Terms and Conditions:
Should my bank or credit card issuer not honor my paid in full renewal, I realize I am responsible for the payment plus any service charge applied by the SIJCC.
In the event I need to cancel my membership, I will give a minimum of 30 day’s written notice and will get a prorated refund in full monthly increments on the remainder monies originally paid in full for the year.
Dues/membership are subject to cancellation and termination of rights set forth in this agreement after the 3-day buyer’s right to cancel.
MEMBERSHIP AGREEMENT TERMS
1. GENERAL PROVISIONS: The types of memberships available, the applicable fees, the suspension, cancellation and expulsion of members, and all other matters affecting or relating to the members or membership (except to the extent expressly governed by this agreement) are solely within the discretion of the Jewish Community Center. Member agrees to abide by all published rules and regulations issued and as amended from time to time by JCC management. No membership shall be denied or conditioned based upon race, creed, religion, gender or national origin.
2. MEMBER’S RISK/LIABILITY LIMITATION: Member acknowledges that engaging in physical activities including exercise programs and recreational sports, presents inherent risk of physical injury. Member assumes all risk of such injury and of any aggravation or consequential complications arising out of any pre-existing physical conditions, which may result from the member’s activities at the JCC, including use of the JCC’s facilities and equipment. Except as may result from the negligent or wrongful act of any employee, agent or authorized representative of the JCC, neither JCC or any of its affiliates, subsidiaries, parents, employees, agents or contractors shall have any liability to the member or any guest or invitee of the member for any claims, demands, damages, injuries, rights or causes of action, present or future, resulting from or arising out of the use of the JCC by the member or such member’s guest or invitee. Member shall be responsible for any improper, destructive or abusive conduct of any guest or invitee of the member. Members are cautioned against bringing valuables onto the premises. All personal effects, automobiles, and other property brought by the member onto the JCC premises shall be solely the member’s responsibility, and the JCC shall not be liable for any damage, destruction, theft or other loss of such personal property.
3. MEMBERSHIP: All memberships are non-proprietary, non-voting and non-assignable by a member. Membership is not transferable. Membership will be automatically renewed unless otherwise noted in writing no less than sixty (60) days prior to the initial annual anniversary date of the membership. After the initial first year of the agreement, annual EFT’s are automatically renewed on either the 1st or 15th of the month unless notified in writing to the Membership Services Director 30 days prior to the desired termination date. There are no refunds of membership fees. All members will receive an ID card/key fob. It is required that this card/fob be swiped upon entering the building as well as at all Sports & Wellness areas. If the membership card/fob is lost or stolen, the member must notify the JCC immediately. Cards/fobs will be replaced at the cost of $15 each. Misuse of your card/fob or permitting another person to use the card/fob shall be cause for the termination of membership without refund.
4. ACT OF GOD: In the event that the JCC is unable to perform its obligations under this Agreement as a result of a force majeure, the JCC shall not be liable for direct or consequential damages resulting from lack of performance. “Force Majeure” shall mean fire, earthquake, flood, act of God, strikes, work stoppages, or other labor disturbances, riots or civil commotions, litigation, war or other act of any foreign nation, power of government, or governmental agency or authority, or any other cause like or unlike any cause above mentioned which is beyond the control of JCC.
5. SUSPENSION/TERMINATION OF MEMBERSHIP BY THE JCC: The JCC has the right to suspend and/or terminate any membership due to the disorderly or disruptive conduct, illegal activities or failure to abide by the rules and regulations set forth by the JCC, whether by the member or by any guest or invitee of the member, or due to the member’s breach of any other provision of this agreement, including failure to make any payment when due.
6. UPGRADE/DOWNGRADE: For all upgrades in membership status, the member is responsible for paying the differential in the enrollment fee, following the policies and terms of that new membership level and the appropriate scheduled fee category. For all downgrades in membership status, there is a $25 processing fee.
7. VOLUNTARY SUSPENSION OF PLATINUM MEMBERSHIP: You may voluntarily suspend your membership and place it on inactive status a) for personal reasons once in any twelve-month period for up to 3 months and, b) for medical reasons, for an indefinite period of time. Requests to voluntarily suspend membership must be in writing and submitted to the Membership Services Director with no less than thirty (30) days-notice accompanied by a monthly fee based on membership category; $25 for Individual, Senior, Young Adult and Teen membership, $35 for Couple, Senior Couple and Single Parent Family membership, or, $45 for a Family membership. If your membership is paid monthly, the regular membership dues will be replaced by the rate stated above and you will maintain your 12-month contract. If your membership is paid in full, you will be charged in full the appropriate rate as stated above multiplied by the # of months you will be inactive. This paid in full fee is due prior to and the corresponding months will be added onto the end of the contract year. There will be no back freezes allowed.
8. BUYER’S RIGHTS TO CANCEL/TERMINATE: You shall have up to three (3) days after signing this agreement to cancel your membership for any reason by written notice to the JCC given in accordance with the terms and conditions of this agreement. A member has the right to cancel or terminate this agreement after the initial one-year term on no less than thirty (30) days-notice. Notice of cancellation must be in writing and include, if applicable, payment of any outstanding charges due through the date of the proposed cancellation. Request must be e-mailed, mailed, or faxed to the address appearing on the face of this agreement to the attention of the Member Services Director. Notice is not effective if orally communicated (whether in person or by telephone). After the three (3) day cooling off period mentioned above, a member may only cancel his/her membership during the initial one year term with no less than thirty (30) days-notice for medical, financial or geographical reasons accompanied by an early termination fee based on membership category; $25 Fee for Individual, Senior Individual, Snowbird, Young Adult and Teen membership, $35 Fee for Couple, Senior Couple, Snowbird Couple and Single Parent Family membership, or, a $45 Fee for a Family membership. This Notice of Cancellation must be accompanied by a doctor’s note stating that the member is no longer medically able to be physically active, proof of a job loss or cut in wages, or, a lease, deed or other proof of new residence off Staten Island along with a utility bill.
9. CHANGE OF INFORMATION: Member must give written notice to the JCC of any changes in the member’s name, address, telephone number, e-mail address, Electronic Funds Transfer information and other billing or contact information. All written communications to the member shall be deemed received 5 days mailing, first class postage prepaid, to the last known address of the member appearing on the JCC records.
10. ENTIRE AGREEMENT: This agreement, including all documents incorporated by reference herein, constitutes the entire and exclusive membership agreement between the parties. Any promises, representations or understandings, oral or written, pertaining directly or indirectly to the terms of the JCC membership which are not contained herein are hereby waived. This agreement may be modified only by an instrument in writing signed by the party against which it is to be enforced, excepting JCC rules and regulations which are effective upon publication. No JCC member is authorized to make any separate agreement with any member or staff.
11. USE OF ANY PHOTOS FOR PUBLICITY: By signing this agreement, the member grants permission for photographs and/or videos taken by the JCC or on behalf of the JCC to be used in publications, publicity and other not-for-profit purposes. The member is not permitted to take any type of photo or video while in the Center or on its grounds.
