1. J&J Carga Abatement Services Inc. Emergency y Labor (J&J Carga Abatement Services Inc.) is Equal Opportunity Employer (EOE) that hires independent Contractors to work in demolition, restoration construction and asbestos removal.

A. This Agreement, by and between J&J Carga Abatement Services Inc. is made to show, in consideration for at-will employment with J&J Carga Abatement Services Inc, Employee is willing to abide by the following practices and policies for job safety and to maintain independent contractor status.

B. J&J Carga Abatement Services Inc. provides independent contractors, such as Employee, to various companies with whom it has Service Agreements. These companies, while not a party to this agreement, are named herein clients, client is ambiguous term not used to identify any one client. Note that Employee may for various clients, and this agreement applies to work performed by Employee for all J&J Carga Abatement Services Inc.

J&J Carga Abatement Services Inc. trabaja con varias compañías con quienes ha firmado contratos, para mandar contratistas intendentes como empleado a trabajar para ellos. Estas compañeras no forman parte de este contrato refiere a ellos, simplemente, como no forma parte de este contrato, pero este contrato se refiere a ellos como clientes, clientes es un termino antiguo. This is to specify that Employee has been informed that Employee is an independent contractor waking on behalf of J&J Carga Abatement Services Inc. Employee is ineligible to be hired directly by another company that J&J Carga Abatement Services Inc. is a subcontractor for and if Employee is contracted to do so employee is obligated, as per this document, to inform Jonathan Romero of J&J Carga Abatement Services Inc. and procure the appropriate documentation that states that both agree to direct hire at that very point in time.

Por este medio certificado que yo, Empleado, he sido informado de que soy un contratista independiente que trabaja para J&J Carga Abatement Services Incy por lo tanto, no soy elegible para ser contratado directamente por inguna otra compañía para la que J&J Carga Abatement Services Incsi se me ofrece directo para el cliente, estoy obligado, segúneste documento, a informar a Jonathan Romero, y obtener la documentación apropiada firmada, que indique que ambas partes acuerdan contratarme directamente partir del indicado momento.

Due to the nature of the work, Employee understands that it is Employee’s responsibility to ensure that Employee always wears the necessary safety equipment on the job site. This includes, but is not limited To, steel-toed boots (or non-slip waterproof boots), long jeans, reflective safety jackts, mask hard hat, gloves and safety glasses, since J&J Carga Abatement Services Inc. client are the only people responsible for ensuring that Employee’s safety equipment on site is not J&J Carga Abatement Services Inc. responsibility.

Como resultado del tipo de trabajo, el Empleado entiende que es su responsabilidad usar todo equipo necesario para su protección y su salud en el trabajo. Furthermore, Employee understands that the on-site client will provide instructions and information related to job site safety. Employee is always required to follow any instructions given by the client. Specifically, Employee must comply with duties given to me by the client and must follow any safety directives given to me by client and must follow ant safety directives given to Employee by the client.

Adicionalmente, Empleado entiende que el cliente dará instrucciones con respecto a la seguridad de con todos los trabajadores en el sitio de trabajo. El Empleado debe seguir cualquier instrucción que el cliente da. Específicamente tiene que cumplir con cualquier obligación requerida por el cliente y con cualquier regla de seguridad que el cliente estime.

Employee acknowledges that has read intends to comply with OSHA job safety rules, that Employee is aware OSHA rules can be obtained AT www.osha.gov, and that Employee will comply with OSHA safety rules, pursuant to Employee’s relevant OSHA compliance with OSHA rules are the responsibility of Employee and the on-site client.

El Empleado asegura que ha leído y tiene la intención de seguir todas las reglas de OSHA con respecto a su trabajo, que el Empleado sabe que puede obtener las reglas de OSHA en www.osha.gov, el Empleado seguirá las reglas de OSHA como las aprendió en su curso de OSHA. Employee is aware that it is Employee’s sole responsibility to notify the on-site client of any injuries suffered as a result of a workplace accident. The client will thereafter be responsible for providing medical attention as well as reporting any such workplace accidents to J&J Carga Abatement Services Inc.

Es la responsabilidad del Empleado de notificar al cliente que lo supervisa si ha sufrido alguna lesión a base de un accidente laboral. El cliente es responsable de proveer atención médica al Empleado en caso necesario y también es la responsabilidad del cliente reportar cualquier accidente a J&J Carga Abatement Services Inc.

Employee is solely responsible for providing direct information. Any incorrect information communicated by the Employee is the information J&J Carga Abatement Services Inc. use. Employee is solely responsible for any charges, delays, or any other issue related to that.

Es la responsabilidad del Empleado proveer información correcta de su depósito directo a la cuenta. Cualquier información que el Empleado es la información que J&J Carga Abatement Services Inc. El Empleado es la única persona responsable por cualquier gasto o cualesquiera retrasos causados por mala información.
