TO ARRIVE WITH HEALTH INSURANCE COVERAGE IN EFFECT.
J. PHOTO RELEASE – Participant understands and agrees that HomeAid North Texas may use, copy, distribute, share, or otherwise make available, for its own purposes in electronic or print format, as it sees fit in its sole discretion, any and all photographs, video and audio components taken of participant during this HomeAid
North Texas event. Participant also consents to the use of Participant’s name together with statements, if any, given by Participant, in connection with any use by HomeAid North Texas. Participant further agrees that all rights, title, interests, and ownership of all materials prepared by HomeAid North Texas which may include part of full photographs and/or video of Participant shall belong exclusively to HomeAid North Texas for all purposes and uses whatsoever and without compensation.
K. MISCELLANEOUS – The Participant expressly agrees that the Assumption of Risk and Release provisions above are intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that this RELEASE AGREEMENT shall be governed by and interpreted in accordance with the laws of the State
of Texas. In the event that any phrase, clause, sentence, paragraph, other portion of this RELEASE AGREEMENT shall be deemed null or void for any reason by Court of competent jurisdiction the remaining portions of this RELEASE AGREEMENT shall not be affected thereby and shall remain in force and effect to the full extent permissible by law.
